The cellular tower and accompanying lease site is proposed at 139 Kelly Road. The property is one acre in stze and is located on the north side of Kelly Road, approximately 900 feet east of the intersection of Kelly load and Highway 93. The proper is legally described by Certificate of Survey No. 3537 located in the SW V4of the NE 1f of Section 20, Township 28 North, Range 21 west. Kalispell Plannir g Department staff presented staff report ICU-10-7 and reviewed the proposed site plan. Staff recommended approval of the conditional use permit subject to 8 conditions, At the public hearing the applicant spoke in favor of the project as well as a neighboring property owner. No one else spoke in favor or against the conditional use permit request and the public hearing was closed. The board discussed possible aesthetic concerns with a tower so close to existing homes, whether to recommend a mono pole tower design and if the tower should be rewired to look like a tree. The board also discussed the location of the tower, its proximity to the adjacent residences and if the tower should be to cat ed to another site on the property. At the conclusion of the bo and ' s discussion the planning recommended the city council consider approving the conditional use permit subject to the 8 conditions listed in the staff report. The vote was unanimous. The property bounder is c=ently fenced with chain hnk fencing topped with three strands of barb wire. The applicant is proposing to construct a decorative wall around the site to avoid tampering with the cell tourer and equipment structure. The wall would be constructed out of contrasting block colors and/or fishes on the columns and capstones of the wall. Planning staff is recommending the wall design he re e ed and approved by staff prior to issumrg a building pen -nit for the cell tower. No additional landscaping, fencing or screening appears to be necessary. If neighborhood concerns from the now of the lease site are voiced over aesthetics, it may be appropriate to consider fast growing tree species such as Poplars to ring the site and f or require the cell tower structure to be camouflaged using a pine or fir tree design. There wfll not he any impacts to the parks or the Kalispell Parks and recreation Department associated with the proposed use. C. Pohce: This facility is currently served by the Kalispell Police Department. No increased impacts to the police can be anticipated as a result of ` the proposed use. d. Fire Protection: Fire protection is currently provided by the Kalispell Fire Department. There is a hydrant on the southeast comer of this property along IeUy Road. Access to the site and the cell tower are good and it does not appear that any modifications to the proposed site layout would he necessary to accommodate the fire department's needs. e* Water: City grater currently serves the site, however the tourer wiu not creed water semees. f. sewer: sewer service is currently provided by the City of Kalispell, however, the tourer will. not rewire surer services. g. Storm water: 'Ihe project includes placing a new equipment shelter} approximately 300 square feet, and cell tower within a. 2,800 square foot lease area. Although this is a small area., a storm grater management plan and permit is still required. In addition to the permit a storm water impact fee will be required for the new impervious surfaces associated with the development. The impact fees are paid at the time the building permit is issued. Page 4 of 11 h. Solid Waste: Solid waste pick --up is currently provided by the city; however, the tower use should not require any reed for garbage pick --up services. L Streets: Access to the property is currently provided to the site from a. city street, Kelly Road. Kelly Road is adequate to accommodate the proposed use and associated traffic. Sidewalks and bike trails: Kelly Road does not have any sidewalk or bike trails along it. However, the proposed use will not generate foot or bicycle traffic that warrants any sidewalk or trail i�provernents in the area or on the property. 4. Chapter 2734 of the Kalispell Zoning ordinance requires certain. conditional uses including transmission towers and cellular communication towers, equipment and facilities to incorporate additional review criteria in the review and evaluation of the use. A review and analysis of the additional criteria is as follows; The location of the transmission tourers and cellular communication towers, equipment and facilities shall take into consideration the following: (a) Visual effects; The proposed cell tower will. be 80 feet tall, approximately 30 to 40 feet taller than existing trees located north of the lease site based on information on sheet - , Overall Site flan, in the application. The tower will be the tallest structure in the immediate area and will be visible to adjacent residential and commercial properties. The cell tourer is proposed to be constructed out of pre--oidied steel that would dull any shiny portions of the tower. (b) Height; The height of the tower is proposed at 80 feet with a. 5 foot ]lightning rod tip, The tower is proposed. at 80 feet to rM411ix ize interruption of signals from surrounding trees and buildings and provide the coverage needed to the targeted service area. (c) Structural integrity; The tower will be constructed to withstand the required wind and ice loads encountered in the area., Venizon wireless conducts soil studies to determine the appropriate footing design and required footing depth. This rnfojrrrxation will be included with the building permit application to insure structural integrity of the tower. (d) Radiation emissions,, Veri on wireless is licensed to operate within certain frequencies by the Federal ommunicati.ons Commission. The proposed tower site will operate within the limits of Veri on as license. (e) Effects on adjoining land use; The applicants are proposing the tourer at this location to enhance the Page 5 of 11 wireless conurracation services for lands within the service area. The tower will protrude above the tree line located to the north of the lease site. Aesthetically, the proposed tower may impact adjacent property owners. Figure .- Looming north at the lease site. In the background the trees are located on the adjacent residential properties. ffl Possibility of shared use; erizon Wireless states in their application that they do allow collocation on their tourers. The proposed tower is designed to accommodate more than one set of antenna's however the number of additional antenna's may be 'ted based on the proposed height of the tower and sinTound g buildings and trees. (g) Effects on city airport operations; The Federal Aviation Administration (FAA) has determined that the proposed tower will not impact the operations at the airport. The city's airport manager was notified of the proposed tower and after spearing with the regional FAA coordinator for the city airport, concurs with the FAA letter submitted with the application, (h) Effects on other communication devices eAzon Wireless is required to operate within its frequency spectrum they are licensed for. Their application states that other devices including TVs, radio and other wireless carriers will not be affected ley the proposed. tower. Page 6 of 1 I (i) Site location alteratives. Based on their application, Verizon Wireless investigated several other possible sites. These sites included the city airport, the lights at Legends Field, two other properties along Kelly Road and the two radio tourers associated with the former KGEZ radio station. The airport declined the offer to locate a tower on the property and the lights at Legends Field would have been too close to the exi'sting Verizon Wireless site to add the needed capacity to the area. The ex-Isting radio towers are not FAA compliant and therefore were not considered. The other sites along Kelly Road were not given prio ity . part because 'erizon Wireless wanted to locate the tower on the property furthest from the city airport. General requirements of a Conditional Use Permit for locating a transmission tower or cellular communication tourer shall include. - (a) Required collocation on an existing tourer or other structure whenever possible and practical; The closest existing tower is located approximately 1 14 rm'les to the northwest on land outside the city. The existing tourer, a 11 o foot monopole, is located on an 8 acre tract of land located off of Ashley Drive. In 2007 the county approved conditional use pest FCU - o 7 T 14 to construct the 110 foot cell tower. The applicant was made aware of the tower location and was requested to look into the feasibility of collocating on this tower. Upon review, the applicant stated that the existing 110 foot monopole is too close to an existing Verizon Wireless tower located at 5 5 Third Avenue Vest North in Kalispell. If they were to use the 110 foot monopole their coverage's would overlap and not provide the additional coverage along Highway 93 south of the airport, which the tower location under consideration Will provide. (b) Screening equipment and structures when located adjacent to a residential district} The applicant has proposed a decorative wall around the perimeter of the lease site. This wall W'111 significantly shield the equipment building from the residential hones located north of the lease site The tower, at 80 feet, is more difficult to screen totally from the residential hornes. Frees Located north of the lease site will provide some screening however the planning board may want to consider reuirl g additional landscaping such as Poplars and f or require the cell tower structure to be camouflaged using a pine or fir tree design to help to partially screen or camouflage the tower. The planning board should consider this if aesthetic concerns are raised by the adjacent residential property owners or the planning board has these concerns. Page 7 of 11 (C) Engineer's certification regarding structural safety; Planning staff is recommending an engineer's certification regarding structural safety be required as a condition of approval. The certification a� should be submitted once the tower is constructed.. (d) Location of the tower so that visual impact to adjacent property owners is limited to the greatest extent possible; The proposed tourer is located at the north end of a commercially zoned. property. This location reduces the visual impact the tourer would have on adjacent property owners to the south and the traveling public along Kelly Road. However, this location does have the potential to impact the neighboring residential property owners. At 80 feet it would be difficult to mitigate the visual impacts to adjacent property owners completely. The planning board may want to consider some type of landscape screening as suggested in subsection b above. (e) That the structure be placed to avoid location on the crest of a mountain or hill or extension into the skyline thus creating aesthetic concerns; The application states that the proposed tourer does not break any mountain skylines. This is true. However, the proposed tower does extend into the immediate skyline taller than any of the surrounding buildings and trees. Based on a conversation with the applicant, reducing the height of the tower would not achieve veri on#s objective of increased coverage on Highway South.. Therefore, if aesthetic concerns are raised the planning board should consider mitigating these concerns with tree plantings of a species that would grow to a height to help camouflage the tourer, such as Poplars, or requiring the cell tower structure that pies a pine or fir tree. Address potential FAA (Federal Aviation Adr inistration) lighting requirements for aviation safety; No lighting is necessary based on a letter from. the FAA. issued duly 11 010. (g) That the structure/tower be camouflaged to blend m with the surrounding environment; The applicants are open to a required color for the tourer based on input from the public, planning board or council.. At this time the tower would be a metallic colon unless conditioned otherwise. (h) The new structure shall allow for collocation with a minimum of four other users; The proposed tower could accommodate up to three other users. To accommodate four other users the tower would have to increase in height and planning staff is not recommending any additional height Page 8 of 11 J increases. Based on information provided by the applicant, they are pursuing additional tower locations throughout the county to increase coverage and service. Additional height does not necessarily serve therm since each cell tower site can only handle a finite number of calls and wireless data transactions. i That all transmission and cellular communication towers he located a minimum of one mile mart, unless collocation opportunities do not exist; The applicant has searched the area and found that there are no other cell tourers within l mile of the proposed. site. As mentioned in subsection a., the closest cell tourer is approximately i 14 miles to the northwest. The applicant states M the appli.cati.on that as the need for wireless capacity increases, the required height for cell towers decreases. With the increase in demand, cell tourer sites are being located closer together and thus the height of the towers dices net need to cover a large geographic area. The application also states "with the federal government limiting the amount of available wireless spectrum, the only way for carriers to add capacity is to add cell sites*" If a. security fence is proposed, a five foot tail dense landscaping screen shall he planted around the security fence of any structure / tower; The applicants are requesting to not install the landscaping screen but instead construct a decorative block waH to help conceal the equipment at the lease site. The gall would be in lieu of a chain link fence. The solid block wall achieves the intent of the five foot tad dense landscape screen which is to screen equipment at the facility from adjacent properties (k) where a new tower is proposed, the applicant skull demonstrate that there is no feasible existing structure on which to locate; As stated previously in this report, the applicant has reviewed several other locations including existing towers and they are not feasible to provide the coverage Verizon wireless is wanting or are not FAA approved. towers. If the mobile phone and the antennas cannot see each other, there is diminished signal strength. Buildings and trees block wireless signals. The proposed tower is used only to hold up the antennas that transmit and receive the wireless signals. Verizon Wireless builds many types of antenna support structures. A self-support tourer makes the most sense because it most readily allows the multiple carrier collocation desired by the city. Pre -oxidizing the steel would dull any shiner portions of the tower. Faint is less practical as it requires periodic maintenance and requires the wireless carriers turn off their signal during the repainting. b. Height The height of the proposed tower is required to cover the proposed service area with minimal' signal interruption by trees and buildings. The city's ordinance might actually have the tower be taller than required for Vernon Wireless to allow practical collocation by 4 other wireless carriers. As the need for wireless capacity increases, the required height for towers actually decreases. The smaller service area allows shorter towers. As demand for wireless service increases, sites will get shorter and more plentiful. In dense usage areas, I have seen full cell sites within Y2 mile of each other or less. some alternative wireless systems have sites every too feat. C. Structural Integrity erion Wireless is happy to build to the wind loading and ice loading design standards of the city. Verizon fireless conducts soils studies in order to design the footing of the tower. This information is provided to the structural engineer along with the loading of the tower to come up with a tower design. The depth of the footings is typically 0%- 50% of the height of the tower. Since every location is different and requires a soils study, most jurisdictions have the structural design submitted during the building permit process, after the completion of zoning when a location has been finalized. d. Radiation Emissions verizon fireless has a license to operate within certain frequencies granted by the Federal communications commission. Veri on Wireless operates within the specified power levels as granted by the FCC. Veri on Wireless will operate this proposed site within those limits. e. Effects on adjoining land use The proposed wireless site will enhance wireless communications service and wireless data speeds for adjoining parcels and in the proposed service area. This enhanced service will be used by wireless customers and emergency services. verizon Wireless is proposing the wireless site on property zoned for industrial ustrial uses near the City's airport. This is one of the heaviest land use areas in the City. As discussed in visual effects, the technology is line of sight; therefore the antennas need to be seen to be most effective. There are trees between the proposed site and the homes to the north that should mitigate some of the visual impacts. f. Possibiiity of shared use veri on Wireless allows collocation on its tourers. verizon Wireless will design the tower to accommodate multiple carriers as directed by the city. g.
