We have reviewed the construction of improvements for the first phase of this
subdivision and we have found that some items were not installed or completed in
accordance with the plans, the City's standards and/or our letter of November 25,
1987. These items are listed as follows.
1. The developer is required to waive the right to protest annexation into the
City of Kalispell, to waive the right to protest creation of an SID, and to
provide a Notice of Intent to Withdraw from the Evergreen Fire District.
Written compliance with the requirement shall be determined by the City Attorney.
We have no evidence that the required waivers have been submitted and that the
City Attorney's written determination has been obtained.
2. The City did not perform inspections of construction of utilities on a daily
basis. We defer to the design engineer for a determination of the acceptablility
of construction. A definite statement stamped by the engineer that construction
strictly conforms to the plans must be provided. Stamped as-builts detailing
all utility construction must also be provided by the engineer.
3. The surface of the storm water detention pond must be seeded, mulched, fertilized,
etc.
4. The curb and gutter section, as installed, does not comply with the detail shown
on the plans, nor does it meet City standards.
5. The cul-de-sac at the west end of River View Drive has not been paved. The
plans show that this area will be paved.
6. The water line in the same cul-de-sac has apparently been extended further
eastwards than shown on the plans and at least two valves have been installed.
The boxes atop these valves are currently about 3 inches above grade and could
be damaged by vehicular traffic.

7. Two fire hydrants, those at Sta 20 + 44 and at Sta 1 + 77 Buffalo Hill Circle,
have steamer nozzles pointing away from the street. The nozzles must point
to the street.
The items must be satisfactorily addressed before we can offer any approval to FRDO.
