BACKGROUND: This is a request for final plat approval of Village Plaza, a five lot
commercial subdivision located on the northeast corner of Whitefish Stage Road and
West Evergreen Drive. The subdivision contains approximately 6.83 and is located on
the northwest corner of Whitefish Stage Road and West Evergreen Drive. Part of the
final plat includes the dedication of a new City street, Village Loop which is an
internal road that has an access from Whitefish Stage Road at the north end of the
subdivision, and an access from West Evergreen Drive at the east end of the
subdivision. This property was annexed to the city in June of 1999 and given a City
zoning designation of 13-1, Neighborhood Buffer District.
The preliminary plat approval was granted by the Kalispell City Council at their June
21, 1999 regular meeting subject to 14 conditions. All of the required conditions have
been met or otherwise adequately addressed. Substantial development on the site
has taken place since the preliminary plat has been approved and several buildings
are either under construction or nearing completion. It is anticipated that as many as
20 to 30 businesses may be located in the subdivision once fully developed.
RECOMMENDATION: A motion to approve the final plat for Village Plaza would be in
order.
FISCAL EFFECTS: Potential minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

Our office has received an application from Sands Surveying for final plat approval of
Village Plaza subdivision will plat five commercial lots with the entire subdivision
containing 6.83 acres. A roadway, Village Loop, will be dedicated to the City of
Kalispell as part of the final plat process. The property is located on the northwest
corner of Whitefish Stage Road and West Evergreen Drive. The property was annexed
to the city of Kalispell in June of 1999 and given a City zoning designation of B-1,
Neighborhood Buffer District.
The preliminary plat was approved by the City Council at their June 21, 1999 regular
meeting subject to 14 conditions. The following is a list of the conditions of approval
and a discussion of how they have been met.
Condition No 1. That the development of the site will be in substantial conformance
with the approved preliminary plat which shall govern the general location of the lots
and accesses.
This condition has been met. The final plat reflects the approved preliminary plat
with regard to lots, access, etc.
Condition No 2. That this property be annexed into the Village County Sewer District
or that some other acceptable arrangement be made to provide public sewer service to
the subdivision which is mutually agreeable to the District and the Kalispell Public
Works Department.
® This condition has been adequately addressed. A letter from the Village County
Sewer District president dated 6/4/99 has been submitted with the plat allowing
connection to their main.
Condition No 3. That all improvements for the subdivision shall be designed and
constructed in compliance with the City of Kalispell's Design and Construction
Standards for local streets. Certification from an engineer licensed in the State of

Montana shall be submitted with the final plat stating that all of the improvements
have been constructed accordingly.'
® This condition has been met. A letter from Carver Engineering dated 10/3/00
has been submitted with the final plat which certifies the improvements for the
subdivision.
Condition No 4. That approval of the water and sewer facilities for the subdivision be
obtained from the Montana Department of Environmental Quality.
® This condition has been met. A Certificate of Subdivision Approval from the
Montana Department of Environmental Quality dated 4/28/00 approving the
subdivision has been submitted with the final plat.
Condition No S. That a letter from the Kalispell Public Works Department shall be
obtained which states that the proposed plans and specifications for all improvements
including sewer facilities, road paving, curbs, gutters, sidewalks, landscaping and
drainage systems have been reviewed and approved in accordance with Kalispell's
Design and Construction Standards and have been constructed accordingly.
® This condition has been met. A letter from the Kalispell Public Works Department
dated 9 / 16 / 00 approving the sewer main extension along with a letter dated
10/2/00 approving the other improvements has been submitted. Certification
from Carver Engineering dated 10/3/00 has been submitted stating that all of the
improvements including the roadways, water and sewer, sidewalks and drainage
have been constructed in accordance with Kalispell's Design and Construction
Standards.
Condition No 6. That a letter be obtained from the Evergreen Water and Sewer
District stating that the plans and specifications for the water facilities have been
reviewed and approved by the district and that service will be provided.
® This condition has been met. A letter from the Evergreen Water and Sewer
District dated 10/21/00 approving the plans for water service to the subdivision
has been submitted with the final plat.
Condition No 7. A letter from the Kalispell Public Works Department shall be
obtained which states that a storm water drainage plan which addresses storm water
management has been reviewed and approved.
® This condition has been met. A letter from the Kalispell Public Works Department
dated 10 / 2 / 00 approving the storm water drainage system for the subdivision has
been submitted with the final plat.
Condition No 8. That sidewalks be constructed on the side of the new unnamed
street serving the subdivision. Sidewalks shall be separated by a five foot landscape

boulevard and the placement of street trees shall be coordinated with the City Parks
and Recreation Department.
® This condition has been met. Sidewalks have been put in place along with the
boulevard and landscaping as verified by an on -site inspection of the
development.
Condition No 9. That approach permits be obtained from the Flathead County Road
Department for the locations of driveways along West Evergreen Drive and Whitefish
Stage Road for the new internal subdivision road and any required conditions be met
prior to final plat approval.
® This condition has been met. Approach permits #AE-1348 and AE-1349 from the
Flathead County Road Department for the new approaches have been submitted
with the final plat and the improvement certified by Carver Engineering.
Condition No 10. That a note be placed on the face of the plat stating that no lot
shall obtain individual access from either Whitefish Stage Road or West Evergreen
Drive and cross easement be noted on the face of the plat which grants access to the
internal lots, Lots 3 and 2, through Lots 1, 3 and 4 or a cross easement be filed as a
separate document.
This condition has been met. The required notes for restricted access and common
area have been placed on the final plat.
Condition No 11. That a common mail facility be located for the subdivision and be
approved by the local postmaster.
This condition has been met. A letter from the USPS dated 9/26/00 approving a mail
facility and location has been submitted with the final plat.
Condition No 12. That the number and location of fire hydrants within the
subdivision be reviewed and approved by the City of Kalispell Fire Department.
This condition has been met. A letter from the Kalispell Fire Marshal dated 9/29/00
approving the hydrants and certification from Carver Engineer for compliance with
the Uniform Fire Code has been submitted with the final plat.
Condition No 13. That any areas disturbed during construction be revegeaated with
a weed -free mix in accordance with a plan approved by the Flathead County Weed
Department.
This condition has been adequately addressed. An approved revegetation plan from
the County Weed Dept. dated 10/3/00 has been submitted with the final plat.

Condition No 14. That this preliminary plat should be effective for three (3) years
following passage of this Resolution.
® This condition has been met. The final plat has been filed prior to expiration of the
preliminary plat.
The final plat is in substantial compliance with the preliminary plat which was
submitted and approved.
This subdivision plat has been found to be in compliance with the State and City
Subdivision Regulations.
This subdivision has been found to be in compliance with the Kalispell Zoning
Ordinance and the B-1, Neighborhood Buffer District, zoning standards which govern
the development standards of the lots within the subdivision.

adequately addressed. The Flathead Regional Development Office recommends that
the Kalispell City Council approve the final plat for Village Plaza and schedule this

The following are preliminary plat approval conditions that we can address and
a brief discussion how each condition has been met.
3. The roads within Village Plaza, including the parking lot(s), were designed
and were constructed in accordance with City of Kalispell Standards for
Design and Construction.
Based on observations of construction and testing, it is our opinion that all
infrastructure improvements - including water, sewer and stormwater
drainage systems; sidewalks; curbs & gutters; roadways and parking lots -
have been constructed in accordance with approved plans and
specifications.
4. Approval of water and sewer main extensions has been obtained from the
MDEQ, and the approval statement accompanies this final plat submittal.
5. A letter from the City of Kalispell, dated September 16, 1999, approving
the sewer main extension is enclosed, as is a letter from the City, dated
October 2, 2000, approving plans for sidewalks, curbs & gutters,
pavement and stormwater drainage.
6. Plans and specifications for the water main extension, to serve Village
Plaza, were approved by the Evergreen Water & Sewer District. See letter
enclosed.
7. Plans for stormwater drainage were reviewed and approved by the City.

8. Sidewalks, with a 5-foot boulevard, have been constructed along one side
of Village Loop, and sidewalks have been constructed through the interior
of the commercial development. The placement of trees along the
boulevard will be coordinated with the City Parks & Recreation Dept.
9. Approach permits have been obtained for the new approach onto
Whitefish Stage and for the new approach onto West Evergreen Drive. In
addition, encroachment permits have been obtained for the water main,
sewer main and sewer services. Conditions of each permit have been
met.
12. The water system was designed to meet flow and pressure requirements
of the Uniform Fire Code - 1994 Edition. The locations of fire hydrants
were approved by the City of Kalispell Fire Department. See letter from
Fire Marshall dated September 29, 2000.

With the final testing of the sewer main extension, which was successfully
completed last week, all water, sewer, and drainage improvements have now
been completed, as well as road(s), curbs & gutters, perimeter sidewalks and
parking areas. - Based on observations of installation/construction, and where
applicable testing, it is our opinion that all work- was done in accordance With
approved plans and specifications.'*
It should be noted that some interior sidewalks that front buildings not yet
under construction have not been completed and likely won't be until work
begins on those buildings, and there is some cleanup work that remains;
however, work on general infrastructure improvements is complete.

Attach a letter which lists each condition of preliminary plat approval and individually state how
each condition has specifically been met. In cases where documentation is required, such as an
engineer's certification, State Department of Health certification, etc., original letters shall be
submitted. Blanket statements stating, for example, "all improvements are in place" are not
acceptable.
A complete final application must be submitted no less than 30 days prior to expiration date of
preliminary plat.
When all final plat materials are submitted to the F.R.D.O. and the staff finds the application is
complete, the staff will submit a report to the governing body. The governing body must act
within 30 days of receipt of the revised preliminary plat application and staff report. Incomplete
submittal's will not be accepted and will not be forwarded to the governing body for approval.
Changes to the approved preliminary plat may necessitate reconsideration by the Planning
Board.
I certify that all information submitted is true, accurate and complete. I understand that
incomplete information will not be accepted and that false information will delay the application
and may invalidate any approval. The signing of this application signifies approval for F.R.D.O.
staff to be present on the property for routine monitoring and inspection during the approval and
development process.

THIS IS TO CERTIFY THAT the plans and supplemental information relating to the subdivision
known as Village Plaza Subdivision
A tract of land located in the Southwest 1/4 Southwest 1/4 Section 32,
Township 29 North, Range 21 West, P.M.M, Flathead County, Montana
consisting of five (5) lots have been reviewed by personnel of the Permitting and Compliance
Division, and,
THAT the documents and data required by ARM Title 17 Chapter 36 have been submitted and
found to be in compliance therewith, and,
THAT the approval of the Plat is made with the understanding that the following conditions shall
be met:
THAT the Lot size as indicated on the Plat to be filed with the county clerk and recorder will not be
further altered without approval, and,
THAT this Certificate supersedes Certificate E.Q. #00-1289 dated the 8ffi day of November 1999,
and all previous copies should be marked superseded or removed from the files, and,
THAT Lots 1, 3, 4 and 5 shall be used for one commercial building, and Lot 2 shall be used for
three (3) commercial buildings, and,
THAT the public water supply will be provided by the Flathead County Water & Sewer District #1,
aka Evergreen Water & Sewer District, and,
THAT the public sewage treatment system will be provided by the Village County Sewer District,
and,
THAT the public water supply and public sewage systems shall be constructed in accordance with
the approved plans and specifications, consisting of approximately 1,872 lineal feet of 8 inch PVC,
AW-W'A C900, Class 150 water main, seven fire hydrants, and appurtenances. The project also
consists of approximately 578 lineal feet of 12-inch sewer main and 275 lineal feet of 6-inch PVC,
SDR 35 sewer main, three manholes, cleanout, and appurtenances. Approval is based on the plan
sheets 1, 2, 3, & 4 of 7 dated received August 26, 1999. Both the plans and specifications were
received under the seal of Thomas M. Cowan P.E. #10323 P.E. of Carver Engineering, Inc., and,
THAT construction will be completed within three years of this date. If more than three years pass
before completing construction, it shall be necessary to resubmit the plans and specifications when
construction is anticipated. This three year expiration period does not extend any compliance
schedule requirements pursuant to enforcement action against a public water/sewage system, and,

THAT within 90 days after construction is completed upon a public water system, wastewater
system, or storm drainage system, or upon an extension of or addition to such a system, the
professional engineer shall certify to the Department that the construction, alteration or extension
was completed in accordance with the plans and specifications approved by the Department, and,
THAT project certification shall be accompanied by a complete set of "as -built" drawings bearing
the signature and seal of the professional engineer, and,
THAT the stormwater drainage shall be constructed in accordance with approved the plans and
specifications. Approval is based on plan sheet 7 of 7 dated received August 26, 1999. Both the
plans and specifications were received under the seal of Thomas M. Cowan P.E. #10323 P.E. of
Carver Engineering, Inc., and,
THAT instruments of transfer for this property shall contain reference to these conditions, and,
THAT the developer and/or owner of record shall provide each purchaser of property with a copy
of the Plat, and a copy of this document, and,
THAT departure from any criteria set forth in the approved plans and specifications and Title 17,
Chapter 36, Sub -Chapters 1, 3, and 6 ARM when erecting a structure and appurtenant facilities in
said subdivision without Department approval, is grounds for injunction by the Department of
Environmental Quality.
Pursuant to Section 76-4-122 (2)(a), MCA, a person must obtain the approval of both the State
under Title 76, Chapter 4, MCA, and local board of health under section 50-2-116(1)(i), before
filing a subdivision plat with the county clerk and recorder.

action, defend the same at its/his sole cost and expense and satisfy any ludg it whim may be rendered against the County
in any suit or action.
T. PROTECTION Of RWIC. Insofar as the interests of the County and the traveling public are concerned, all work
performed under this permit shall be done under the supervision of the County load Department and its authorized
representatives, and he/they shall indicate the traffic control devices, the lighting thereof at night, placing of flagmen
and watchmen, the acceptable canner in which traffic is to be handled, and shall specify to Persittee how road surface is
to be replaced if it is disturbed during operations, but said supervision shall in no way operate to relieve or.discharge
Persittee from any of the obligations assumed by acceptance of this permit and especially those set forth under Section 6
hereof.
S. HI AY DRAINAGE. If the work done under this permit interferes in any way with the drainage of the County highway
affected, Peraittee shall, at its/his own expense, sake such provisions as the County say direct to take -care of said
drainage.
RUBBISH PA DORIS. Upon completion of work contemplated under this permit, all rubbish and debris shall be immediately
removed and roadway and roadside left in a neat and presentable condition satisfactory to the County.
10. WMI TO BE MVISED BY COUNTY. All work contemplated under this permit shall be done under the supervision of and to
the satisfaction of the authorized representative of the County, and the County hereby reserves the right to order the
change of location or removal of any structure of installation authorized by this permit at any time, said changes or
removal to be jade at the sole expense of the Peraittee.
11. TY'S RIQiT NOT TO BE INTERFERED WITH. All such changes, reconstructing, and relocation shall be done by Peraittee
in such a tanner as will cause the least interference with any of the County's work, and the County shall in no way be
liable for any damage to the Peraittee by reason of any such work by the County, its agents, contractors, or
representatives, or by the exercise of any rights by the County upon the highways by the installation or structures placed
under this permit.
.2. REIMVAL OF INSTALLATIONS OF STRUCTURES. Unless waived by the County, upon termination of this permit, the Peraittee
shall remove the installation or structures contemplated by this permit and restore the premises to the condition existing
at the time of entering upon the same under this permit, reasonable and ordinary wear and tear and damage by the elements,
or by circumstances over vhich the Peraittee has no control, excepted.
13. NAINTEM AT EXPENSE OF PERMITTEE. Peraittee shall maintain, at Its/his sole expense the installations and structures
for which this permit Is granted, in a condition satisfactory to the County.
14. Y NOT LIABLE FOR DAMAGE TO INSTALLATIONS. In accepting this permit the Persittee agrees that any damage or injury
done to said installations or structures by a contractor working the County or by any County employee engaged
in construction, alteration, repair, maintenance, or improvement of the County right-of-way shall be at the sole expense
of the Persittee.
15. TY TO BE REIMBURSED FOR REPAIRING ROADWAY. Upon being billed therefor, Persittee agrees to promptly reimburse the
County for any expense incurred in repairing surface of roadway due to settlement at installation, or for any other damage
to roadway as a result of the work performed under this permit.

2.) A corrugated metal culvert having a minimum diameter of (12,
15, 18) Inches be installed beneath the approach such that
the culvert bottom (invert) be even with and at the same g�-ra
as the ditch bottom. (The culvert will provide adequate
drainage should water accumulate in the ditch.)
3.) The approach must have a 20 foot long landing graded 3 percenL
away from, the county road. (See the attached sheet for
details.) (This will reduce the amount of gravel loss and
the possibility of drainage from the approach on to the -countT
road.)
4.) All approaches onto a paved road shall be paved a nlaimum of
3 inches compacted by 24 feet wide and from the paved road to
the outside edge of the right-of-way. For additional
construction s-Decifications and requirements see "Approach
Permit Attachment" (Appendix B)
All area within the county right-of-way disturbed during
cons trUction must be reseeded wizhia 14 days. A four imch
layer of topsoil must be spread over all disturbed areas of
the right-of-way prior to reseeding. (See the attached
sheet for detadetai l s .) (Reseeding will reduce the potential
for growth of noxious weeds adjacent to the county road as
well as the adjacent property.}
