BACKGROUND: The Kalispell City planning Board Tact on January I I t, and held a public hearing
to consider a request by Digital Skylines, Inc., representing Verizon wireless, for a conditional use
permit to install an 80 foot self-supporting cellular tower and a 12 foot: by 26 foot prefab equipment
building inside a 42 foot by 70 foot fenced lease area. The cellular tower and accompanying lease
site is proposed at 139 Kelly Road. The property is one acre in stze and is located on the north side
of Kelly Road, approximately 900 feet east of the intersection of Kelly load and Highway 93. The
proper is legally described by Certificate of Survey No. 3537 located in the SW V4of the NE 1f of
Section 20, Township 28 North, Range 21 west.
Kalispell Plannir g Department staff presented staff report ICU-10-7 and reviewed the proposed site
plan. Staff recommended approval of the conditional use permit subject to 8 conditions,
At the public hearing the applicant spoke in favor of the project as well as a neighboring property
owner. No one else spoke in favor or against the conditional use permit request and the public
hearing was closed.
The board discussed possible aesthetic concerns with a tower so close to existing homes, whether to
recommend a mono pole tower design and if the tower should be rewired to look like a tree. The
board also discussed the location of the tower, its proximity to the adjacent residences and if the
tower should be to cat ed to another site on the property. At the conclusion of the bo and ' s discussion
the planning recommended the city council consider approving the conditional use permit subject to
the 8 conditions listed in the staff report. The vote was unanimous. No changes to the location or
design of the tower were reconended by the planning board.

January 11, 2011, held a public hearing on the application, took public comment and recommended that
the application be approved subject to eight conditions.
After reviewing the application, the record, the I PD report, and after duly considering the matte`,
the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts
Kalispell Planning Department Conditional Use Report #KCU-10-7 as the Council's findings of fact, and
issues and grants to the above -described real property a conditional use permit to construct and operate an
80-foot cellular communication tower and an equipment building at 1. 39 Kelly Road in the Industrial --
Business, B-5, zoning district subject to the following conditions:

of authorized activity has not begun. Activity can be demonstrated by a continuous, good faith
effort to secure financing, permits} engineering and. design.
8. Should the tower be abandoned or cease to operate for a period of 180 days, the tower shall be
removed at the expense of the owner. It shall be the responsibility of the structure/tower owner to
promptly notify the city if a facility is abandoned or ceases operation.

B. Size and Location: The cellular tower and accompanying lease site is proposed at
139 Kelly Road. The propel is one acre m size and is located on the now side of

equipment and materials for a. masonry business (Root Masonry). The property is
fenced with little other iumprovements.
The property is zoned B-5, industrial -Business, which requires a conditional use
permit for cellular tourers within the district. The B-5 zoning district permits a variety
of commercial and light industrial uses with development typically not creating
objectionable characteristics such as dirt, noise, glare, heat, odor, smoke, etc., which
extend beyond the lot lines.

b . Height, bulk and location of structures: The height of the tower is proposed at
80 feet with a live foot lightning rod at the top of the tower. The tourer would be a
lattice tower as opposed to a single pole and located at the northeast corner of
the proper. One equipment building would be located at the base of the tower.
A six foot block wall with a. chamn link gate on the west sidle of the gall will
surround the tourer and equipment building.
C. Adequate Access; Access to the area where the cell tower will be located is via a.
driveway off of Keller Road. The driveway leads to an e>dst .g fence line around
the property. There is adequate access to the site.
d. Enviromnental Constraints,;,Mere are no obvious enwronmental constraints
associated with this property or in the area such as floodplain or wetland areas,
steep slopes or severe drainage problems. the site is nearly level and there, i

a. Parldng_Scheme: section 27.24.050 of the Xalispell Zoning ordinance provides
for num' um off-street parting standards by use. cell towers or sim :far uses are
not included in the list of uses under tWs section of the ordinance. Section
27.24.050 subsection 4 states that in the ease of a use not specifically
mentioned in the ordinance the requirements for off-street parking ng will be
determined by the zoning administrator based upon the requirements for the
most simflar use listed in the ordinance.
The application states that the site is u=anned with a tecbxiician rnaldng

recommending any off-street parking ng for the cell tourer based on the following;

b. Traffic Circulation:- Traffic to and from the cell tower site would be from Kelly
Road, south of the tower site. Traffic circulation to access the tourer is good and
the maintenance visits will not disrupt traffic circulation in the area.

other than those associated With the required setbacks, which have been
adequately observed on the site plan.

on the rear portion of the property. The property bounder is c=ently fenced
with chain hnk fencing topped with three strands of barb wire. The applicant is
proposing to construct a decorative wall around the site to avoid tampering with
the cell tourer and equipment structure. The wall would be constructed out of
contrasting block colors and/or fishes on the columns and capstones of the
wall. Planning staff is recommending the wall design he re e ed and approved
by staff prior to issumrg a building pen -nit for the cell tower. No additional
landscaping, fencing or screening appears to be necessary. If neighborhood
concerns from the now of the lease site are voiced over aesthetics, it may be
appropriate to consider fast growing tree species such as Poplars to ring the site
and f or require the cell tower structure to be camouflaged using a pine or fir tree
design.

the school district can be anticipated as a result of the proposed use.
b , Parks and Recreation! There are no city parrs whin the immediate proximity of
this property. There wfll not he any impacts to the parks or the Kalispell Parks
and recreation Department associated with the proposed use.
C. Pohce: This facility is currently served by the Kalispell Police Department. No
increased impacts to the police can be anticipated as a result of ` the proposed
use.
d. Fire Protection: Fire protection is currently provided by the Kalispell Fire
Department. There is a hydrant on the southeast comer of this property along
IeUy Road. Access to the site and the cell tower are good and it does not appear
that any modifications to the proposed site layout would he necessary to
accommodate the fire department's needs.
e* Water: City grater currently serves the site, however the tourer wiu not creed
water semees.
f. sewer: sewer service is currently provided by the City of Kalispell, however, the
tourer will. not rewire surer services.
g. Storm water: 'Ihe project includes placing a new equipment shelter}
approximately 300 square feet, and cell tower within a. 2,800 square foot lease
area. Although this is a small area., a storm grater management plan and permit
is still required. In addition to the permit a storm water impact fee will be
required for the new impervious surfaces associated with the development. The
impact fees are paid at the time the building permit is issued.

h. Solid Waste: Solid waste pick --up is currently provided by the city; however, the
tower use should not require any reed for garbage pick --up services.
L Streets: Access to the property is currently provided to the site from a. city street,
Kelly Road. Kelly Road is adequate to accommodate the proposed use and
associated traffic.
Sidewalks and bike trails: Kelly Road does not have any sidewalk or bike trails
along it. However, the proposed use will not generate foot or bicycle traffic that
warrants any sidewalk or trail i�provernents in the area or on the property.
4. Chapter 2734 of the Kalispell Zoning ordinance requires certain. conditional uses
including transmission towers and cellular communication towers, equipment
and facilities to incorporate additional review criteria in the review and evaluation
of the use. A review and analysis of the additional criteria is as follows;
The location of the transmission tourers and cellular communication towers,
equipment and facilities shall take into consideration the following:
(a) Visual effects;
The proposed cell tower will. be 80 feet tall, approximately 30 to 40 feet
taller than existing trees located north of the lease site based on
information on sheet - , Overall Site flan, in the application. The tower
will be the tallest structure in the immediate area and will be visible to
adjacent residential and commercial properties. The cell tourer is proposed
to be constructed out of pre--oidied steel that would dull any shiny
portions of the tower.
(b) Height;
The height of the tower is proposed at 80 feet with a. 5 foot ]lightning rod tip,
The tower is proposed. at 80 feet to rM411ix ize interruption of signals from
surrounding trees and buildings and provide the coverage needed to the
targeted service area.
(c) Structural integrity;
The tower will be constructed to withstand the required wind and ice loads
encountered in the area., Venizon wireless conducts soil studies to
determine the appropriate footing design and required footing depth. This
rnfojrrrxation will be included with the building permit application to insure
structural integrity of the tower.
(d) Radiation emissions,,
Veri on wireless is licensed to operate within certain frequencies by the
Federal ommunicati.ons Commission. The proposed tower site will
operate within the limits of Veri on as license.
(e) Effects on adjoining land use;
The applicants are proposing the tourer at this location to enhance the

wireless conurracation services for lands within the service area. The
tower will protrude above the tree line located to the north of the lease site.
Aesthetically, the proposed tower may impact adjacent property owners.

ffl Possibility of shared use;
erizon Wireless states in their application that they do allow collocation
on their tourers. The proposed tower is designed to accommodate more
than one set of antenna's however the number of additional antenna's may
be 'ted based on the proposed height of the tower and sinTound g
buildings and trees.
(g) Effects on city airport operations;
The Federal Aviation Administration (FAA) has determined that the
proposed tower will not impact the operations at the airport. The city's
airport manager was notified of the proposed tower and after spearing with
the regional FAA coordinator for the city airport, concurs with the FAA
letter submitted with the application,
(h) Effects on other communication devices
eAzon Wireless is required to operate within its frequency spectrum they
are licensed for. Their application states that other devices including TVs,
radio and other wireless carriers will not be affected ley the proposed. tower.

(i) Site location alteratives.
Based on their application, Verizon Wireless investigated several other
possible sites. These sites included the city airport, the lights at Legends
Field, two other properties along Kelly Road and the two radio tourers
associated with the former KGEZ radio station.
The airport declined the offer to locate a tower on the property and the
lights at Legends Field would have been too close to the exi'sting Verizon
Wireless site to add the needed capacity to the area. The ex-Isting radio
towers are not FAA compliant and therefore were not considered. The other
sites along Kelly Road were not given prio ity . part because 'erizon
Wireless wanted to locate the tower on the property furthest from the city
airport.
General requirements of a Conditional Use Permit for locating a transmission
tower or cellular communication tourer shall include. -
(a) Required collocation on an existing tourer or other structure
whenever possible and practical;
The closest existing tower is located approximately 1 14 rm'les to the
northwest on land outside the city. The existing tourer, a 11 o foot
monopole, is located on an 8 acre tract of land located off of Ashley
Drive. In 2007 the county approved conditional use pest FCU -
o 7 T 14 to construct the 110 foot cell tower. The applicant was made
aware of the tower location and was requested to look into the
feasibility of collocating on this tower.
Upon review, the applicant stated that the existing 110 foot
monopole is too close to an existing Verizon Wireless tower located at
5 5 Third Avenue Vest North in Kalispell. If they were to use the 110
foot monopole their coverage's would overlap and not provide the
additional coverage along Highway 93 south of the airport, which the
tower location under consideration Will provide.
(b) Screening equipment and structures when located adjacent to a
residential district}
The applicant has proposed a decorative wall around the perimeter
of the lease site. This wall W'111 significantly shield the equipment
building from the residential hones located north of the lease site
The tower, at 80 feet, is more difficult to screen totally from the
residential hornes. Frees Located north of the lease site will provide
some screening however the planning board may want to consider
reuirl g additional landscaping such as Poplars and f or require the
cell tower structure to be camouflaged using a pine or fir tree design to
help to partially screen or camouflage the tower. The planning board
should consider this if aesthetic concerns are raised by the adjacent
residential property owners or the planning board has these
concerns.

(C) Engineer's certification regarding structural safety;
Planning staff is recommending an engineer's certification regarding
structural safety be required as a condition of approval. The
certification a� should be submitted once the tower is constructed..
(d) Location of the tower so that visual impact to adjacent property
owners is limited to the greatest extent possible;
The proposed tourer is located at the north end of a commercially
zoned. property. This location reduces the visual impact the tourer
would have on adjacent property owners to the south and the
traveling public along Kelly Road. However, this location does have
the potential to impact the neighboring residential property owners.
At 80 feet it would be difficult to mitigate the visual impacts to
adjacent property owners completely. The planning board may want
to consider some type of landscape screening as suggested in
subsection b above.
(e) That the structure be placed to avoid location on the crest of a
mountain or hill or extension into the skyline thus creating aesthetic
concerns;
The application states that the proposed tourer does not break any
mountain skylines. This is true. However, the proposed tower does
extend into the immediate skyline taller than any of the surrounding
buildings and trees. Based on a conversation with the applicant,
reducing the height of the tower would not achieve veri on#s
objective of increased coverage on Highway South.. Therefore, if
aesthetic concerns are raised the planning board should consider
mitigating these concerns with tree plantings of a species that would
grow to a height to help camouflage the tourer, such as Poplars, or
requiring the cell tower structure that pies a pine or fir tree.
Address potential FAA (Federal Aviation Adr inistration) lighting
requirements for aviation safety;
No lighting is necessary based on a letter from. the FAA. issued duly
11 010.
(g) That the structure/tower be camouflaged to blend m with the
surrounding environment;
The applicants are open to a required color for the tourer based on
input from the public, planning board or council.. At this time the
tower would be a metallic colon unless conditioned otherwise.
(h) The new structure shall allow for collocation with a minimum of four
other users;
The proposed tower could accommodate up to three other users. To
accommodate four other users the tower would have to increase in
height and planning staff is not recommending any additional height

increases.
Based on information provided by the applicant, they are pursuing
additional tower locations throughout the county to increase
coverage and service. Additional height does not necessarily serve
therm since each cell tower site can only handle a finite number of
calls and wireless data transactions.
i That all transmission and cellular communication towers he located
a minimum of one mile mart, unless collocation opportunities do
not exist;
The applicant has searched the area and found that there are no
other cell tourers within l mile of the proposed. site. As mentioned in
subsection a., the closest cell tourer is approximately i 14 miles to the
northwest.
The applicant states M the appli.cati.on that as the need for wireless
capacity increases, the required height for cell towers decreases.
With the increase in demand, cell tourer sites are being located closer
together and thus the height of the towers dices net need to cover a
large geographic area. The application also states "with the federal
government limiting the amount of available wireless spectrum, the
only way for carriers to add capacity is to add cell sites*"
If a. security fence is proposed, a five foot tail dense landscaping
screen shall he planted around the security fence of any
structure / tower;
The applicants are requesting to not install the landscaping screen
but instead construct a decorative block waH to help conceal the
equipment at the lease site. The gall would be in lieu of a chain link
fence. The solid block wall achieves the intent of the five foot tad
dense landscape screen which is to screen equipment at the facility
from adjacent properties
(k) where a new tower is proposed, the applicant skull demonstrate that
there is no feasible existing structure on which to locate;
As stated previously in this report, the applicant has reviewed
several other locations including existing towers and they are not
feasible to provide the coverage Verizon wireless is wanting or are
not FAA approved. towers. Included with the application are two
attached reaps. The maps, titled Kalispell area Current Sites
Coverage and Kalispell Area Current Sites .plus .urbout Proposed
`overage are computer generated that show the current and
proposed coverage for Verizon Wireless around. Kalispell. Yellow is
the strongest signal, blue is next, and red is the weakest. The white
areas have mirlimal or no coverage.
On the reap titled Kalispell Area Current Sites Coverage there is a
large band of blue in the southern portion of Kalispell. If a new cell
tower site is not permitted., the application states that there will be

more dropped phone calls, blocked calls, and lower data speeds in
the area. The reap including the proposed cell tower, titled. Kalispell
Area Current Sites Plus Burbout Proposed Coverage, shows the
southern area of Kalispell with Most entirely yellow areas, the
strongest signal.
Prior to submitting a conditional use permit application Venzon
Wireless had their RF engineers produce a search axea map with
about a 12 mile radius almost entirely on the east side of Highway
93. Kelly load is approximately in the center of the search ring.
The search ring produced by the Verizon wireless RF engineers is
the real estate road neap for where to look for a site. The engineers
draw the search ring based on: current wireless traffic on esting
sites, wireless data speeds, customer complaints, and drive test data
compiled by the veri on wireless test gran. The real estate
consultants take the search area map and compare it to zoning and
the built environment. The result of this work is the application that
has been submitted for the cit 's consideration.
(1) A freestanding tower shall be setback from the right-of-way line(s) a
distance equal to the height of the tower.
The tower is located approximately o feet north of the Kelly Road
nght-o way. This distance is higher than the height of the proposed
tower.
F Neighborhood impacts,: No neighborhood impacts are anticipated with regards to
light, dust, fumes or noise with the approval of the conditional use permit to allow the
proposed cell tower. The only noise generated on the site is by two -ton HVA
wits. The units are proposed to be placed on the south side of the shelter, away
from the residential. lots. There is a backup generator to allow operation during
the time of a commercial power outage. The generator Is internal to the shelter
and the application states that it does not emit much. noise. The generator will be
exercised weekly for about 20 minutes typically ding the middle of the day..,
during the work week. Based on the limited use and weekly run time of the
generator ,staff does not consider the noise as an impact to the neighborhood.
Given the close proximity of the proposed 80-foot tower to the residential homes,
aesthetic concerns may be raised by the neighboring homeowners; As of the
writing of this report however no comments from the adjacent residential property
owners have been received.. if concerns are raised or the planning board has
concerns with. the aesthetics of an so -foot tower appro 'mately 50 feet from
residential lot lines to the north landscaping should be considered as an
appropriate form of mitigation whether in the foram of fast growing trees (i.e.
Poplars) or in the design of the cell tower structure (pine or fi_r tree design) .
5.0 Consideration of Mitt cal use patterns and recent changes: The proposed
cell tower site is on the northern boundary of a commercial / industrial zoning
district. Land to the cast, west and south has been used for a variety of commercial
businesses for several decades.,, New development and redevelopment will continue to
occur in this neighborhood given, the larger s= lots and relatively undeveloped
nature of those lots.

f Effects on property values: No significant negative impacts on property values
are anticipated. As previously mentioned the proposed cell tower will net create
any adverse impacts with regard to noise or traffic.

block gall for security around the base of the tourer. Verizon Wireless is open as to the color of
the proposed tower.

The structural report and required soils report cost about $8,000. Verizon fireless would like
to propose making this a condition of the CUP and providing them prig to issuance of a
building permit.
Location of the tower so that visual impact to adjacent property owners is limited to the
greatest extent possible
Wireless technology forks on a line of sight principle. The fireless antennas need to be seen
by the user for the best call quality and data speeds, Verizon fireless is open to suggestions
for mitigating the tower's appearance through suggestions for color. The proposed location is
industrial which means the adjacent property owners expected heavy uses of the property.

The response proposes a `decorative block wall" for security. Tease describe
how the wall will be decorative. The plans on page -4 indicate a masonry
block wall will provide security and surround the lease site.

This is the latest: information from the Verizon Wireless surveyor and civil engineer.
The Tract Id 70E is the parcel where Verizon Wireless wants to use.
The certificate of Survey (COS) 17351 is a retracernent of two existing parcels of
property, Tract Id......70E and .....` 0F. The COS 3537 is referenced on Tract Id ....70E
in the cos 17351. We believe that referencing COS 3537 in the legal description is
correct.
.
Noise -the only noise generated is by two 5-ten H AC units. The units are the same
size as used on residential structures in warm climates. The units are proposed to be
placed on the south side of the shelter, away from the residential lots. There is a
backup generator to allover operation during the time of a commercial power outage.
The generator is internal to the shelter and does not emit much noise. The generator is
exercised weekly for about 20 minutes typically during the middle of the day, during the
work week.
Light -The tower is not required to be lit by the FAA. Verizon Tireless is fine with
deleting the standard motion sensor night light outside the door.
Dust, odors, and vibration -After completion of construction, Verizon Wireless
installations do not generate dust} odor, or vibration.
Fumes -The backup generator is fueled by either diesel or propane. During fueling, the
fuel truck could emit fumes.
. a. Visual effects
Wireless technology is line of sight technology. If the mobile phone and the antennas
cannot see each other, there is diminished signal strength. Buildings and trees block
wireless signals. The proposed tower is used only to hold up the antennas that transmit
and receive the wireless signals. Verizon Wireless builds many types of antenna
support structures. A self-support tourer makes the most sense because it most readily
allows the multiple carrier collocation desired by the city. Pre -oxidizing the steel would
dull any shiner portions of the tower. Faint is less practical as it requires periodic
maintenance and requires the wireless carriers turn off their signal during the repainting.
b. Height
The height of the proposed tower is required to cover the proposed service area with
minimal' signal interruption by trees and buildings. The city's ordinance might actually
have the tower be taller than required for Vernon Wireless to allow practical collocation
by 4 other wireless carriers.
As the need for wireless capacity increases, the required height for towers actually
decreases. The smaller service area allows shorter towers. As demand for wireless
service increases, sites will get shorter and more plentiful. In dense usage areas, I
have seen full cell sites within Y2 mile of each other or less. some alternative wireless
systems have sites every too feat.
C. Structural Integrity
erion Wireless is happy to build to the wind loading and ice loading design standards
of the city. Verizon fireless conducts soils studies in order to design the footing of the
tower. This information is provided to the structural engineer along with the loading of
the tower to come up with a tower design. The depth of the footings is typically 0%-
50% of the height of the tower. Since every location is different and requires a soils
study, most jurisdictions have the structural design submitted during the building permit
process, after the completion of zoning when a location has been finalized.
d. Radiation Emissions
verizon fireless has a license to operate within certain frequencies granted by the
Federal communications commission. Veri on Wireless operates within the specified
power levels as granted by the FCC. Veri on Wireless will operate this proposed site
within those limits.
e. Effects on adjoining land use
The proposed wireless site will enhance wireless communications service and wireless
data speeds for adjoining parcels and in the proposed service area. This enhanced
service will be used by wireless customers and emergency services.
verizon Wireless is proposing the wireless site on property zoned for industrial ustrial uses
near the City's airport. This is one of the heaviest land use areas in the City. As
discussed in visual effects, the technology is line of sight; therefore the antennas need
to be seen to be most effective. There are trees between the proposed site and the
homes to the north that should mitigate some of the visual impacts.
f. Possibiiity of shared use
veri on Wireless allows collocation on its tourers. verizon Wireless will design the
tower to accommodate multiple carriers as directed by the city.
g. Effects on city Airport operations
erizon fireless has an FAA clearance to operate this site with no red and white
painting and no lighting. The FAA believes the proposed site will have no impact on
operations of the airport.
Veri on Wireless approached the airport about placing the site on the airfield much as
an airport control tower would be sited at an airport. The airport manager Was not
interested in this option.
h. Effects on offer communications devices
As stated above, the FCC allocates wireless spectrum. Verizon Wireless Will operate
Within its legal power levels and Within its allocated spectrum. other devices operating
Within FCC guidelines Will not be impacted including TVs, radio, and other Wireless
r
carriers.
i. site location alternatives
Veri on Wireless investigated several other sites. The airport, the lights at the football
stadium, and the non -compliant radio towers were all considered. In addition, another
real estate consultant considered two other nearby industrial parcels, both on the north
side of Kelly rid. The airport declined to enter into discussion about a possible site on
the airport property. The football stadium location Was too close to the existing Verizon
Wireless site to add the needed capacity to the area. The two sites would overlap their
coverage areas too much. The existing radio towers are in bankruptcy and not FAA
compliant. Verizon Tireless Will not consider sites that are not approved by the FAA.
4. a. Existing 1 1 omonopole
The existing 1 1 o' monopole north of Ashley Drive is too close the existing Verizon
Wireless cell site at 55 3rd Ave vilest North. The coverage areas will overlap
significantly. one of the primary objectives of improving Verizon Wireless capacity in
the commercial areas and along Highway 93 south of the airport will not be met. A
Veri on Tireless site at this location at this time Would be a very poor use of capital.
b . Screening
veri,zon Wireless proposes to Work with staff on the exact design of the screen Wall.
erizon Wireless would propose using contrasting block colors and/or finishes on the
columns and capstones of the gall.
f . FAA
The FAA has made a DETERMINATION of NO HAZARD To AIR NAVIGATION ATIo on
July 1 } 2010, This means no painting or lighting of the tower is required. We have
attached the letter for your reference.
h . Collocation
Wireless carriers prefer 10 feet of separation between the antennas of competing
companies to minimize potential for radio interference. Wireless panel antennas can be
up to 8feet in length. surrounding trees and buildings would seem to make ' for the
bottom antenna the bare minimum.
I will start from the bottom to see how high the tower needs to be to accommodate
wireless carriers.

Droids, and Pads all use significant amounts of data. This growth in data usage is one
of the huge drivers of the need for additional wireless capacity, The other driver is voice
calls moving from landline to wireless. The latest national survey shows % of homes
have no landline service. For people under age 35, the wireless -only number
approaches 35%. Wireless service has become an essential public utility, like suer,
water, and power. Each cell site can handle a finite number of calls and a finite number
of wireless data transactions. With the federal government limiting the amount of
available wireless spectrum, the only way for carriers to add capacity is to add cell sites.
k. Feasible structures
The attached maps are computer generated that shover the current and proposed
coverage for Veri on Wireless around Kalispell. Yellow is the strongest signal, blue is
next, and red is the weakest. The white areas have minimal or no coverage. on the
current map you will notice there is a lame band of blue in the southern portion of
Kalispell. If a new site is not permitted, there will be more dropped phone calls, blocked
calls, and lower data speeds in the area. The proposed map shoves the southern area
of Kalispell with almost entirely yellow areas, the strongest signal.

hazard to air navigation provided the fallowing candition(s), if any, is(are) met:
It is required that FAA Form 7 60-2, Notice of Actual Construction or Alteration, be completed and retuned to
this office any time the proJ ect is abandoncd or:
At least 10 days prior to start of construction (7460-2, Part I)
X� Within 5 days after the coustructioza reaches its greatest height (7460-2, Part II)
Based on this evaluation, marling and lighting are not necessary for aviation safety. However, if marking
and/or lighting are accomplished on a voluntary basis} we recommend it be installed and maintained in
accordance with FAA Advisory circular 70/7460-1 K Change 2.
This determination expires on 01 /0 1/2012 unless
(a) extended, revised or tenninated by the issuing office.
(b) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction pcz;xn.it has been filed, as required by the FCC, within
months of the date of this determination. In such case, the determination expires on the date
prescribed by the FCC for completion of construction, or the date the FCC denies the application.

addition of other transmitters, requires separate notice to the FAA.
This detcr ination does include temporary construction equipment such as cranes, dem'cks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.

The regular meeting of the Kalispell City Plarming Board and Zoning Commission is scheduled for
Tuesday, January 11, 2011 hegi nm*ng at 7:00 PM in the Kalispell City Council Chambers, Kalispell
City lull, 201 First Avenue Faso Kalispell. The planning board will hold a public hearing and take
public comments on the following agenda item. The Board will make a recommendation to the Kalispell
City Council who will take final action.
l . A request by CTA representing Goldberg Properties, Inc., for preliminary plat approval of Spring
Prairie Center Phase III. Phase M includes 21.9 acres and is proposed to be subdivided into 10 lots
rang in size from 0. 82 of an acre to 4.5 acres. In addition to the 10 lots, three tracts of land for
storm water drainage collection are also proposed. The subdivision is located at the northwest corner
of the intersection of US Highway 93 North and Treeline Road. The property is zoned B- /PUD
(Industrial -Business planned Unit Development) and is part of the Spring Praise Planned Unit
Development MIXed Commercial POD. Anticipated development on the proposed lots include, but is
not limited to, retail commercial businesses, restaurants, professional offices and financial
institutions. The 21.9 acre property can be described as a portion of assessor"s tract 5 located in the
NE 1 of Section 36, Township 29 North., Lange 22 Nest.
2. A request by Digital Skylines, Inc.} representing verizon wireless, for a conditional use permit to
install an 80 foot self-supporting cellular tourer and a 12 foot by 26 foot prefab equipment building
inside a 50 foot by 60 foot fenced lease area. The cellular tower and accompanying lease site is
proposed at 139 Kelly load. The property is one acre in size and is located on the north side of Kelly
Road, approximately 900 feet east of the intersection of Kelly Road and Highway 93. The property is
zoned B-5, Industrial --Business, which requires a conditional use permit for cellular towers within the
district. The property can be described as assessor's tract 70E located in the SW 1/ of the NIE V4 of
Section 20, Township 28 North., Mange 21 west.
3. A. proposal by the City of Kalispell to amend the Kalispell Growth Policy 2020 by adding a specific
policy to address annexation of land to the city. The purpose of the policy would be to help provide
predictability, guidance and timing when addressing annexation requests to the city. The policy is
intended to encourage an efficient pattern of growth and the efficient extension of municipal services
to land in and near the city. The propos cd annexation policy would contain both a map and polices.
The map graphically portrays those areas adjacent to the city where requests for annexation would be
routinely embraced and conversely those areas farther out where requests for annexation or municipal
service may be provided using alternative measures. The associated policy tent provides further
guidance in interpreting the reap and prodding suggested procedures to follow.
