Box 114 Whitefish, MT 59937 Preliminary Plat Approval Waiver for Bob Cook. -Townhouse -Subdivision Dear Bob: This letter is in response to your request for waiver of preliminary plat approval for a four lot townhouse subdivision. The subdivision is proposed to have two parent lots each with two sublots to be used for townhouses. The property is located on the south side of Sunnyside Drive in Kalispell and is zoned R-4, a Two Family Residential zoning district. The property proposed for the subdivision: can be described as Lot 2 of the Amended Plat of Lot :.1. of Insteness Subdivision located in Section .19, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. Our office can find that this development can meet the criteria outlined in Section 2.06 of the Kalispell Subdivision Regulations which addresses preliminary plat waiver. Specifically, we can find that (1) the plat contains live or fewer lots; j2) these is no public dedication of streets or public or private parkland, (3) all lots have legal and physical access conforming to these regulations, (4) _ each lot has a suitable .building_ site, and ,there are .now environmental hazards present, (5) ' municipal water and sewer are adequate and in place, (6) the subdivision complies with these regulations and zoning regulations, (7) there is no significant effects anticipated .on agriculture and agricultural 'fer user " facilities; local "services, the .. natural environmental wildlife acid wildlife habitat and the public hea'lth'and safety. The preliminary plat for the. aforementioned subdivision is hereby waived subject to the following conditions: _ 1. That access to the site be limited to two driveway approaches which will be located on the east and west ends of the property with curbing installed between the driveways. The approach on the west end of the property is a shared access with the adjoining property to the west. 2. Obtain approach permits from -the City of Kalispell Public Works Department -and comply with the conditions for the driveway approaches onto Sunnyside Drive. 3. That the driveway approaches be paved prior to final plat approval and that the parking lots shall be paved upon completion of construction. 4. That_ a five. foot landscape buffer be established between the curb and the property boundary and street trees be placed at 40 foot intervals which have a minimum of a one and a half inch caliper at planting. This waiver of preliminary ,plat approval is valid for three years and --shall expire. on February 23, 2001. Driveway construction in all other areas must be approved by the Kalispell Public Works Department prior to construction. 2) The nearest edge of any driveway shall not be closer than 35 feet to the nearest edge of the pavement of the street intersecting the street serving the driveway. If curbing exists, the roadside face of the curbing shall be the measuring point. 3) All driveway construction shall be in conformance with the Standards and General Provisions for Design and Construction for Kalispell, Montana. The basic construction requirements are as follows: a) Existing curbing at the location o the driveway must be removed and replaced with drive over type curbing. b) Driveway approaches between the curbing and property line must be constructed with concrete or asphalt.
