Patrick, City Manager Final Plat for Sinopah Subdivision October 3, 2005 Telephone: (406) 751-1850 Fax: (406) 751-1858 Website: kalispellplanning.com BACKGROUND: This is a request for final plat approval of Sinopah Subdivision that plats 16 single-family lots and 8 sublots from 6 parent lots, on approximately 5.49 acres. This subdivision is located between Northwest Lane and Meridian Road, north of Three Mile Drive. Most of the required infrastructure has been completed and constructed in accordance with City standards. The remaining improvements are being addressed with a subdivision improvements agreement and a letter of credit in the amount of 125 percent of those costs totaling $96,640. It is anticipated that the remaining improvements will be completed by November 1, 2005 in accordance with the agreement. Cash -in -lieu of parkland has been submitted in the amount of $7,880 in park improvements is included in the SIA. The subdivision was given preliminary plat approval by the Kalispell City Council on August 2, 2004. Preliminary plat was amended by City Council March 7, 2005 to address the existing homes fronting on Meridian Road. A list of the conditions of preliminary plat approval for this subdivision and a discussion of how they have been met or otherwise addressed is included with the transmittal letter attached. RECOMMENDATION: A motion to accept the subdivision improvements agreement and approve the final plat for Sinopah Subdivision would be in order. Drawer 1997 Kalispell, MT 59901 Re: Final Plat for Sinopah Subdivision Dear Jim: This is a request for final plat approval of Sinopah Subdivision. This major subdivision creates 16 single-family lots and 8 sublots from 6 parent lots, on approximately 5.49 acres. The property is located between Northwest Lane and Meridian Road, just north of Three Mile Drive. Preliminary plat for this subdivision was granted by the City Council on August 2, 2004. Preliminary plat was amended by City Council March 7, 2005 to address the existing homes fronting on Meridian Road. Condition #4 was amended to allow those two homes to remain. A Subdivision Improvements Agreement in the amount of $96,640 has been submitted to secure completion of the remaining improvements which consists primarily of the water, sewer and utility work as well as road construction and paving. The letter of credit addresses 125% of the estimated cost of remaining improvements. The estimated completion date is November 1, 2005. The preliminary plat was approved with 17 conditions as outlined below. The following is a discussion of compliance with each of these conditions as well as findings of compliance with the City subdivision regulations and zoning ordinance. COMPLIANCE WITH CONDITIONS OF APPROVAL: Condition No. 1 Development of the subdivision shall be platted in substantial compliance with the approved preliminary plat which governs the location of lots and roadways within the subdivision. (Kalispell Subdivision Regulations, Appendix C - Final Plat) . 0 This condition has been met. The lots have been platted as approved. Condition No. 2 That the plans and specifications for all public infrastructure be designed and installed in accordance with the Kalispell Design and Construction Standards and a letter shall be obtained stating that they have been reviewed and approved by the Kalispell Public Works Department. (Kalispell Subdivision Regulations, Chapter 3, Design Standards, Section 3.01). ® This condition has been met. Attached is a letter from the Kalispell Public Works Department dated April 22, 2005 that approves the water and sewer construction plans. Condition No. 3 That an easement shall be obtained and recorded from the property owner to the west granting access across the property for utility extension purposes. (Kalispell Subdivision Regulations, Section 3.08 (A)). ® This condition has been adequately addressed. The original easement was submitted to this office. Condition No. 4 The existing approaches onto North Meridian Road be maintained until such time as there is a redevelopment of the property wherein a revised access plan may be considered. ® This condition has been met. This condition has been addressed in condition # 13 of the Covenants filed with this subdivision. These two lots should be required to consolidate their approaches onto Meridian Road as they redevelop. Condition No. 5 The following requirements shall be met per the Kalispell Fire Department: Kalispell Subdivision Regulations, Section 3.20). a. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with Uniform Fire Code (1997) Appendix III -A. b. Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. Additional design information shall be submitted for approval by this department. c. Fire Department access shall be provided in accordance with Uniform Fire Code (1997) Article 9. d. Secondary emergency access shall be addressed during project phasing as required by this department. e. Emergency vehicle access to the existing 3 structures is indicated via an existing wooden bridge. More information is required related to the adequacy of the bridge structure to support fire apparatus. f. Due to project phasing it should be noted that hazardous weed abatement shall be provided in accordance with City of Kalispell Ordinance 10-8. ® This condition has been met. Attached is a letter from the Acting Deputy Fire Marshall dated March 26, 2005 that approves the plans. Condition No. 6 That a letter be obtained from the Kalispell Parks and Recreation Director approving a landscape plan for the placement of trees and landscaping materials within the five foot landscape boulevard developed between the curb and the sidewalk. (Kalispell Subdivision Regulations, Section 3.11). ® This condition has been met. Attached is a letter from the Kalispell Parks 8, Recreation Department dated September 13, 2005 that approves the landscaping plans. The installation of the trees and landscaping is included in the SIA. Condition No. 7 That cash in lieu of parkland shall be accepted in the amount of $7,880 to meet the parkland dedication requirement based on 11 percent of the area in lots or .47 acres at a value of $17,000 per acre. An attempt shall be made to coordinate a plan reviewed and approved by the City of Kalispell Parks and Recreation Department and School District 5 that provides improvements to the ball field that lies directly to the west of this property. (Kalispell Subdivision Regulations, Section 3.19). ® This condition has been met. A check in the amount of $7,880 has been submitted with this application. Condition No. 8 The roads within the subdivision shall be named and signed in accordance with the policies of the Kalispell Public Works Department and the Uniform Traffic Control Devices Manual and be subject to review and approval of the Kalispell Fire Department. (Kalispell Subdivision Regulations, Section 3.09). ® This condition has been met. Street signs are included in the SIA. Condition No. 9 The developer shall provide a letter from the U.S. Postal Service approving the plan for mail service. (Kalispell Subdivision Regulations, Section 3.22). ® This condition has been met. Attached is a letter from the U.S. Postal Service dated May 20, 2005 that approves the plans. Condition No. 10 Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude unnecessarily onto adjoining properties. (Kalispell Subdivision Regulations Section 3.09(L)). • This condition has been met. Street lighting is included in the SIA. Condition No. 11 All utilities shall be installed underground. (Kalispell Subdivision Regulations, Section 3.17). ® This condition has been met. All utilities are designed and constructed underground. Condition No. 12 That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. ® This condition has been met. The engineer has certified that over 2/3 of the necessary infrastructure has been completed. Condition No. 13 All areas disturbed during development of the subdivision shall be re -vegetated with a weed -free mix immediately after development. • This condition has been met. Seeding of disturbed areas is included in the SIA. Condition No. 14 Lot lines shall be shifted east a minimum of 10 feet to accommodate the required 15 foot side corner setback or else replaced with single family lots. ® This condition has been met. The lines have been shifted to the east. Condition No. 15 A note shall be placed on the face of the plat waiving protest to the creation of a special improvement district for the future upgrade of Northwest Lane to City standards. ® This condition has been met. The note appears on the plat. Condition No. 16 A note shall be placed on the face of the plat designating the lots within the subdivision as being intended for single family dwellings other than those identified on the preliminary plat as being intended for two unit townhouse development. ® This condition has been met. The note appears on the plat. Condition No. 17 That preliminary plat approval shall be valid for a period of three years from the date of approval. (Kalispell Subdivision Regulations, Section 2.04). • This condition has been met. The preliminary plat was granted August 2, 2004. The final plat is in compliance with the preliminary plat which was submitted and approved. This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. This subdivision complies with the Kalispell Zoning Ordinance, the R-2 zoning, and the conditional use permit granted earlier this year. z1*6100 I jj All of the conditions of preliminary plat approval have been adequately addressed. The staff recommends that the Kalispell City Council approve the final plat for this subdivision. Please note that the Subdivision Improvements Agreement should be accepted along with the final plat approval. THIESEN a.k.a. JEFF THIESEN & KAREN J. THIESEN, a.k.a. KAREN THIESEN located at 789 Fifth Ave. WN, Kalispell, MT 59901, Party of the Second Part and hereinafter referred to as DEVELOPER. WITNESSETH: THAT WHEREAS, the Developer is the owner and developer of a new subdivision known as SINOPAH SUBDIVISION located at 1270 & 1288 N. Meridian Rd. and 121 & 125 Northwest Ln. Kalispell, Montana and, WHEREAS, the City has conditioned it's approval of the final plat of SINOPAH SUBDIVISION, upon the conditions as set forth in the Preliminary Plat of the Subdivision being completed and all improvements, as cited in "Exhibit A" have not been completed at this time, and the Developer wishes to bond for the completion of those improvements set forth in "Exhibit A"; and WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide a financial security of 125% of the estimated total cost of construction of said improvements as evidenced by an estimate prepared by a licensed public engineer included herewith as "Exhibit B"; and WHEREAS, the estimated total cost of construction of said improvements is the sum of $77,312.00. NOW THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows: 1. The Developer shall deposit as collateral with the City a Letter of Credit, or other acceptable collateral as determined by the City Council, in the amount of $96,640.00. Said Letter of Credit or other collateral shall have an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following: a. That the creditor guarantees funds in the sum of $96,640.00 the estimated cost of completing the required improvements in SINOPAH SUBDIVISION. b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay to the City immediately, and without further action, such funds as are necessary to finance the completion of those improvements up to the limited of credit stated in the letter; 2. That said required improvements shall be fully completed by November 1, 2005. 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: a. All required improvements are complete; b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City; c. That the Developer knows of no defects in those improvements; d. That these improvements are free and clear of any encumbrances or liens; e. That a schedule of actual construction costs has been filed with the City; and, f. All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of final plans, profiles, grades and specifications of said improvements, with the certification of the registered professional engineer responsible for their preparation that all required improvements have been installed in conformance with said specifications. IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS, TO -WIT: That the Developer shall provide for inspection of all required improvements by a registered professional engineer before the Developer shall be released from the Subdivision Improvement Agreement. That if the City determines that any improvements are not constructed in compliance with the specifications, it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure such compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the specifications, or within the required time limits, it may withdraw the collateral and employ such funds as may be necessary to construct the improvement or improvements in accordance with the specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate.
