Between The West View Estates Homeowners Association and the City of Kalispell

West View Estates is a subdivision in the incorporated City of Kalispell. The City of
Kalispell owns and maintains the streets within the West View Estates Subdivision. As
part of the approved road design and to enhance the aesthetics of the subdivision, the
developer of West View Estates installed two landscape islands within the City road
right-of-ways. The Landscape Islands are located at both subdivision entrances: Taelor
Road/West Reserve Drive and Taelor Road and Stillwater Road. See Exhibit A
It was always the intent of the developer that maintenance of the Landscape Islands
would be the responsibility of the West View Estates Homeowners Association. This
agreement is established to formalize the responsibilities for long term maintenance of
said landscape islands.
West View Estates Homeowners Association Responsibilities:
• Maintain all plantings within the landscape islands in a healthy growing state.
Maintenance includes pruning of vegetation and replacement of sick, dead, or
dyeing plants.
• Maintain and operate the irrigation system for the landscape islands and pay all
water bills associated with the irrigation of the landscape islands. Maintenance
includes replacing any broken or damaged irrigation components
City of Kalispell Responsibilities:
Snow plowing around the Landscape islands and replacing curbing should the
snow plows or general street maintenance destroy or severely damage the curbing
around the island.
The term of this agreement shall not be for less than 20 years and shall automatically be
renewed for successive periods of 10 years unless by mutual agreement both parties
provide written notice of termination 30-days prior to the expiration date.
