As you know, a meeting was held in Kalispell on Tuesday, May 27th to discuss the
unresolved floodplain issues regarding the Kalispell Hampton Inn. I am sorry that you
were unable to attend. With this letter I will attempt to recap what was decided at the
meeting. The meeting was attended by various Kalispell City Officials, representatives
from the Federal Emergency Management Agency and a representative from the State
Department of Natural Resources.
The focus of this meeting was to identify what work has taken place in the floodway and
the floodplain of Bowser Spring Creek, and to determine how the Hampton Inn
development could gain compliance with local and federal agency requirements. It is our
belief, that when the work in the creek took place, the property�as within the County's
jurisdiction. It has in the meantime been annexed into the City of Kalispell, and the new
city boundary is the centerline of the creek. Therefore, both the City of Kalispell and the
County have jurisdiction over any work that takes place in the floodplain of Spring
Creek.
It was determined at this meeting, that you have a couple of different options. One
option is to remove the culvert from the creek entirely. If you choose this option, you
will still be required to apply for a Letter of Map Revision from the Federal Emergency
Management Agency for re-routing the creek channel. I would also advise that you
contact the Soil Conservation Service regarding a "310" permit if you decide to remove
the culvert from the creek. Another option that you have is to request that the culvert
remain as is, and apply for a floodplain development permit from the City of Kalispell.
The City will require that a new application be submitted by Springcreek Development.
This application will need to be filed with this office by June 4, 1997. Once we receive
this application, we will ask that you supply the necessary engineering data (HEC-2
analysis) showing what effect the culvert has on the 100 year floodplain and the
surrounding properties. This office will then submit a legal notice to the local newspaper
and to the neighboring property owners. If there is considerable public concern, a public
hearing will need to be held. If it is determined that the culvert has negative impacts to
neighboring properties, you will be required to do what is necessary to eliminate these
negative impacts. Please note that this could mean removal of the culvert.
If it is determined that there is no negative impact, and the city has received all required
engineering data, a floodplain development permit will then be issued. Once the
floodplain development permit is issued, you will then be required to obtain a Letter of
Map Revision from the Federal Emergency Management Agency. You will need to
contact John Liou of the Federal Emergency Management Agency in Denver to discuss
the requirements for a Letter of Map Revision. He can be reached at 303-235-4830.
I have enclosed a blank application form for a City of Kalispell floodplain development
permit. Please return the completed application to the above address by June 4, 1997.
Failure to supply requested application and information may result in legal action by the
City of Kalispell. If you have any questions regarding the contents of this letter, or the
