Attached is the calculation sheet used to determine the Water and Sewer Latecomers Fees and an
invoice for the referenced project. These charges are as follows:

Currently there does not appear to be a latecomer's fee associated with the 1500 gallons per
minute fire flow.
Latecomer fees are collected by the City of Kalispell, under an agreement with Owl Corporation,
the developer who constructed extensions to water and sewer systems (collectively the
"Extensions"), serving parcels now owned by the developer and others. The intent of the
agreement is to provide for collection of the fair pro rata share of the total project costs of the
Extensions from the owners of the properties which benefit from the Extensions, but who did not
contribute to the original cost thereof.

Attached please find our calculations for the water and sewer latecomer fees. As can be
seen in the calculations, the LEER work completed on the building implemented water
saving measures that reduced our water usage from previous estimates. Please take a look
at our calculations and contact me with any questions.
AIso attached is the letter we received in January 2007 that concluded we are not required
to pay any fire -flow latecomer fees.

.Dear Mr. Goldberg:
BCER Engineering, Inc, has completed the requested review and evaluation of the building construction
type and water supply for the proposed Forest Supervisor's Office and Tally Lake Ranger District located
at 725 Stillwater Rd., Kalispell, MT 59901. The review and evaluation was based on the 2003
International Building Code (IBC) and the 2003 International Fire Code (iFC), The purpose of this letter
is to provide a report of findings for the review and evaluation of the building construction type and water
supply for the proposed project. Recommendations and conclusions are also provided.
The findings are as follows:
Although not required based on use, occupancy, and type of construction, the building is to be
protected with an automatic fire sprinkler system in accordance with Section 903.3.1.1 of the
2003 IBC (installed and tested to NFPA 13 Standard for the Installation of Sprinkler Systems).
2. Although not required based on use, occupancy, and type of construction, the building is to be
protected with a fire alarm and detection system in accordance with Section 907 Fire Alarm and
Detection Systems of the 2003 IBC (installed and tested to NFPA 72 National Fire Alarm Code),
3. According to Treble 601 Fire -Resistance Rating Requirements for Building Elements (hours)
in the 2003 IBC, "an approved automatic sprinkler system in accordance with Section 903.3,1.1
shall be allowed to be substituted for I -hour fire resistance -rated construction, provided such
system is not required by other provisions of the code or used for an allowable arch increase in
accordance with Section 506.3 or an allowable height increase in accordance with 504.2." It is
BCER Engineering, Inc.'s understanding that the automatic sprinkler system will be installed in
accordance with Section 903.3.1.1 and that the automatic sprinkler system is not being installed
to increase allowable area or height. BCER. Engineering, Inc, confirmed the calculations for
increased area based on Section 506 Area Modifications of the 2003 MC and the automatic
sprinkler system is not being installed to increase the building's area or any other provisions of
the Building Code (2003 IBC). Based on the use and occupancy classification (Group B and

Group S-l), an automatic sprinkler system is not required to be installed per the 2003 IBC. This
finding does allow the 1-hour fire resistance -rated construction to be eliminated with the
installation of the automatic sprinkler system for Type V-A construction. This does not change
the construction type. The building is still considered Type T-A (]-hour) construction, utilizing
footnoted The 2003 IBC Co7nmenrary stares, "Note d permits buildings of Type 11A, IIIft and
Ir.A construction to use an automatic sprinkler system in compliance with NFPA 13 as an
alternative to 1-hour fire -resistance -rated construction. In order to utilize the substitution the
sprinkler system must nor be required for any other reason, including for increases in allowable
height and area. The sprinkler system may not be used as an alternative to the fire -resistance
rating for exterior walls. This means that this exception is applicable in very limited
circumstances. " This exception is therefore permitted in the application.
4. According to Table 602 ]Eire -Resistance Rating Requirements for Exterior WRILS gassed on
Fire Separation Distance in the 2003 IBC for use and occupancy classifications Group B and
Group S-1, exterior walls are not required to be fire resistance -razed construction with fire
separation distances greater than or equal to 30 feeL This frndingdoes allow the exterior walls to
hold afire resistance -rating of 0 hours based the identified separation distances on the provided
plans (minimum of 30 feet).
S. According to Section 302.3 Mixed occupancies in the 2003 IBC, "the building or portion thereof
shall comply with Section 302.3.1 or 302.3.2 or a combination of these sections." This finding
indicates there appears to be a discrepancy in the fire barrier wall separating the Group B
occupancy and the Group S-1 occupancy and the required fire -resistance rating. The Group S I
should be classified as Group S 2.
6. Confirm the fate -resistance rating of the fire barrier wall separating the Group B occupancy and
the Group S-1 occupancy and the method used according to Section 30.2 Mixed occupancies in
the 2003 IBC. Table 302.3.2 Required Separation of Occupancies (Hours)' in the 2003 IBC
indicates the that the separation rating should be 3 hours reduced to 2 hours per the Exception in
302.3.2 Separated rises in the 2003 IBC. The provided plans indicate a separation rating of I
hour. If the use is changed from a Group S-1 to a Group S-2 as described in Item 3, the
separation rating per Table 302.3.2 Required Separation atOccupancies (Hours)* in the 2003
IBC between the Group B occupancy and the Group S-2 occupancy would be 2 hours reduced to
1 hours per the Exception in 302.3.2 Separated uses in the 2003 IBC. Although this
discrepancy does not impact the fire flow interpretation, the code sheet should be corrected.
7. According to Appendix B Fire -Flow Requirements for Buildings in the 2003 IFC, the required
fire flow in gallons per minute (GPM) for the proposed building would be 1500 GPM for 2 hours.
This finding is based on the requirements set for in Table B105.1 Minimum Required .Fire Flow
and plow Duration For Buildings` in the 2003 IFC. Due to the .Type V A construction, the fire
(low calculation area including horizontal projections (29,785 square feet), and the Installation
of an automatic fire sprinkler system, Section .8105.2 Buildings other than one- and two-family
dwellings in the 20031FC allows a SO percent reduction in the required f ire flow (300012=1500

Dan Lozar of Thomas, Dean, & Hoskins, Inc. verified that the origiaal assumption is that 1625
GPM at 20 psi is available to the site &orn the 14" water train on Stillwater Road. It is BCER
Engineering, Inc.'s understanding this flow has been provided for the sprinkler system design. It
is also our understanding that the water system on No dame Street will be looped at a future date.
9. BCER Engineering, Inc. assumes that the location of the Fire Department Connection (FDC) and
the placement of fire hydrants have been confirmed with the Kalispell Fire Department.
BCER, Engineering, Inc. makes the following recommendations/conclusions:
I. By installing an automatic fire sprinkler system in a Type V-A constructed building, the 1-hour
fire resistance -rated construction can be reduced by 1-hour. This does not change the
construction type. The building is still considered Type V-A (I -hour) wr struction. This is in
accordance with Table 681 Fire -Resistance Rating Rtguirements far ftilding Elements
(hours) in the 2003 IBC fooin2te d.
2. Based on the fire flow reduction with the installed automatic sprinkler system; a reduction of the
number of available fire hydrants on site is not recommended. Three (3) fire hydrants should
remain to anssure appropriate hydrant placement is available to the Kalispell Fire department for
their selected strategy and tactics for firefighting operations, firefighter safety, life safety, and
property protection.
3. The client and the Kalispell Fire Department fire inspector should meet to ensure code
compliance and an understanding of the IBC and IFC requirements with regard to the installation
of non -required automatic sprinklers and fire alarm a.rid detection systems_ This should
encourage cooperation and a shared understanding regarding occupant and firefighter safety.
4. The available water flow of 1625 GPM at 20 psi to the site .from the IV water main on Stillwater
Road meets the requirements of the fire flow 1500 GPM per Appendix B Fire -Flow
Requirements for Buildings in the 2003 IFC. Additionally, the available water flow will only
improve for the area when the system is looped in the fi=e.
5. Review the use and occupancy of the Group S-1 area of the building and the requirements of
Group S-2 per the 2003 IBC. The separation change from 1-hour to a 2-hour rating will need to
be considered. Another option is to change the use from Group S-1 to Group S-.2. This will

in this building in addition to the automatic sprinkler system It should be noted that this review and
evaluation of the building construction type and water supply did not include a review of the fire alarm
and detection system or automatic sprinkler system
Based on our reviews, the current design meets and in some cases exceeds the minimum building and fire
codes. By meeting the minimum 1500 GPM requirements of the; 2003 IFC, this building meets the intent
and spirit of that code provision and should not be required to exceed the 1500 G.PM minimum fire flow
requirement.
