Hansz, P.E., Director of Public Works SUBJECT: Award Bid-2010 Chip Seal Project MEETING DATE: April 5, 2010 BACKGROUND: Each year the City performs significant street pavement maintenance typically as asphalt overlays or chip sealing of existing roadway surfaces to extend their service life. Pavement maintenance for 2010 will consist of chip sealing a number of streets. A single bid Was received from Pavement Maintenance Solutions of Columbia Falls for the 2010 project. Their bid totaled $143,495.88. The project will involve sections of the streets shown on the attached list and maps from the project manual. The Engineer's estimate for the work was $150,000.00; the Special Street Maintenance and Gas Tax funds contain the budget for this work. The bid was in order and the recommendation is to award the work to Pavement Maintenance Solutions of Columbia Falls. The Project Manager's analysis is attached for additional information. ACTION REQUESTED: AT CITY COUNCIL MEETING OF APRIL 5TH, MOTION TO AWARD OF THE BID FOR THE 2010 CHIP SEAL PROJECT TO PAVEMENT MAINTENANCE SOLUTIONS OF COLUMBIA FALLS. One bid was received from Pavement Maintenance Solutions Inc. from Columbia Falls, Montana. The bid is in order and contained the required Bid Bond. The bid analysis is as follows: CONTRACTOR TOTAL BID PRICE PAVEMENT MAINTENANCE SOLUTIONS INC. $ 1439495.88 The Engineers estimate for the 2010 Chip Seal Project is $ 150,000.00. Sufficient funding has been budgeted and is available in the Gas Tax and Special Street Maintenance Funds to support the project. Pavement Maintenance Solutions Inc. has completed the City Chip Seal Projects since 2006 and has consistently provided a satisfactory product. The contract primarily consists of fur- nishing materials, labor and equipment required to chip , seal approximately four miles of City streets. Bidding documents may be ex- amined or obtained from the City of Kalispell Public Works Depart- ment, 201 First Avenue East, Kalispell, Montana 59901. A non-refundable fee of $15.00 will be charged for each set of bid- ding documents obtained. Construction of the 2010 Chip Seal Project shall not begin prior to June 1, 2010 and shall be completed on or before August 15, 201 0. Construction of the 2010 Chip Seal Project shall be performed by a Contractor who is regis- tered with the Montana Depart- ment of Labor and Industry.. The Contractor shalt be properly reg- istered at the time of submitting the Bid. Any bidder wishing further in- formation may obtain the same from the City of Kalispell Public Works Department, 201 First Avenue East, Kalispell, Montana 59901. Phone 405-758-7720. Bids will be received by the City Clerk, 201 First Avenue East, Kalispell, Montana until 2:30 pm on Tuesday, March 23, 2010. All bids must expressly cove- nant that if the bidder shall be awarded the contract, the bidder shall within fifteen (15) calendar days of the acceptance of said bid by the City Council, .enter in- to a contract and give good and sufficient bond to secure the per- formance of the terms ' and con- ditions of the contract. In the event the successful bidder does not enter into a formal contract within fifteen (15) calendar days or give -sufficient bond to secure performance, the bidder shall pay unto the City the difference between the amount of the bid of said bidder and the amount for which the City legally contracts with another party to perform said work if the latter amount is more than the former. No bid shall be withdrawn after the opening of bids without the consent of the City Council for a period of sixty (60) days after the scheduled time of receiving the bids. The City will accept -the lowest responsible bid, but the Council. _ reserves the right to reject any and all bids or to waive any tech- nicality or informality and accept any bid which may be deemed in the best interest of the City - The successful bidder will be required to abide by Federal and State laws, particularly Section 18-2-401 et, seq., M.C.A. (Mon- tana Prevailing wage Rates) The successful bidder will be required to. furnish an acceptable security for the full amount of the contract for faithful performance thereof and payment of labor, material and subcontractor claims. The successful bidder shall be required to furnish the City of Kalispell evidence of insurance in accordance with the Fifth Edi- tion of the Montana Public Works Standard Specifications. The successful bidder shall name the City of Kalispell as ad- ditional insured on said policy while performing work under City contract.
