Subject: 30-Day Release Report for the Old Kalispell Armory,1840 Highway 2 South,
Kalispell, MT; Facility ID #15-05102, Release #Pending.
Dear Ms. Moyer:
The Department of Environmental Quality Petroleum Release Section (DEQ-PRS) was notified on May
31, 2006 by Mark Brooke from Morrison-Maierle that a release has been confirmed at the facility
referenced above. The hydrocarbon's present in groundwater is the result of a release from a 1,000 gallon
underground storage tank system that was removed from the facility several years ago. The DEQ
understands that six groundwater monitoring wells have been installed at the facility and were sampled
one time, and that the City of Kalispell now wants to abandon those wells and install approximately four
additional wells closer to the assumed source area. The DEQ does not recommend this action and
believes there are alternatives for you to consider prior to abandoning, or installing additional wells. Any
additional remedial work completed at this facility must be approved, in advance of that work, by the
DEQ. It would be prudent for you to apply to the Petroleum Tank Release Compensation Board
(PTRCB) for potential reimbursement.
If the City of Kalispell seeks eligibility for assistance with the clean-up of this facility from the PTRCB
then I would advise you leave the six wells in place at this time. As the case manager for this facility I
would not recommend reimbursement for abandoning the wells and would not recommend
reimbursement for the installation of new wells slated to be installed on, or around June 12, 2006 without
review of the report(s) for the work that has already been completed at the site.
As the owner/operator of this facility, you are required to investigate and clean up the petroleum release.
Please complete the enclosed 30-Day Release Report form, and return it to this office by June 15,
2006. The 30-Day report is designed to be completed by the owner/operator. The department will not
recommend cleanup fund reimbursement for labor for consultant personnel to complete the 30-Day
report. Once the DEQ-PRS has reviewed the 30-Day Release Report, it will determine if the services of
an environmental consultant are needed to provide further investigation and cleanup.
Technical Assistance:
Because the services of a qualified consultant may be necessary to assist you with the investigation and
cleanup, the DEQ-PRS has enclosed a list of consultants and contractors who have indicated they provide
environmental consulting services in Montana. You must ensure that your consultant is qualified to
properly conduct the work and meet DEQ-PRS requirements. Again, please be aware that the DEQ-PRS
will advise you if a consultant is needed after reviewing the completed enclosed 30-Day Release Report
that you submit.

Financial Assistance:
The Petroleum Tank Release Cleanup Fund (PTRCF) is available to eligible owners and operators of
petroleum storage tanks to provide reimbursement for eligible expenses incurred for the investigation and
cleanup of contamination caused by petroleum releases, and for reimbursement of third party damages
incurred as a result of releases. If you intend to apply for compensation from the PTRCF, please
complete the enclosed Application for Petroleum Release Eligibility (Form 1R) and return it to the
Petroleum Tank Release Compensation Board along with copies of release detection records and the most
recent corrosion protection test results for the tanks and piping at this facility. Additionally, an
owner/operators' Report of Insurance or other third party liability form (Form 7) must be completed and
submitted before the board will make its first reimbursement payment. All investigation and cleanup
activities must be pre -approved by this office prior to implementation. Questions regarding the eligibility
determination process should be directed to the Petroleum Tank Release Compensation Board at (406)
841-5094, or 800-556-5291.
Prompt Response Required:
State and federal laws require that owners/operators of petroleum facilities respond to a petroleum release
with appropriate and prompt action (40 C.F.R. 280.62 and ARM 17.56.602). Failure to comply with the
above -referenced regulations may affect your ability to obtain reimbursement from the PTRCF.
Non-compliance may also subject you to substantial civil penalties.
The Montana Water Quality Act (WQA) is also violated if petroleum wastes cause pollution of any state
waters or are placed where they will cause pollution of state waters. Section 75-6-605, MCA. You are
required to mitigate all impacts and threatened impacts of this release if petroleum waste causes impact to
state waters. Pursuant to Section 75-5-617(2), MCA, DEQ is required to initiate an enforcement response
if you do not comply with the cleanup requirements of the department.
The DEQ-PRS is authorized under Subtitle I of the Resource Conservation and Recovery Act (RCRA) to
initiate corrective action if the owner/operator fails to respond properly. As the owner/operator, you may
then be held financially liable for any corrective action costs incurred by the state, as well as for
administrative or indirect costs and penalties pursuant to Subtitle I of RCRA. Under Section 75-11-504,
MCA, the Department is also authorized to abate public nuisances. You may also be subject to liability
for contamination at this site under Section 75-10-715, MCA.
You must keep this office informed about the progress of work conducted at this site. If you do not
understand your responsibilities or have any questions in this matter, please contact me at the DEQ-PRS
