Subdivision ReportOFFICE • • ' 1 1 11 A report to the Kalispell City Planning Board and the Kalispell City Council regarding a request for preliminary plat approval of a one lot subdivision on DNRC's Section 36. A public hearing on this matter has been scheduled before the Kalispell Planning Board for June 14, 2005 beginning at 7:00 PM in the Kalispell City Council Chambers. A recommendation from the Planning Board will be forwarded to the Kalispell City Council for final action. A. Owner/Applicant: Technical Assistance City of Kalispell c/o Randy Brodehl P.O. Location: This property is located on the west side of US Highway 93, north of Four Mile Drive and directly west of the proposed Costco site in Spring Prairie Planned Unit Development. The lot would be adjacent to Costco to the west and Kalispell Youth Athletic Complex to the south. The property is generally described as a portion of Assessor's Tract 5 in Section 36, Township 29 North, Range 22 West, PMM Flathead County, Montana. C. Size: Total area: 2.15 acres Area in Lots: 1.714 acres Area in Roads: 0.44 acres D. Nature of the Request: The City of Kalispell is purchasing an easement from the State Department of Natural Resources for the purposes of constructing a second fire station north of the existing station. The station was approved by the City of Kalispell residents in the November 2004 election and work has been moving forward ever since. The approximately two acre site will be located on the west side of the Costco located in the Spring Prairie development on the west side of US Highway 93 and north of the Youth Athletic Complex. The fire station site will be accessed via a City street currently under construction that will also serve Costco. Apparently Costco has agreed to construct the roadway that will serve the fire station as well as their project. The City would like to begin construction on the fire station this summer. The subdivision and easement agreement with the DNRC creating the fire station are part of the process in bringing the fire station project together for construction. E. Existing Land Use: This property is currently undeveloped. F. Adjacent Land Uses: This property is part of the State DNRC's Section 36 property that was the subject of a neighborhood plan, annexation, zoning and subsequent lease and development agreements with lessees. North: Undeveloped, B-5 / PUD zoning South: Youth Athletic Complex, P-1 zoning East: Costco under construction, B-5 / PUD zoning West: Undeveloped, B-5 / PUD zoning G. Zoning: This property is zoned B-5 / PUD and is part of the Spring Prairie PUD for all of Section 36. The B-5 / PUD area of the property is mixed use commercial. The fire station complies with the zoning for the property. H. relation to Growth .Policy Map: This property lies within the jurisdiction of the Kalispell City Growth Policy and is the subject of the Spring Prairie Neighborhood Plan and associated agreements. Note that while only one additional lot is being created, the parent lot, Section 36, has been the site of the Spring Prairie Subdivision and as such the cumulative number of lots created exceeds the minimum of 5 for minor subdivision review. A. Effects on Health and Safety: Fire: Access to the area will be via US Highway 93 from a newly construction roadway, Spring Prairie Center South, a City street that will be construction in conjunction with the development of the Costco site. The new station will be able to increase the fire safety in the north section of Kalispell. The subdivision will be developed in accordance with the Uniform Fire Code and have access which meets City standards. The property does not have steep slopes or woody fuels. Hydrants will be required to be placed in compliance with the requirements of the Uniform Fire Code and approved by the Fire Chief. The fire access and suppression system should be installed and approved by the fire department prior to final plat approval because of potential problems with combustible construction taking place prior to adequate fire access to the site being developed. 10 Flooding: According to the Kalispell FIRM (Flood Insurance Rate Map) Map, this area is not located in the 100 year floodplain nor does it have high ground water that would lead to flooding. Roads: The primary access to this site is via US Highway 93 from a newly constructed City street known as Spring Prairie Center South Road. The entrance road to the fire station will be extended to the western property boundary and will be adequate to accommodate the additional traffic generated by the new fire station. The City and State will need to work with the MDT on the installation of a controlled access at the newly created intersection and any conditions required be met or otherwise adequately addressed prior to final plat approval. The site is not mapped within any big game winter range and does not provide significant habitat to wildlife and does not host any significant or endangered wildlife. There are no significant environmental factors that would pose an impact on the natural environment of the area. Sewer and Water: City of Kalispell water and sewer are being extended to the site as part of the Costco development. Adequate capacities exist to serve proposed development. Stormwater management: Stormwater management will be accomplished with on site retention of stormwater run off. This engineered drainage plan is being developed by Morrison-Maierle as part of the engineering for the site. Roads: US Highway 93 will provide access to the property and will be developed as a new City street which will create an intersection at Highway 93 and Spring Prairie Center South Road. It is anticipated that the intersection will be controlled with a light. The fire station will have some capability on controlling the timing of the light during an emergency run. MDT will have to approve the approach, light and timing of the light and will require review and permitting. The road system is adequate to provide the needed service. Schools: This subdivision is within the boundaries of School District #5. Because of its commercial nature it will not generate school children. Taxes generated from the project will benefit the school district. Parks: This subdivision is not subject because it is a commercial subdivision Regulations and as under State Statute. to the parkland dedication requirements as outlined in the Kalispell Subdivision Police Protection: This development will be served by the Kalispell Police Department. According to the Kalispell Police Department, they will be able to adequately serve this area. Fire Protection: This development will be served by the Kalispell Fire Department. The location and placement of fire hydrants needs to be addressed. Fire flows in the area are adequate to accommodate any necessary hydrants. Refuse Disposal: The subdivision will be served by the City of Kalispell for solid waste disposal. Adequate space at the County landfill is available for the solid waste which will be generated by the subdivision. Medical Services: Kalispell Regional Hospital is approximately two miles from the site. Ambulance services are available to serve this subdivision and access is good. E. Effects on Agriculture and Agricultural Water Users Facilities: This property is undergoing a conversion from agricultural to urban scale and density development. Because of its proximity to services and other commercial development, the proposed use is appropriate. The conversion of this property from agricultural to a public facility will not have a significant affect on agriculture or agricultural water users facilities. This property is included in the Spring Prairie Neighborhood Plan which is part of the Kalispell City Growth Policy. A full range of uses is anticipated in this area and the fire station proposal complies with the neighborhood plan and the growth policy for the area. This zoning for this property is B-5 / PUD a Mixed Commercial pod. Minimum lot sizes of 7,000 square feet with standard setbacks are required. The proposal complies with these standards. The preliminary plat is in substantial compliance with the State and City Subdivision Regulations. la&V'sJosm�s • Staff recommends that the Kalispell City Planning Board adopt staff report #KPP-05-10 as findings of fact and recommend to the Kalispell City Council that the preliminary plat be approved subject to the following conditions: 1. That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lot, easements and roadways. (Kalispell Sub. Regs. Appendix C - Final Plat I(A) Contents of final plat.) 2. All public infrastructure serving the site shall be reviewed and approved by the Kalispell Public Works Department for compliance with Kalispell's Standards for Design and Construction. A letter shall be obtained from the Kalispell Public Works Department approving said plans. (Kalispell Sub. Regs. Section 3.12 A). 3. That a letter be obtained from the Kalispell Public Works Department approving the installation of the public infrastructure to the site. Certification from an engineer licensed in the State of Montana shall be submitted with the final plat stating that all of the improvements have been constructed accordingly. As built drawings shall be provided to the public works department prior to final plat submittal. (Kalispell Sub. Regs. Section 3.12 - 3.15). 4. Subdivision Regulations, Section 3.20). a. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with International Fire Code (2003) Appendix B. b. Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. c. Fire Department access shall be provided in accordance with International Fire Code (2003) Chapter S. d. Street naming shall be approved by the fire department. 5. Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude unnecessarily onto adjoining properties. 6. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. 7. That landscaping of the site be done in accordance with a plan approved by the Kalispell Parks and Recreation Department. 8. All existing and proposed easements shall be indicated on the face of the final plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating the easement locations have been reviewed and approved. 9. Site lighting shall be accomplished through the use of a full -cut off lens and in accordance with the same standards as required under the development agreement between the City of Kalispell and the developers of the Spring Prairie site, to wit not to exceed 30 feet in height with the light fixture that does not shine above a 70 degree horizontal plane. 10. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. 11. All new utilities shall be installed underground. (Kalispell Sub. Regs. Section 3.17A). 12. An approach permit shall be obtained from the Montana Department of Transportation for the creation of the proposed intersection at US Highway 93 and Spring Prairie Center South Road and any needed improvements be accomplished prior to the submittal of the final plat. after being reviewed and approved by MDT. 13.
