(Joint Tenancy)
FOR VALUE RECEIVED, THE CITY OF KALISPELL, a municipal corpor-
ation, the Grantor, does hereby grant, bargain, sell and convey unto
MYRON K. STRAND and MARILYN J. STRAND, husband and wife, the Grantees,
as joint tenants (and not as tenants in common), and to the survivor
of said named joint tenants, and to the heirs and assigns of suc.i
survivor, the following described premises, in Flathead County, I'dont-
ana, to -wit:
A tract of land lying and haing in Section 20, Township 2E North,
Range 21 West, M.P.M., more particularly described a!;_,P,gllows:.,
Beginning at the Southwest corner of Lot 2, Block 1, Airport
Addition to Kalispell, thence; S. 56059' W. a distance of 150.0'
to the Northeast corner of the tract of land to..)e conveyed,
also the true point of beginning, thence; S. 33'01' E. a -dis-
tance of 560.0 feet, thence; S. 56059' W. a distance of 240.0'
thence; N. 33"01' N. a distance of 560.0 feet, thence; N. 56'
59' E. a distance of 240.0 feet to the true point of beginning
and containing 3.085 acres.
Grantor further grants to Grantees a perpetual easement, for in-
gress and egress purposes only, on a strip of land thirty (30) feet
in width between the tract hereinabove described and U. S. Highway
#93, as existing on the date of this instrument, the northerly bound
ary.of which strip shall -be the southerly boundary of that tract of
land conveyed to the State of Montana.by Deed as recorded in Book 372,
Page 172, in the office of the Clerk and Recorder for Flathead County,
.Montana.
This conveyance is made :.iith the exnress restrictive covenant,
running with said land, which covenant is accepted by and binding for-
ever upon the Grantees, their heirs, successors and assigns, by accept-
ance of this deed, and -which covenant is: That, the above described
tract .shall. be used only for airport and aviation related operations
and activities directly incidental thereto for so long a time as the
airport now known as Kalispell City Airport, of which this tract was
formerly a part, is operated as an airport and available for use
thereas; upon failure of said Kalispell City Airport to be operated
as an airport and not being available for use thereas, said covenant
shall cease to apply. Enforcement of this covenant by injunction or
otherwise may be waived only.by a written resolution adopted by the
Council of the City of Kalispell, or its successor as the governing
body of the City of Kalispell.
TO HAVE AND TO HOLD the said premises, with their appurtenances
unto the said Grantees, as joint tenants with right of survivorship
(and not as tenants in common) and to the heirs and assigns of the
survivor of said named joint tenants forever.
IN WITNESS WHERIOF, the said Grantor has, by resolution duly
adopted and passed on the 5th day of ?iav, 1969, by two-thirds (2/3)
or more of all the members of the Council thereof, authorized and
caused these presents to be executed by the Mavor and attested by
