Management Additional Hours
I concur with TD&H's billing for additional construction management hours worked. Either
Carol Grigg or I visited the work site on a semi -daily basis and always found the construction
engineer present. Additionally, I was involved in numerous meetings and telephone
conversations with TD&H over this period of time regarding the project and its progression.
The electrical backbone work had not been completed by Pacific Power at the time the project
started (which also happened on The Courtyard project) and funding for such was in a different
line item on the budget.
As stated in Mike Fraser's letter, the increase was caused by an increase in time allowed by a
working day contract, contractor delays in completions and adding the backbone electrical
service to Schedule III.

RESOLUTION NO. --4-3,25--
A RESOLUTION TO ALiTER AND AMEND THE -CONTRACT WITH THOMAS, DEAN &
HOSKINS, INC. ON THE WOODLAND COURT/TETON TERRACE PROJECTS.
WHEREAS, the City on May 5, 1994 did enter into a contract
with Thomas, Dean & Hoskins, Inc., for the construction of certain
improvements connected with the Woodland Court/Teton Terace
Projects, and
WHEREAS, certain elements in the project required additional
work, as well as time to complete; and said additional work and
time requirements could not have been necessarily foreseeable when
the original construction contract was entered into, and said
changes are contained in Exhibit "A", attached hereto and are by
this reference made a part hereof; and
WHEREAS, upon the advise and recommendation of Roger
Sommerville, of Thomas, Dean and Hoskins, Inc., (the City's
Consulting Engineers) it appears in the best interests of the City
to approve said changes and alterations.
NOW THEREFORE, pursuant to the provisions of Section 7-5-
4308(l) MCA be it hereby resolved:
1. The alterations and modifications of the contract between
the City of Kalispell and Thomas, Dean & Hoskins, Inc., dated
January 6, 1997, as set out in Exhibit "A" attached hereto are
hereby approved, and
2. As soon as the alterations and modifications are agreed to
in writing, signed by the City Manager, as hereby approved by the
Council, this approval thereof shall be in effect.
PASSED AND APPROVED BY THE CITY COUNCIL AND MAYOR OF THE CITY OF
KALISPELL THIS - DAY OF 1 1997.

It appears the final payment to NUPAC may be delayed. Our inspection and construction
management services are complete. Previously, we have requested a contract amendment to
increase the fee limit to include service thru November.
We request the amendment be approved. Enclosed as documentation are four exhibits. Exhibit
A is a month by month summary of invoices. Exhibit B is the monthly summary of fees for the
NUPAC contract, Schedules I and 11. Exhibit C is the monthly summary of the A-1 contract,
Schedule Ill. Exhibit D is a summary of Teton Terrace, a comparable project with a 90
calendar day contract.
The increase in fees for South Woodland is due to the increase in time allowed by a working day
contract, contractor delays in completions and adding the backbone electrical service to Schedule
in.
Exhibit D documents the reasonableness of the original fee estimate for a 90 calendar day
contract.
The City's early action would be appreciated.
