Re: Southfield Park Development
On April 26, 2000, representatives of Jackola Engineering met with the
Site Review Committee to discuss a significant development at Southfield
Park. Although I was not in attendance at the meeting, staff has related
that Jackola indicated the need for additional parking associated with
the project requiring City accommodation on Lion's Park Street.
Considering the hiatus of development within Southfield Park, the City
is anxious to see the development proceed. However, issues still
unresolved with regard to the Development Agreement may deter the City's
ability to cooperate. Lions Street Park, under the Development Agreement,
exists as an undedicated/ undeeded street providing access to and
encouraging the use of Lion's Park. The use of the area for parking
purposes would obviously impede public access to the park. The City
Council must be involved in the decision to allow its use for the parking
associated with the development of Southfield Park. Without resolving our
difficulties, convincing the Council to exercise the discretion for your
benefit may be difficult.
The City Finance Department has determined, under our interpretation of
§5.5 of the Development Agreement, that as of this date you are obligated
to pay the sum of $162,537. We anticipate an additional sum of
approximately $65,000 will be owed after the 2001 tax is determined.
In recent conversations you indicated to me that you did not dispute the
amount claimed but merely desired an adjustment in the schedule. I
believe the time is right for a discussion of our respective positions
on the matter, with the object being the successful resolution of our
difficulties.
I will be leaving town on May 3, 2001 for about 10 days. Hopefully we can
meet either today or on May 2 to discuss the matter.
