Resolution 5488 - Grant Acceptance and Budget AppropriationCity of Kalispell Post Office Box 1997 -Kalispell, Montana 59903 Telephone: (406) 758-7701 Fax: (406) 758-7758 REPORT To: Mayor Tammi Fisher and Kalispell City Council FROM: Michael Baker, Director of Parks & Recreation Jane Howington, City Manager SUBJECT: 2010/2011 ARRA Urban Forestry Grant Award MEETING DATE: March 21, 2011 BACK GROUND: Last year the Montana Department of Natural Resources and Conservation made available a total of $325,000 to Montana cities and towns interested in conducting innovative urban community forestry projects. The Kalispell Parks and Recreation department submitted a successful grant application for $93,500 to address Dutch Elm Disease in the city. In spring of 2010, Kalispell was awarded an additional $11,500 to continue the project for a total grant funding of $105,000. Recently the city was notified once again that DNRC had additional funds available from other cities and towns that were not able to utilize all of their project monies. Kalispell Parks and Recreation submitted a proposal to utilize the available $4087.30 to remove four Dutch Elm diseased trees and plant four replacements. To date 97 diseased American Elms have been removed and disposed of and 67 replacement trees planted. Our existing service contracts will be utilized for the completion of the project. RECOMMENDATION: Approve resolution accepting the additional grant monies and approving the budget appropriation. WHEREAS, on August 16, 2010, the City Council adopted Resolution 5444 adopting the annual appropriations of the City of Kalispell for fiscal year 2010-2011; and WHEREAS, on October 9, 2009, the City of Kalispell received an American Recovery and Reinvestment Act (ARRA) Urban Forestry Grant through the Montana Department of Natural Resources and Conservation and the US Forest Service in the amount of $93,500 to address Dutch Elm Disease in the City of Kalispell; and WHEREAS, in February, 2011 the City of Kalispell applied for and was awarded an additional $4,087.30 to complete additional work on the project; and WHEREAS, said funds available to the City were not appropriated pursuant to Section 7-6-- 4271, and an increase of appropriation authority is needed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALIS PELL AS FOLLOWS: SECTION 1. That the City Council hereby accepts an additional ARRA Urban Forestry Grant in the amount of $4,087.30, for a total grant award of up to $109,087.30. SECTION II, That the City Council hereby appropriates the additional sure. of $4,087.30 and directs the Finance Director to allocate said amount to expenditure code: 2602-436-46043 3-3 54. BOX 1997, Kalispell, MT 59901, hereinafter called the "Grantee". Except to the extent amended by this Amendment #3, and by Amendment #1 and #2, Grant Agreement ARRA--10-302 remains fully in effect. The parties to this Amendment #3 to Grant Agreement No. ARRA-10-302, in consideration of the mutual covenants and stipulations, and Pursuant to SECTION 15, ASSIGNMENT AND AMENDMENT, agree to amend the following sections of Grant Agreement No. ARRA-10-302 as follows; SECTION 4s PROJECT SCOPE is hereby deleted and the following inserted in its place: "SECTION 4. PROJECT SCOPE. (A) The Grantee shall use the proceeds provided pursuant to this Grant Agreement to perform allowable activities under ARRA as administered by the USFS. t These funds must relate to urban forestry practices, which for the purpose of this Grant Agreement are considered to be tree planting for energy conservation in cities and towns, or planting, pruning and hazard tree removal of park, street and boulevard trees The key outcome of the project will be the removal of approximately 94 trees and plantings of approximately 70 trees within Kalispell city limits. Proper disposal methods will be utilized to dispose of disease' or affected trees. (13) supporting documents and attachments. The approved project proposal, as defined in Appendix D, "original Project Proposal;" Appendix E, "Approved Alterations to Proposal;" and Appendix F, "Additional Requirements to Proposal," shall constitute the entire scope of work to be completed under this Grant Agreement." SECTION 6. GRANT DISBURSEMENTS is hereby deleted and the following inserted in its place: "SECTION 6. GRANT DISBURSEMENTS. The Grantee shall submit claims for disbursement of Grant Agreement funds to the DNRC Procurement officer. Documentation of reimbursable costs incurred must be submitted with the disbursement requests. Documentation may include but is not limited to itemized receipts, vendor invoices: inspection certificates, financial reports, and payroll records. DNRC will determine whether documentation submitted adequately supports the disbursement request and may require additional documentation before approving payment. Each disbursement must be approved by the DNRC Procurement officer or her designee prior to submission of an invoice for payment. The DNRC will verify the claims and check them against the Reports required in Section 7. The DNRC will disburse Grant Agreement funds to the Grantee upon DNRC's approval. Reimbursement of Grantee's expenditures will only be made for actual, incurred expenses that are included in the Budget Form provided in Appendix D, E and updated in the table below; are expended for approved project activities, as outlined in Appendix D, E and updated in the table below; and are approved for reimbursement by the DNRC Procurement officer or her designee. The DNRC will withhold five (5) percent from each payment, up to a maximum of Five thousand four hundred fifty-four and 37/100 dollars ($5,454.37) of the total authorized Grant Agreement amount until the project tasks outlined in section 4, Project Scope, and the Final Report required by Section 7, Program Performance Reports, are completed by the Grantee and approved by the DNRC,," Additional Funds Added to Pro-ect Budget Project Activity Expense Remove and Replace Trees $4,087.30 Total Additional Funding Amount $4, 087.30 Total payment for all purposes under this Grant Agreement shall not exceed One hundred nine thousand eighty seven and 30/100 dollars ($109,087.30).
