SUBJECT Glacier village Greens Subdivision Phases 19, 21 and the remainder of 22 — Request for
one-year preliminary plat extension
MEETING DATE: august 15, 2011
BACKGROUND: This is a request by Sands Surveying on behalf of the developer of Glacier village Greens for a
one-year extension of the preliminary plat for phases 19, 21 and the remainder of phase 22. These phases would
create 25 single-family lots and 34 townhouse lots. The phases were approved in December of 2002 by the
Kalispell City Council subject to 16 conditions.
The Glacier village Greens Subdivision is approximately 200 acres in size, includes 22 phases and is located on the
north side of west Evergreen Drive. Phases 19, 21 and the remainder of phase 22 are located on the north side of
the subdivision. Phase 19 is located north of the cul-de-sac for Palmer Drive. Phase 21 is located east of the cul-
de-sac for W. Nicklaus Avenue and the remainder of phase 22 is located at the northern end of E. Nicklaus .avenue.
The preliminary plat is scheduled to expire on November 3, 2011. They have already received a one year extension.
However, House Bill 522 with an effective date of October 1., 2011 amends Section 76-3-610 M.C.A. allowing a
subdivider to request an extension of the preliminary plat beyond the initial three year approval date and one-year
possible extension. The Bill permits the city council to extend its approval of the preliminary plat for a mutually
agreed -upon period of time. The applicants have completed the majority of the required improvements which will
support these last 3 phases of the project and they are simply waiting for a better economy to file the final plats.
RECOMMENDATION: A motion to adopt the resolution and grant a one-year extension to the preliminary plat
for phases 19, 21 and the remainder of 22 of the Glacier Village Greens Subdivision would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for
Glacier village Greens Phases 19, 21 and the remainder of Phase 22, located in
Section 32, Township 29 forth, Range 21 west, P.M.M., Flathead County,
Montana on December 16, 2002; and
WHEREAS, the city council of the City of Kalispell granted a one-year extension of the
preliminary plat for Glacier village Greens Phases 19, 21 and the remainder of
Phase 22 on September 7, 2010; and
WHEREAS, the 2011 Montana Legislature has approved a change in Montana Law to allow
for additional extensions to preliminary plats beyond the previous approved one-
year extension; and
WHEREAS, Owl Corporation, owner of the property, has requested an additional one-year
extension to the preliminary plat for Glacier village Greens Phases 19, 21 and the
remainder of Phase 22 due to economic conditions; and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision
and Platting Act allows the city council to grant a one --year extension to the
preliminary plat; and
WHEREAS, good cause exists for the request for extension and it is in the best interests of the
city that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITE'" COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the application for an extension of the preliminary plat of Glacier
Village Greens Phases 1.9, 21. and the remainder of Phase 22, Kalispell,
Flathead County, Montana is hereby approved for a period of one year
ending the 3rd day of November, 2012. -

THE CITY OF KAL.ISPELL, THIS 15TH DAY OF AUGUST, 2011.

Dear Mayor Fisher and City Councilors:
On behalf of our client Mark Owens and Cowl Corporation., we are requesting a one year
extension for the Preliminary Plat approval of Glacier Village Greens, Phases 19, 20, &
the remainder of Phase 22 which is located north of in the Glacier Village Greens
development off of west Evergreen Drive. The Preliminary Plats of the above mention
phases are set to expire on November 3, 2011.
The applicants have invested substantially in the Glacier Village Greens development but
at present there is still a large supply of lots available and it does not make sense to
proceed with the next phase at this moment. we are hopeful that market conditions will
improve in the next year or two thereby reducing the supply lots at which time we can
proceed with final plating.
