Dear Council Members:
Please be advised that we have inspected the improvements to The Willows - Unit II and to the best of
our knowledge and belief, all required improvements with the exception of those listed in the
Subdivision Improvements Agreement, have been installed in accordance with the attached as -built
drawings.
Pursuant to Section 8.04 of the Subdivision Regulations for the City of Kalispell, we have prepared a
cost estimate for the completion of remaining improvements for The Willows - Unit No. II.
The remaining items and their costs are as follows:

American Land and Development, Inc., developers of The Willows Subdivision
wish to file for Final Plat Approval at this time. Improvements have been
completed as described in the following item by item breakdown of the sixteen
(16) conditions listed in the Preliminary Plat Approval dated April 1, 1997. A
Subdivision Improvement Agreement addressing the conditions which are not
complete is also enclosed.
The site has been developed in substantial conformance with the approved
Preliminary Plat.
2. The roadways have been constructed in accordance with the City of
Kalispell adopted Standards for Design and Construction. A letter from the
Kalispell Public Works Department stating compliance with the Standard is
enclosed.
3. A note reserving ten feet along Willow Glen Drive has been added to the
plat.
4. Approach permits for the two approaches onto Willow Glen Drive were
approved and issued by the Flathead County Road Department. Copies of
the permits are enclosed.
5. The subdivision name has been changed and approved.
6. A central mailbox location has been approved by the United States Postal
Service and added to the Final Plat (letter enclosed).
7. The developer will bond for the coniferous tree buffer/screening. See
Subdivision Improvements Agreement.
8. The sidewalks will be bonded for. See Subdivision Improvement Agreement.

9. An agreement with the Flathead Valley Christian School for use of their open
space, along with the cash -in -lieu parkland fee of $15,610.00 is enclosed.
10. All utilities have been installed. underground.
11. A drainage plan approved by the Kalispell Public Works Department has
been installed. (Approval letter enclosed)
12. Water and sewer plans and specifications were reviewed and approved by
the Montana Department of Environmental Quality and the Kalispell Public
Works Department. (Approval letter enclosed)
13. A letter from the assistant Fire Chief approving the placement and spacing of
the fire hydrants within the subdivision is enclosed.
14. Phases I and II were annexed into the City in January 1999.
The Subdivision Improvement Agreement lists the items which have not been
completed, projected construction costs and completion dates. Also enclosed
is a Title Report for Unit 1, a Consent to Plat, signed by all of the parties with an
interest in the property, six copies of the Final Plat of Unit No. 1, a complete set of
as-builts drawings and a final draft of the covenants.

Dear Mr. McKenna:
We hereby certify that we have inspected a portion of the improvements to The Willows
Subdivision -Phase I, and to the best of our knowledge and belief, have found them to be in
substantial conformance with the approved plans and specifications, and in accordance with
the City of Kalispell Design & Construction Standards. The sidewalks and street trees are not yet
completed but have been bonded for and will be completed as covered in the Subdivision
Improvement Agreement. Additionally, the drainage transmission culvert along the South
property line of Phase II will be replaced during construction of Phase II.
Enclosed for your records is a set of "As -Built" drawings.
Please note that Schwarz Engineering assumed inspection responsibilities for the project on June
25, 1998. Prior to that date, the project was under the direction of another engineering firm. We
received copies of the inspection notes from January 28, 1998, through May 22, 1998, but
received no written indication of any inspection or activity on the project from May 23, 1998, to
June 24, 1998.

MEMORANDUM

Subject: Storm water drainage from the Willows Subdivision
Attached is correspondence from Billmayer Engineering concerning the storm water drainage
treatment system approved by the State for the Willows Subdivision. The concern expressed is
that the present system was designed and approved for the Willows, but could play a significant
role in solving the overall Greenacres slough problem if there is a drainage pipe installed at
Russell Drive and Willow Glen Drive as has been proposed.
As you will recall from the first evening meeting we attended concerning Greenacres, there are
substantial issues to be resolved before any slough storm water could be transported across
Willow Glen to the river outfall. It was suggested that the Willows drainage system could be
used to convey this water, but before that could happen many many questions would need to be
answered. There are also significant policy issues the Council needs to address. One of the key
items would be whether the City even wants to play a role in this process. It is my understanding
that the storm water system for the Willows does not require a discharge to the River to function.
It will meet the needs of the Willows without this. Since the Willows will be annexed, and the
Greenacres area is outside the City a future scenario could include the City acting as an unwilling
transporter of slough water to the river is a pipe is installed under Willow Glen at Russell, and as
such could be placed in the awkward proposition of having to engineer and obtain permits for
discharge of out -of -City storm water. In the event this happens, Billmayer's concern is that this
exceeds the requirements they have for the subdivision, and their belief is that the City or other
organization should be the responsible party for any engineering, permitting and operating of the
final product.
This is an extremely complex issue, and I believe some staff direction is required. At this time I
believe the proper course is to proceed as policy and approved plans dictate with respect to the
Willows Subdivision. As matters progress for the Greenacres area the City should be alert and if
there is an attempt to solve this problem by the use of City facilities the Council should then
provide staff with specific direction on their wishes concerning our involvement in the solution.

RE: Green Acres Slough Drainage System
Dear Jim:
During our recent discussions, we addressed the stormwater treatment system to serve the Willows
Subdivision with the possibility of extension to accommodate the Green Acres Slough.
We are currently negotiating with the Flathead County Commissioners to acquire an easement across
County property to allow the construction of a pipeline connecting the slough to the stormwater treatment
facility. That easement will be assignable to the City of Kalispell or a neighborhood group assuming the
responsibility for the perpetuation of the stormwater treatment system. This stormwater treatment concept,
if expanded to address the Green Acres Slough discharge, will also require a stream bank preservation
permit from the Flathead County Conservation District (310 permit). We suggest that the City of Kalispell
is the proper governing body to support the permit if the City chooses to get involved in solving this
neighborhood problem.
In order to acquire the permit, considerable engineering design and water quality analysis must be
conducted to ensure the various interested parties that the proposed concept is a viable solution. These
professional services go beyond the approval requirements of the Willows Subdivision. Should the City of
Kalispell desire to pursue this endeavor, Billmayer Engineering remains available to assist the Public
Works staff in performing the necessary analysis.
We would appreciate knowing the City of Kalispell's position in this matter. We remain available for
further discussion should the City elect to pursue this matter.
