CorrespondenceRelease of collateral for Stratford Village Ph. 1 Subject: Release of collateral for Stratford Village Ph. 1 Bate: Tue, 31 Dec 2002 13:39:39 -0700 From: "Narda Wilson" <tricitynarda@centurytel.net> To: "Carol Kostman (E-mail)" <ckostman@kalispell.com> Hi Carol - The developer called about his release of collateral for Stratford Village Ph. 1 which was a letter of credit for around $91K. As you know we received the final plat for Stratford Village Ph 2 which has a subdivision improvements agreement with it. The subdivision improvements agreement for Ph. 2 includes a little bit of work still needed in Phase 1 and is included in the "new" letter of credit. The improvements associated with Phase 1 were certfied by Jackola Engineering as being completed except for some paving of the alleys. You should send the developer his orignal letter of credit filed with Phase 1, but I think it might have expired Dec. 1, 2002 anyway. Thanks and have a great new year, Narda I of 1 1/6/2003 8:28 AM 1_141te THE CITY OF KALISPELL, MONTANA 312 First Avenue East — P.O. Assistant City Engineer RE: Stratford Village Subdivision Combined Phase I, II, and III Security agreement amount to $59,800 Dear Mr. Castles: This letter is a request by the Developer, Norman Sanderson of Apex 1, LLC through this office to reduce the Phase III security amount from $187,895.00 to $41,125.00. It is also requested that the carry forward security amounts for Phase I ($4,212.50) and Phase II ($14,462.50) be combined and added to the Phase III amount of $41,125.00 for a combined Phase I, II, and III security amount of $59,800.00. This would allow the security amount to be inclusive of all current three phases under one security agreement. Exhibit "A" is part of this letter of request. We respectfully request the City of Kalispell to allow the security reduction request and process the reduction of the current Phase III agreement amount from $187,895.00 to $59,800.00 which includes the amount carried forward from Phase I and Phase II. This would allow the current Phase I and II agreement amount of $18,675.00 to expire as a result of it being included with Phase III required security amount for the total of $59,800.00. The Developer is planning to begin Phase IV in the spring of 2005 when weather permits as well as resolve the corrective measures under the security agreement of concern with the City.
