Dear Mayor Boharski:
This letter is in response to the amendment to the State of Montana Spring Prairie Planned Unit
Development (PUD) Agreement that passed at your council meeting on Monday, November 19,
2001. The Department cannot support the amendment to the agreement that restricts all retail
development on the property to "conditional use".
This issue regarding placing a "conditional use" requirement was not raised during the first
reading, and the department did not anticipate the Council considering an amendment of this type
during second reading. We believe that we can present information to convince the Council that
placing this "conditional use" restriction is inappropriate in this circumstance.
Due to the fact that the Department was not present to clarify the facts of the PUD and our
position, we respectfully request that this amendment be rescinded and/or a third reading of the
PUD occur.
