Resolution 5504 - Annexation Request - Todd and Theresa CardinREPORT TO: Kalispell Mayor and City Council FROM: Sean Conrad, Senior Planner Jane Howington, City Manager SUBJECT: Cardin - Annexation and Initial zoning of R-2 Residential MEETING DATE: July S, 2011 BACKGROUND: The Kalispell City Planning Board met on June 14, 2011 and held a public hearing to consider a request by Todd and Theresa Cardin to annex approximately 0.26 of an acre into the City of Kalispell. The owners have requested R-2 Residential zoning on the property. The 0.26 acre project site is located on west side of South woodland Drive at the intersection of South Woodland Drive and Quincy Loop. The property is currently vacant and can be described as Lot 4 of Block 3, Greenacres Northwest as shown on Certificate of Survey #18774 located in the SE4 of Section 17, Township 28 North, Range 21 west, P.M.M., Flathead County, Montana. Kalispell Planning Department staff presented staff report #A-11-02 providing details of the proposal and the evaluation. Staff reported that the proposed R-2 zoning district was compatible with surrounding land uses and also consistent with the Kalispell Growth Policy which designated the area as urban residential. Staff recommended the board consider recommending the council approve the annexation request and initial zoning of R-2 based on findings in the staff report. At the public hearing there was no public comment and the public hearing was closed. The board briefly discussed the annexation request and recommended the city council consider approving the request to annex and assign the R-2 zoning district on the property upon annexation. The vote was unanimous. RECOMMENDATION: A motion to approve the resolution annexing the property and a motion to approve the first reading of the ordinance for initial zoning of R-2 Residential would be in order. FISCAL EFFECTS: The cost of services analysis indicates that the annexation will generally be revenue neutral or possibly slightly beneficial for the city. The standard cost of services figures are based on an average residential piece of property on the outskirts of the city which will receive new city services. However, it should be noted that the property to be annexed is already wholly surrounded by the city. The property already has access to city parks, city police cars drive past the front of the property and the property abuts South Woodland Drive a developed city street. The cost of streets, parks and police have been removed from the cost of services analysis as these services are already available to the site whether the property is annexed or not. A public hearing has been scheduled before the Kalispell City Planning Board for June 14, 2011 be ' g at 6:00 PM, to consider the annexation request and the appropriate zoning for the property to be annexed. The planning board will forward a recommendation to the Kalispell City Council for consideration. BACKGROUND INFORMATION In April the planning board considered an annexation and initial zoning request for an existing lot, lot 5 of Block 3, Greenacres Northwest. Lot 5 is approximately 11,325 square feet in size, is owned by Todd and Theresa Cardin and is located adjacent to South woodland Drive. The Cardin's also owned several lots to the rear (rest) of Lot 5 but did not include them in the annexation request. The planning board recommended annexation of lot 5 with the initial zoning of R-2 to the city council. The city council annexed the property at their May meeting and zoned the property R-2 upon annexation. The Cardins then began designing the home they intended to build on the lot. Upon submitting building plans to the city, the Cardins realized that the house design was larger than just lot 5 would accommodate. Therefore, they are now requesting to annex and consolidate Lot 4 which they also own with Lot 5 to mare one larger building lot. The Cardin's are therefore now requesting annexation of lot 4 to permit the consolidation of lots 4 and 5 and accommodate the location of their future home on the property. Please note that the Cardins also own additional lots immediately abutting and to the west of lots 4 and 5. They plan to develop an orchard with fruit trees on the property and have no plans to annex this land into the city at this time. This report evaluates the annexation request and the appropriate assignment of a City zoning classification in accordance with Section 27.03.010(4) of the Kalispell zoning Ordinance. This property will be annexed under the provisions of sections 7-2-4601 through 7-2-4610, M.C.A., Annexation by Petition. A. Location and Legal Description of Property: The lot is located on the west side of South woodland Drive at the intersection of South woodland Drive and the southern lane of Quincy Loop. The 11,325 square foot lot can be legally described as Lot 4 of Block 3, Greenacres Northwest, as shown on Certificate of Survey 15774 located in the SE 1/4 of Section 17, Township 28 North, Range 21 ]Vest P.M. Existing Land Use and Zoning: The property proposed for annexation is located within the Greenacres Northwest subdivision, a 29--lot subdivision platted in the County in 1941. The annexation and initial zoning request is for an existing lot approximately 11,325 square feet. The lot is currently undeveloped and the property owners intend to consolidate this lot with Lot 5 to the east which was previously annexed last month. They then plan to build one single family home on the consolidated lots. The current county zoning on the property is R-2, one Family Limited Residential. This district is defined as "A district to provide for large -tract residential development. These areas will typically be found in suburban areas, generally served by either surer or crater lines." Permitted uses in this district are generally limited to residential uses. The conditionally permitted uses allover some non-residential uses but those are limited to churches, daycare centers, bed and breakfasts, schools and golf courses. The minimum lot size requirement of the County R-2 zoning district is 20,000 square feet. D. Proposed Zoning: The proposed R-2, Residential, zone allows single-family residences and has a minimum lot size requirement of 10,000 square feet and a width of 70 feet. The proposed City R-2 district more closely reflects the existing single family residential nature of the area and intended uses for the property. E. Size: The area proposed for annexation and zoning contains approximately 11,325 square feet. 2 Adjacent Land Uses and Zoning: The South woodland area is primarily developed with single --family residences. General Land UseCharacter: The general land use character of this area can be described as primarily single family residential. There is an existing mobile home parr located approximately 1/4 mile southof the project site. However, the mobile home park is the anomaly in an area otherwise built with detached single-family homes. H. Utilities and Public services: All available public services and facilities are available to the property owner. water and surer main lines are located directly in front of the property requesting annexation within the South. woodland Drive right-of-way. If annexed, the owner would have to pay water and sewer impact fees prior to connecting to the city's water and serer lines. Compliance with the growth polio : Chapter 2 of the Kalispell Growth Policy discusses the issues with cyclical growth the city has seen over the years. The chapter focuses on affordable dousing, delivery of services, location of new development, redevelopment of the existing urban core and quality of life issues. As part of the review of the annexation request the following goals contained in chapter 2 are relevant to this particular annexation. request. The goals are: Implement a comprehensive, effective growth management program that recognizes and upholds the general welfare of the community as well as individual rights. New urban and suburban development occurs in areas where public water and sewer are available. In addition to the two cited goals, the city council has recently adopted an annexation policy with a corresponding reap as an addendum to the city's growth policy document. The purpose of the annexation policy is to give the planning board, the council and the development community direction when property owners outside of the city limits are requesting municipal services and 3 annexation.. The property requesting annexation falls inside the annexation boundaries for property owners to request direct annexation into the city. Public grater and sewer main lines are located immediately east of the property requesting annexation. The main lines are within the right-of-way for South Woodland Drive. If annexed, the property would have access to connect with the water and surer main lines provided the appropriate impact fees and necessary permits are obtained from the city first. 2. Municipal Services: As stated above water and sewer main lines are located east of the property. These main lines are adequate to serve the future home on the property requesting annexation. Fire hydrants are located on the west side of South Woodland Drive. One hydrant is approximately 300 feet south of the project site; the other hydrant is approximately 100 feet north. Given the close proximity to existing services, annexation of the property will not overburden the municipal services currently in. place. 11 Figure 2: Current city limits and existing city utilities in the area. The map in figure 2 also provides an illustration of the current city limits in relation to the property requesting annexation. 4, Cost of services; Drake annexed to the city, full city services wiH be made available to the property owner. Any necessary infrastructure associated with this development will be required to be constructed in accordance with the City of Kalispell as Design and Construction standards and any other development policies, regulations or ordinances that may apply. when annexed, ed, the property owner wig. be connecting to city water and sever serve ces prior to completing the home on the property. The attached cost of services analysis prepared for this property is based on a. form that is used for all residential annexations for residential land up to one- half acre. This form however has been modified specifically for those annexations which involve wholly surrounded properties. The assumption here is that because of the unique location of the property surrounded by the city, many services are already being provided to or available to this property by the city without the benefit of the wholly surrounded properties paying for then Examples would be the abutting city street, South Woodland, which is already maintained by the city, police protection from city police which already patrols past this property as officers drive by in route to other areas in the city, access to city parks which are developed for city residents in the area, etc, Administration costs, fire protection, surer, storm suer and grater service were included as these are considered new services. As always, please note that the information can only be used as a general estimate of the anticipated cost of services and revenue. This cost of services analysis was re -done to reflect both Lot 5, which was annexed last month, and lot 4 which is the basis of this report as both lots and the proposed single family house make a single development unit. The attached cost of services analysis for the combined lots and house shows that approximately 1,050 will be generated per year from assessments and property taxes. To serge the property with water, sewer, and storm water as well as fire services and general city administration the cost is estimated at approximately $812 per year. Based on the estimated revenue paid to assessments and property taxes this annexation will generate a net increase of 59 per year. This is only an estimate. The 9 amount would help to pay for the services and impacts to city infrastructure already being e penence by the city due to the wholly surrounded location of this property.
