This memo is in response to your request regarding our office's approval on the release
of collateral on the subdivision improvements agreement for Glacier Village Greens
Phase 11. This subdivision was approved by the Flathead County Board of
Commissioners prior to annexation into the city of Kalispell and therefore in some
regards poses an anomaly as to how subdivisions should be reviewed and approved.
This subdivision is further complicated by the fact that it is served by the North Village
Sewer District via an interlocal agreement with the City of Kalispell.
One requirement of subdivision approval was that the roads be constructed to City
standards. In the past there has been inconsistency in the County's approval of the
road profile and the City's requirements. This has resulted in most of the Glacier
Village Greens development being void of sidewalks.
As a result of recent changes to policy by the Kalispell City Council regarding the
provision of services to new subdivisions, this subdivision was annexed into the city
prior to final plat approval in conjunction with other areas of Glacier Village Greens.
In essence this is the first subdivision in the development to be required to install
sidewalks. Although the placement and size of the sidewalks has not been in strict
compliance with the Kalispell Design and Construction Standards, it can be found
that they are in substantial compliance and should be accepted.
Our office would recognize that the improvements have been installed and certified by
Carver Engineering as being complete and in accordance with Kalispell's Design and
Construction standards, and recommend that the collateral for the project be released
to the developer upon request.

The developer should provide a revised Letter of Credit, Cashier's Check, or suitable
financial security prior to releasing the current security for the referenced project.
