SUBJECT West View Estates Phase 3 - Request for one-year preliminary
plat extension
MEETING DATE: August 18, 2008
BACKGROUND: This is a request by Sands Surveying, Inc. on behalf of Owl
Corporation for a one year extension for phase 3 of the preliminary plat of West
View Estates. The developer is requesting the extension to deal with estate matters
due to a recent death in the family. The West View Estates subdivision is a six
phase residential subdivision approved on May 5, 2003 by the Kalispell City
Council subject to 20 conditions. West View Estates is located at the northeast
comer of the intersection of West Reserve Drive and Stillwater Road. The
subdivision includes approximately 60 acres with a zoning designation of R-3,
Urban Single Family Residential, on 50 acres and RA-1, Low Density Residential
Apartment, on 10 acres located in the southwest comer of the subdivision. The
West View Estates subdivision includes 129 single-family lots and one 10-acre
parcel that would later be developed most likely with duplex, townhouse or multi-
family dwellings.
The Kalispell City Council granted final plat approval for phases I and 2 on August
21, 2006. Phase 3 would plat 30 single family residential lots around the city
park. A letter from Sands Surveying, Inc. states that at most there win be two
other phases platting the remaining lots.
The Kalispell Subdivision Regulations require subsequent phases to be filed within
two years of filing the final plat for the first phase. This would require the final
plat for phase 3 to be filed by August 21, 2008. A one year extension would give
the developer until August 21, 2009 to file the final plat.
RECOMMENDATION: A motion to adopt resolution 5294 and grant a one-year
extension to the preliminary plat approval for phase 3 of West View Estates
Subdivision would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

WHEREAS, the City Council of the City of Kalispell granted final plat approval for West View
Estates, Phases I and 2, on August 21, 2006, and
WHEREAS, developer Owl Corporation now desires a one-year extension to the preliminary plat
for Phase 3 in order to handle estate matters due to a recent death in the family, and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and
Platting Act allows the City Council to grant a one-year extension to the preliminary
plat in addition to the original three year approval; and
WHEREAS, good cause exists for the request for extension by Owl Corporation and it is in the
best interests of the City that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION 1. That the application of Owl Corporation for a one-year extension of the
preliminary plat of West View Estates Phase 3, Kalispell, Flathead County,
Montana is hereby approved.

Dear Sean:
On behalf of our client Mark Owens, Owl Corporation, we are requesting a one year
extension for the Preliminary Plat approval of West View Estates, Phase 3 which is
located off West Reserve Drive and Stillwater Lane. The final plats of Phase 1 and 2
were granted by the City Council on August 21" of 2006 and Phase 3 would expire two
years later or August 21st of 2008.
Mr. Owens has secured approvals from the City of Kalispell and the MDEQ for
infrastructure extensions and construction. Construction is nearly complete for all of the
infrastructure requirements, however dues to a death in the family the applicant is
requesting the one year extension to address the estate matters.

Per our conversation you requested information on the remaining West View Estates lots. West
View Estates was approved for 129 single family lots on 60.396 acres, 10.399 of which was
zoned RA-1 (low density apartment). The preliminary plat was approved as six phases for the
129 lots. Phases 1 created nine lots and Phase 2 of West View Estates created 42 lots for a total
of 51 platted lots.
I've attached a copy of the proposed West View Estates, Phase 3 Plat which we have completed
and will be bring to the City for Final Plat review in the next couple months. Phase 3 consists of
30 lots that loop around the new City Park which has the new City Well. The park is 2.192 acres
in size.
The remaining lots will come in most likely as a single phase but at the most two additional
phases. After Phase 3 is platted there will be 81 lots of record leaving 48 lots to be platted in
phase four and possible five. At most there will be five phases.
The multi -family lot (10+ acres) will be created with phase 4 as it is not yet a lot of record. The
multi -family lot will follow the legal description provided in the zone change approval. A
Conditional Use Permit (CUP) will need to be applied for and approved by the City Council prior
to the development of any units on the multi -family tract. With the CUP, the multi -family lot
becomes a separate but related development project as access was planned and conditioned
through the internal subdivision streets within the West View Estates Preliminary Plat.
