Glen, please prepare a resolution awarding the sale of the following lots in Teton Terrace:
Lots 14, 15 and 16 for a purchase price of $16,000 each which will be in the form of a
zero interest deferred mortgage to Timberland Construction, Inc. and ultimately to the
buyers. The reason for the total deferment is due to the $7,000 higher construction cost
by having to award to the next lowest bidder. The buyers were previously advised and
qualified by the lending institutions based on the original bid as well as Buy/Sell
agreements have been signed.
Lots 12 and 13 to Pacific Homes and Land, Inc. for a cash purchase price of $3,000 each
and a zero interest deferred mortgage in the amount of $13,000. The buyers for these
units are in the 50% of median income range.
The legal description is: Teton Terrace, a cluster development, located in the Northeast 1/4 of
Section 12, Township 28 North, Range 22 West, Principal Meridian, Montana, Flathead County,
Montana.
In addition to the above resolution, we need council approval to bid Lots 3 & 4 in Teton Terrace
as well as Lots 19 & 22 South Woodland Court. I am preparing a bid packet now and will
advertise the day after council approval.

Attached is the financial summary on the two projects. We will discuss each project in detail
but may summarize project status as saying both projects are substantially couTlete and under
budget.
Schedule I & II, NUPAC is the contractor for the water, sewer, drainage and subbase
p3reparatiEou. Contract amount was $280, 847.00. Change orders were approved by the council
allowing work to progress on a working day and days worked. basis. The contractor worked
intermittently thru the winter, spring and summer of 1996. Sixty calendar days or 43 working
days were allocated by contract. With the change orders, the project was complowd im 122
working days.
First day of contract time was December 6, 1995, at which time work commenced on a clays
worked contract per Change Order No. 1. On March 16, 1996, the. 37th day worked, the
contract time was changed to working day, any day on which site conditions allowed proceeding.
The 60th day was May 6, 1996. Contract work was substantially complete on August 16, 1996
the 122nd clay.
Section 1005 provides for fees and liquidated damages. Paragraph 3.2 defines the fees and
Paragraph 3.2.5 states "the Contractor shalt reimhurse the Owner for all costs incurred as a
result of the Contractor's failure to complete the work within the time period specified..."
Engineering fees frum biddhig dauugh May 6, 1996 are $29,190.82. Our fee estimate was
$27,165.00 for 90 calendar days or sixty-four working days of construction for all three
schedules. Sixty for Schedules I & 11 and 30 for Schedule M. This fee was expended in six
rnonths of construction or sixty working days because of the increased pay estimates,
administration and the extended construction time of the working day contract, The amount of

On July 20, 1998, the City of Kalispell sold Lot 24 in Teton Terrace to H & H Enterprises for the
sole purpose of constructing a townhouse unit for resale toEaambra J. Peterson. H & H
Enterprises purchased the land from the City with a $6,000 cash payment an by signing a
Promissory Note and Montana Trust Indenture in the amount of $10,000. This Trust Indenture
and Promissory Note are intended to be assumed by Ms. Peterson and the dollar amount will be
recaptured by the Glacier Affordable Housing Foundation (GAHF) sometime in the future when
the property either changes ownership, is refinanced or is sold. The Montana Trust Indenture
was recorded as Reception No. 199820814430 at 2:43 p.m. on the 27th day of July, 1998 by
Susan W. Haverfield, County Clerk and Recorder.
Due to an insufficient amount of Rural Development mortgage funds available for the closing
from what the buyer was advised would be available, the City is increasing the subsidy to this
purchase by $2,160. Therefore, the writer is requesting you to prepare the necessary documents
to release the original Promissory Note and zero interest deferred Trust Indenture in the amount
of $10,000 as well as new ones in the amended amount. By copy of this memorandum, we are
requesting Debbie Brown at Glacier Bank to prepare new Assignment and Assumption
Agreements in the amended amount of $12,160.

area and survey the property areas in question. He wants to keep this inhouse for the time being

I have received a large number of phone calls from people living in Teton Terrace. Their concerns
range from unsatisfactory construction to possible time delays to simply not understanding any gamut
of issues pertaining to the entire project.
It sounds like the best way to resolve all of the issues for all of the homeowners might be for you and
Susan to meet with them as a group, perhaps even on -site. I, or one of the council members, could
probably make ourselves available if you would be interested. I am not sure if you would agree. If
you have an alternative suggestion, please let me know. I can assure you the number of complaints
and concerns is increasing, not decreasing.

The City has retained the services of Mr. Randy Beaver of Silvertip Drywall to inspect the drywall cracks
that have appeared in your unit. Please call him at 257-9141 to set up a time for him to gain access to your
home that is mutually agreeable. Mr. Beaver has one of the leading drywall firms in the Valley, and the
City will defer to his opinion of the problem and what needs to be done.
In reference to your complaint about the City's failure to provide you with shutters, please remember that at
the time your unit was constructed and sold to you shutters were not part of the specifications and
construction contract for the duplex -style units. Staff made the decision to install shutters on the duplex -
styled townhouses after seeing how they dressed up the appearance on the triplex -style units. Shutters were
later ordered for both your unit and the Murrays; however, the contractor had not received them when he
ordered in the residing of your units and has been too busy since to make a special trip to install them.
Please remember that the shutters, their normal installation, and the patios are provided to you at no charge.
If you wish to pay to have someone install the shutters rather than wait until Mr. Berger can work the
installation of this small job into his or his vinyl installer's overall work schedule, we will be glad to have
them delivered to you. Otherwise, the City will let the instructions stand for Mr. Berger to install them.
The City, again at no charge to the homebuyers, in the landscaping phase of the project is not only
irrigating the common areas but is installing irrigation in individual yards in an attempt to make home
ownership as easy as possible. The regular seed has a fast, annual rye seed mixed in with it; so that within
a couple of weeks grass will be growing and will last until the regular seed germinates and grows. As
previously stated to you, the cost of the landscaping and irrigation for the subdivision is an $86,000
expense that the City is paying for. The City's goal has always been to achieve a subdivision that people
don't equate to "low income" housing. As a result, the City early on made the decision to completely pay
the landscaping expense so that the homes would remain affordable to lower income buyers and still have
the townhouse subdivision equivalent to any privately developed townhouse subdivision in the town.

Dear Teton Terrace Home Owner:

New Leaf Landscaping & Maintenance has submitted the following schedule for completing the
work in the common areas as well as on your individual properties:
6/14 through 6/16 Plant trees and shrubs
6/ 17 through 6/21 Install weedibarrier and mulch
6/22 through 6/23 Prepare final grade
6/24 through 6/25 Install irrigation
6/28 Apply grass seed
We would like to ask your help temporarily in watering the trees on your individual properties as
well as those in the common areas surrounding your units. Watering should be done with a slow
trickle so as not to wash away dirt from the base of the tree. After the irrigation is installed and
working, it still is important that all the trees receive a thorough soaking once a week during the
first year. The amount of water provided through the timed irrigation system will not be
sufficient to ensure a good take and healthy growth in the first year. The landscaper does
warranty the trees and shrubs as healthy stock, but adequate watering is beyond his control.
Rain gutter installations will either take place during the landscaping process or shortly
thereafter.
