RE: Rob Monk's Developer's Extension Agreement
Per your request, this department has taken into consideration the request by Mr. Monk to
renew/extend the developer's extension agreement to which the City and Monk are party
(attached). Our recommendations are as follows:
The expiration date of the agreement should be extended to the 3rd day o
September, 1996.
2. In exchange for the City's willingness to extend the agreement, Mr. Monk shcm
deed to the City that portion of Tracts 2 and 7C which he owns abutting t h e
southerly end of the City airport runway. The property in question measures
approximately 240' x 70'. A section map identifying the property is attached.
3. Mr. Monk should sign a "Waiver of Protest of Annexation" concurrent with the
signing of the new developer's extension agreement. This was a recommended
condition of preliminary plat approval which the County was unwilling to require.
4. Mr. Monk should also acknowledge the existence of, (a) runway protection zones,
(b) object free areas, and (c) safety areas, as discussed in the Kalispell City Airport
Neighborhood Plan and associated development restrictions in those areas.
5. It would also be appropriate to request an easement from Monk on Tract 2L for the
purpose of allowing aircraft to use a portion of that property as a taxiway.
It should be kept in mind that the City has agreed to allow access to Monk's proposed subdivision
across City -owned property from Airport Road. Furthermore, the City has agreed to provide
paved access to the edge of Monk's property to help facilitate his development plans in this area.
Certainly these improvements will offset any monetary loss incurred by Monk in deeding the
above -referenced property to the City.
