Resolution No. 5511-- a Resolution to Declare an :.emergency
Caused by River Erosion
MEETING DATE, July 18, 2011 - Regular Council Meeting
The extraordinary 2010/2011 winter snow pack experienced within
the Flathead valley watershed caused extremely high spring and early summer river
flours that eroded, damaged and continues to threaten valuable property within the City
of Kalispell. The city owned property known as the Buffalo Hills Golf Course, as well as
surrounding private properties, suffered extensive damage due to erosion from the
Stillwater Diver and is compromised to the extent that further erosion may cause the
river channel to become redirected further threatening extensive property and possibly
essential city utilities. The purpose making a declaration of emergency is to activate
applicable parts of the local or inter] urisdictional disaster and emergency plan and
program pursuant to .MCA 10-3-402 and to authorize the furnishing of aid and assistance
in accordance with such plans and programs. such assistance is not available unless the
City makes such a declaration.
RECOMMENDATION.* That City Council gives consideration to and pass Resolution
No. 5511.
FISCALIMPACTS: Passing the resolution making the declaration of emergency has no
positive or negative fiscal impact. However, the City will have positive fiscal impacts if
federal or state aid becomes available as a result of the declaration to alloy for
mitigation to preserve the city's assets as well as the assets of private individuals.

OF EXTRAORDINARY SPRING SNOW MELT CAUSING LOCAL RIVERS TO ERODE,
DAMAGE AND THREATEN VALUABLE

WHEREAS, the city owned property known as the Buffalo Hills Golf Course, as well as surrounding
private properties, suffered extensive damage due to erosion from the Stillwater River
and is compromised to the extent that further erosion may cause the river channel to
become redirected further threatening extensive property and possibly essential city
utilities; and
WHEREAS, the purpose of this declaration is to activate applicable parts of the local or
interjurisdictional disaster and emergency plan and program pursuant to MCA 10-3-402
and to authorize the furnishing of aid and assistance in accordance with such plans and
programs; and
WHEREAS, the Kalispell City Council finds that it is in the best interests of the City and the citizens
and taxpayers of the City of Kalispell that a declaration of emergency be declared so that
assistance may be solicited from the available various disaster resources.
Now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL
AS FOLLOWS:
SECTION I. That an emergency is declared pursuant to MCA 10-3-402 because extraordinary

caused extremely high spring and early summer river flows that eroded, damaged
and continues to threaten valuable property within the City of Kalispell..
SECTION II. that copies of this resolution shall be filed with the City Clerk and the Montana
Disaster and Emergency Services Division in Helena, Montana.
SECTION III. this resolution shall. become effective immediately upon its passage and approval
by the Kalispell. City Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR. OF THE
CITY OF KALISPELL, THIS 18TH DAY OF JULY, 2011.
