Motoyama Federal Emergency Management Agency Denver Federal Center, Building 710 Box 25267 Denver, CO 80225-0267 RE: Kalispell Hampton Inn Floodway Violation Dear Ms. Motoyama: Enclosed are (1) a letter to Tim Stulc of Spring Creek Development setting a deadline for restoration of the floodway; and (2) a formal denial of the June 3, 1997, permit application. The deadline was set after reviewing the performance bond provided as part of the project, which gives us until July 1 to institute a suit under it. We have given them approximately two months in order to prepare a specific plan and obtain the appropriate permits for the restoration. In regard to the Morrison-Maierle study, the city council has previously reviewed the options and has preliminarily selected alternative F. No time table can be set at this time for implementation due to a number of factors, including the situation with the Hampton Inn and funding concerns aggravated by CI-75, which is an inititive passed by the voters requiring approval of any increase in fees or taxes. It is now the subject of a district court lawsuit. The uncertainty caused by CI-75 and its impact on the storm drain assessment prevents us at the present time from specifying dates and detailing funding. We will keep you up to date as this matter progresses.
