Dear JoAnn:
This communication is to confirm that the Developer, Spring Creek
Development, LLC, has, to this date complied with its obligations under the Public
Improvement Completion Agreement, dated January 22, 1997, in the following
respects: a.) Landscape and Irrigation Installation; b.) Asphalt Paving; and c.)
Highway #2 Approach Permit.
To this date, however, the Developer has failed to complete its obligation to
obtain the Flood Plain Development Permit.
Therefore, a partial release of the Bond in the amount of $90,000.00 may be
appropriate at this time.
