RE: Village Plaza Subdivision
Dear Mr. Dittman:
At the June 21, 1999 Meeting, the City Council approved a
preliminary plat application for the Village Plaza Subdivision
located at the corner of Evergreen Drive and Whitefish Stage. One
of the conditions placed on the plat, which must be satisfied prior
to final plat approval, stated:
That this property be annexed into the Village County Sewer
District or that some other acceptable arrangement be made to
provide public sewer service to the subdivision which is
mutually agreeable to the District and the Kalispell Public
Works Department.
In reviewing the agreement between the City and Village County
Sewer District, Section 5.1 of said agreement provides in part:
The District shall not expand its boundaries or provide
service to any properties outside its boundaries without the
express written permission of the City. Otherwise, the
District (and not the City) shall have exclusive right to
expand the boundaries of the District, pursuant to Montana
law. . . .
Please be advised, that in my opinion the City cannot force the
Village County Sewer District to annex any property. The City must
consent to the annexation of territory to the District, but does
not have the authority under the agreement to sua sponte annex
property to the District.

If Mr. Schulze has not approached the District's Board concerning
annexation, I am sure he will at some time in the near future. If
and when the Board does agree to annex the Village Plaza
Subdivision into the District, please advise the City of your
decision so that the City, in keeping with the letter and spirit of
our agreement, will have the opportunity to consent to said
annexation.

Re: Village Plaza — Street Name
Dear Tom,
Earlier this year the Public Works Department assigned addresses to the Village Plaza
Subdivision. At that time it was observed that the roadway associated with the subdivision was
named Village Loop on the preliminary plat. The City of Kalispell Subdivision Regulations,
Section 3.09, K.7. reads in part "Names of new streets aligned with existing streets shall be same
as those existing streets." The roadway serving Village Plaza is aligned with Buffalo Stage. In
order to comply with this regulation the roadway shall be named Buffalo Stage. City Staff does
not have the authority to circumvent the City of Kalispell Subdivision Regulations.
Please revise the plat accordingly. Upon submittal of the revised plat it will be promptly
processed.

A. All roadway improvements including pavement, curbs, gutters, and
drainage systems shall be constructed in accordance with the adopted
Standards For Design and Construction, Kalispell, Montana.
B. All roads within a proposed subdivision shall be approved by the City
Engineer and upon completion of construction shall be certified by a
licensed Professional Engineer that they are in compliance with these
regulations.
C. Residential driveways shall not have direct access to arterial streets or
State or Federal Highways.
D. Collector streets shall be designed to afford easy access to arterial or other
collector streets or for street continuation to adjoining areas.
E. When a subdivision abuts or contains an existing or proposed arterial
street, the City Engineer may require a frontage roads or other treatment
as may be necessary for adequate protection of residential properties and
to separate arterial and local traffic. Screen plantings or other means of
screening may be required in areas abutting arterial streets or highways.
F. When a subdivision abuts or contains a railroad right-of-way or a
controlled access highway, a street approximately parallel to and on each
side of such right-of-way at a distance suitable for an appropriate use of
the intervening land may be required. Such distances shall also be
determined with regards to the requirements of approach grades and future
grade separations.
G. All dead-end streets shall terminate in an approved cul-de-sac. Where a
future street extension is proposed, a temporary cul-de-sac as approved by
the Fire Chief and City Engineer shall be provided.
H. Half streets are discouraged but will be reviewed on a case by case basis
and only when there is reasonable assurance that the adjoining right-of-
way can be obtained in the foreseeable future.
I. Horizontal alignment of streets must ensure adequate sight distances.
When street center lines deflect more than five (5) degrees, construction
shall be made by horizontal curves.

J. In minor subdivisions where lot access is provided by existing streets,
City Council may require waiver of protest to a special improvement
district (SID) to upgrade the street in lieu of actual street improvements,
in order to avoid upgrading small sections of existing streets.
K. Street intersections shall meet the following requirements:
1. Streets shall intersect at 90' angles, if topography permits but in no
case shall the angle of intersection be less than 75' for a minimum
distance of 60 feet as measured along the centerline.

2. No more than two streets may intersect at one point.
3. Two streets meeting a third street from opposite sides shall meet
the same point, or their centerlines shall be offset at least 125 feet
for local roads and 300 feet for arterials or collectors.
4. Intersections of local streets with major arterials shall be kept to
a minimum.
5. Hilltop intersections are prohibited, except where no reasonable
alternatives exist. Intersections on local streets within 100 feet of
a hilltop are prohibited. Intersections on arterial or collector
streets within 200 feet of a hilltop are prohibited.
6. Maximum grade of approach to any intersection shall not exceed
2 % for a distance of 60 feet as measured from edge of travel
ways to provide for adequate starting, stopping and stacking
distances.
7. All streets shall be named. Names of new streets aligned with
existing streets shall be same as those of existing streets. Proposed
street names shall not duplicate or cause confusion with existing
street names and shall be taken from an approved list located in
the City Engineer's Office.
8. Location of collector and arterial streets shall comply with the
Kalispell City -County Master Plan or any other major street and
highway plan adopted by the Board of County Commissioners
and/or the City of Kalispell.
L. Street light installations are required on all streets within the subdivision.
M. Street or road signs and traffic control devices of the size, shape and
height as approved by the City Engineer shall be placed at all intersections
by the developer. Traffic control devices shall be consistent with the
latest addition of "Manual of Uniform Control Devices".
3.10 ALLEYS:
A. Alleys may be required by the City Council.
B. Alleys, if required, shall be at least 20 feet wide and shall be open at both
ends.
Street Names for Future Subdivision Roads
Quadrants will determine the type road name used with the city
divided into 4 areas. Using the intersection of Hwy 93 and Hwy 2
as the dividing lines there is a NW , NE , SW , BE Quadrant.

Fred has advised me of a brewing confusion over the proper name of the new extension of
Buffalo Stage that loops around the Village Plaza. development. As his memo indicates, the
developer initially asked for it to be named Village Loop but, since this would conflict with City
subdivision regulations, it was changed to Buffalo Stage. Now it appears that someone has
changed the signs to Village Loop.
We have been told that an unnamed city official may have interceded in this and OK'd a
change back. Do you have any information on this issue? As Fred has warned, if this is not
resolved soon there is a strong possibility that the business owners may be unnecessarily harmed if
their address has been wrongly stated to them.

Re: Village Plaza Subdivision — Stre ame Issue
Earlier this year I provided addresses for the Village Plaza development which is located at the
intersection of Whitefish Stage Road and West Evergreen Drive. I noticed that the name of the
street as shown on the plat did not comply with the City of Kalispell Subdivision Regulations.
The plat indicated the name of the road as Village Loop. The roadway is aligned with Buffalo
Stage on the opposite side of Whitefish Stage Road. The subdivision regulations require that
names of new streets aligned with existing streets shall the be same as those of existing streets. In
conjunction with the addressing I required the name of the road to be changed to Buffalo Stage.
Street signs which read Buffalo Stage were installed shortly thereafter by the developer.
Early in September I received a phone call from Tom Sands, the developer's surveyor and
representative for the project. Tom advised me that the developer was requesting the name of the
road be changed to Village Loop so the development could have its own identity. If the road
continues to be named Buffalo Stage it would be associated with the Buffalo Stage development
and not the Village Plaza development. In reply I mailed Sands Surveying a letter explaining the
reasoning for naming the road Buffalo Stage and advised Tom that City staff does not have the
authority to circumvent the subdivision regulations.
Yesterday I received a call from the Building Department and was advised that there was
confusion as to the name of the road. Builders obtaining building permits for lots within the
development were certain the road was named Village Loop and not Buffalo Stage. I advised the
Building Department that the name of the road is Buffalo Stage. A subsequent visit to the
development revealed that the Buffalo Stage signs had been replaced with Village Loop signs.
This situation must be resolved quickly or the eventual tenants will suffer the consequences.
