Resolution 4461/Notice of Public HearingNOTICE OF PUBLIC HEARING RESOLUTION NO. 4461 A RESOLUTION OF INTENTION TO APPROVE, MODIFY OR DENY A PLANNED UNIT DEVELOPMENT AGREEMENT FOR THE WATERFORD ON SUMMIT RIDGE, L.L.C. WHEREAS, Waterford of the Flathead Valley, L.L.C. a/k/a Waterford on Summit Ridge, L.L.C. on January 11, 1999 made an application for zoning under Chapter 27.21, Kalispell Zoning Ordinance, Creation of Planned Unit Development District, and WHEREAS, on January 9, 1999, the Kalispell City County Planning Board and Zoning Commission reviewed the application and recommended adoption of Residential, R-4 and Low Density Residential Apartment with a Planned Unit Development overlay zoning for the property, and WHEREAS, under §27.21.020, Kalispell Zoning Ordinance requires that the City Council hold a public hearing to consider the recommendation of the Zoning Commission regarding a Planned Unit Development proposal. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION I. That pursuant to §27.21.020 (4), Kalispell Zoning Ordinance, the City Council of the City of Kalispell intends to consider a proposed Planned Unit Development amendment to the Kalispell Zoning Ordinance, made by Waterford on Summit Ridge, L.L.C., as recommended by the Kalispell City -County Planning Board and Zoning Commission. Said amendment consisting of creating a Residential, R-4 and Low Density Residential Apartment with a PUD overlay on property owned by Waterford adjacent to the City limits between Summit Ridge and Four Mile Drive, by adopting, revising or rejecting said proposed amendment. SECTION II. That the City Council of the City of Kalispell shall consider whether to pass a final resolution affirming, modifying or denying H:\attsec\wp\res\waterfordinten.wpd proposed amendment as set forth herein at a meeting to be held on April 19, 1999 at 7:00 P.M., at the Council Chambers, City Hall, Kalispell, Montana, and at the conclusion of said meeting the City Council will consider a Resolution to revise, reject or adopt the proposed amendment. SECTION III. The Clerk of Council is authorized and directed to give notice of this meeting in accordance with Section 7-1-4128, MCA.
