Box 1997 Kalispell, Montana 59903-1997 GRANT OF CONDITIONAL USE APPLICANT: Glacier Village Greens Homeowners Association Jim Connelly, President PO Box 5173 Kalispell, MT 59903 LEGAL DESCRIPTION: Lot 167, Glacier Village Greens Phase IV located in Section 32, Township 29 North, Range 21 West, P.M.M., Flathead County, Montana ZONE: Two Family Residential, R-4 The applicant has applied to the City of Kalispell for a conditional use permit to allow the construction of a community center for use of the residents of Glacier Village Greens. The applicant is proposing to build the center in an area that has traditionally been used as park area. The center would only be for the use of residents of Glacier Village Greens and would not be rented to the general public. The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on March 9, 2004, held a public hearing on the application, took public comment and recommended that the application be approved subject to four conditions. After reviewing the application, the record, the TCPO report, and after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts Tri-City Planning Office, Conditional Use Report #KCU-04-1 as the Council's findings of fact, and issues and grants to the above -described real property a conditional use permit to allow a community center to be built on Lot 167 in the Glacier Village Greens subdivision in an R-4, Two Family Residential zoning district subject to the following conditions: 1. That the development of the community center shall be in substantial conformance with the approved site plan. 2. That the number and location of fire hydrants comply with the requirements of the uniform fire code and be installed at the approved locations prior to combustible construction. That the building be clearly addressed and visible from West Nicklaus Avenue. That interior access shall be designed to provide a minimum clear width of 20 feet for emergency vehicle access with no parking signs as may be required to maintain width. 3. Use of the community center shall be limited to residents and guest of Glacier Village Greens and shall not be made available for use or rent by the general public. 2000-03 1Yi I 4. The conditional use permit is valid for a period of 18 months from the date of authorization after which time if the commencement of activities has not occurred the permit shall be void. A continuous, good faith effort to design the building, obtain financing and other activities shall be considered a commencement. Dated this 5th day of April, 2004.
