SUBJECT Revisions to the Preliminary Plat for Sinopah Subdivision
MEETING DATE: February 7, 2005
BACKGROUND: Sinopah Subdivision is a 26 lot residential subdivision on
approximately 5.53 acres in the northwest part of Kalispell. This 26 lot residential
subdivision has 18 single family lots and 8 two unit townhouses. The zoning is R-4,
Two Family Residential and accommodates the two unit townhouses. The property is
located between North Meridian Road and Northwest Lane, north of Three Mile Drive.
The property can be addressed as 125 Northwest Lane. Currently there are three
houses and two mobile homes that will be removed from the property when the
subdivision is developed.
This subdivision was approved by the Kalispell City Council on August 2, 2004
subject to conditions. Subsequent to city council approval, a more thorough
engineering analysis of the infrastructure was conducted revealing some
topographical challenges on the lots to the east of the site. Therefore, the developer is
requesting the city council consider a modification to the preliminary design which
would shift the cul-de-sac to the west approximately 120 feet. This results in the
elimination of the proposed landscape buffer along Meridian Road and the creation of
two lots along Meridian with the remaining lots accessed via the internal access road
off of Northwest Lane.
Because this can be considered a significant change to the preliminary design, the
revision cannot be approved administratively. The most significant change is the
access onto Meridian Road whereas before the two existing accesses were eliminated.
In consultation with the Kalispell City Attorney, it was determined that the city
council would be able to consider this change rather than sending the subdivision
back through the public hearing process and scheduling the matter before the
planning board. Therefore, consideration of the proposed change has been scheduled
for public hearing before the city council in order to provide an opportunity for
comment on the revision.
The attached resolution schedules a public hearing for March 7, 2005. An updated
adjoining landowners list is being provided by the developer and a public hearing
notice will be sent to them advising them of the proposed change and their
opportunity to comment.

At the time of the public hearing a revised staff report will be presented to the city
council and appropriate conditions placed on the plat to address the changes and
potential impacts to Meridian Road.
RECOMMENDATION: A motion to adopt the resolution of intention to hold a public
hearing on the proposed revisions to the preliminary plat for Sinopah Subdivision
would be in order.
FISCAL. EFFECTS: Minor positive impacts once developed.

TRANSMIT/ 2004 / KPP04-9 MEMO AMENDMENTS
WHEREAS, Karen and Jeff Thiesen, the owners of the certain real property described as Lots 13,
14, 15, 27, 28, and 29, Block 1 Northwest Tracts, a platted subdivision in Section 1,
Township 28 North, Range 22 West, P.M.M., Flathead County, Montana, has
petitioned for approval of the Subdivision Plat of said property, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission held a public hearing on
July 13, 2004, on the proposal and reviewed Subdivision Report #KPP-04-9 issued
by the Tri-City Planning Office, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission recommended approval
of the Preliminary Plat of Sinopah Subdivision, subject to certain conditions and
recommendations, and
WHEREAS, the City Council of the City of Kalispell passed Resolution 4917 on August 2, 2004,
approving the preliminary plat subject to those certain conditions, and
WHEREAS, the Developer now desires to have the City Council of the City of Kalispell consider
certain revisions to the preliminary plat and is being asked to approve, disapprove or
conditionally approve the proposed revisions to the preliminary plat, and
WHEREAS, because the proposed revisions are uncomplicated, the Developer requests the City
Council of the City of Kalispell to consider said revisions without another
preliminary plat review by the Planning Board, and
WHEREAS, in order to satisfy the public interest and to allow public participation and comment,
the City Council of the City of Kalispell shall on the 7th day of March, 2005, hold a
Public Hearing, pursuant to MCA 7-1-4127 to hear all persons and things relative to
the proposed preliminary plat.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That it is the intention of the City of Kalispell that they will consider
proposed revisions to the preliminary plat for Sinopah Subdivision.
SECTION II. The City Clerk shall forthwith prepare and publish in the Daily Inter
Lake, a daily newspaper published at Kalispell, Montana, proper
notice of this Resolution of Intention, which shall be published twice,
with at least 6 days separating each publication.
SECTION III. During the period between the first publication of said notice by the
City Clerk and the public hearing, the City Clerk will receive
expressions in writing of the approval or disapproval of the proposed
preliminary plat.
SECTION IV. At the regularly scheduled meeting of the City Council of the City of
Kalispell, the City Clerk shall forward all written communication
received by said Clerk for Council's consideration.
SECTION V. The City Council, after considering all written communication as well
as oral testimony, may adopt a resolution approving, disapproving or
conditionally approving said preliminary plat.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
CITY OF KALISPELL, THIS 7TH DAY OF FEBRUARY, 2005.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council will hold a Public Hearing on the 7th
of March, 2005 at 7:00 pm in the City Hall Council Chambers to consider revisions to the
preliminary plat for Sinopah Subdivision.
NOTICE is further given that the City Council on the 7th day of February, 2005, passed
Resolution No. 4974 declaring an intention to consider revising said preliminary plat. Said
Resolution No. 4974 declares that it is in the best interest of the City of Kalispell and the
inhabitants thereof that said property be considered for preliminary plat revision.
NOTICE is further given that the City Clerk will receive expressions in writing of
approval or disapproval of the proposed revisions to the preliminary plat from the property
owners residing in the immediate area of the preliminary plat. The City Clerk's address is PO
Box 1997, Kalispell, MT 59903.
The City Council, at the time of the Public Hearing on the 7th day of March, 2005, shall
consider all written communication and public comment received by the City Clerk pursuant to
this Notice. Following the Public Hearing, the Council may duly and regularly pass and adopt a
Resolution approving the revisions to preliminary plat, as described above. The time when the
said Resolution shall go into effect shall be fixed by said Resolution.
