Ordinance 1694 - PUD Agreement Extension - Cornerstone Community ChurchPLANNING FOR THE FUTURE MONTANA REPORT TO: Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Jane Howington, City Manager Planning Department 201 1" Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.kalispell.com/planni*n2 SUBJECT Cornerstone Community Church/Valley Bank — Request for one-year extension of the Planned Unit Development overlay zoning MEETING DATE: March 21, 2011 BACKGROUND: This is a request by Ron Rosenberg, President of Valley Bank of Kalispell and Luke Knoll, Pastor of Cornerstone Community Church for a one-year extension of the Planned Unit Development (PUD) overlay zoning on the properties. Both letters state that because of the current economic climate in the valley, Valley Bank is not ready to begin construction of a new bank this year. In April of 2009 the city council approved. ordinance no. 1655 creating a PUD overlay zoning district on approximately 3 acres located at the northwest corner of Highway 93 and Northridge Drive. The PUD was approved in conjunction with the B-1 (Neighborhood Business) zoning district. The PUD permitted the construction of a bank at the corner of the Northridge Drive and Highway 93 with shared parking between the bank and existing church. Condition 10 of ordinance no. 1655 granted the property owners two years to obtain the permits to begin construction of the bank and shared parking lot with the possibility of a one-year extension of the PUD. The one- year extension is required to be approved by the city council. The two-year PUD approval ends on April 6, 2011. A one-year extension would give the property owners until April 6, 2012 to obtain permits to begin construction on the site. If the city council elects to extend the PUD for one year and Valley Bank still does not obtain the permits to begin construction by April of 2012, the owners still have the ability to request future extensions for the PUD plan from the city council. Section 27.19.020(10)(a)(2) of the Kalispell Zoning Ordinance. allows landowners to request additional extensions for their PUD zoning district from the city council provided they present the council with a revised completion schedule for the project. RECOMMENDATION: A motion to grant a one-year extension to the PUD zoning overlay district would be in order. FISCAL EFFECTS: Minor positive impacts once fully developed.
