Dear Chris:
The Kalispell City -County Planning Board met on October 12, 1999, and held a public hearing to
consider a request by the Salvation Army for a conditional use permit for the construction and
operation of a 12 unit senior and disable persons' apartment complex. The property is located on the
side of the existing Salvation Army parking lot in the north part of Kalispell near the hospital, on the
east side of Bountiful Drive.
Narda Wilson of the Flathead Regional Development Office presented staff KCU-99-8 evaluating the
conditional use permit proposal. The staff recommended that the board forward a recommendation
to approve the application subject to the conditions contained in the staff report.
At the public hearing Lt.. Jones of the Salvation Army spoke in favor of the proposal stating that they
would manage the complex and that this proposal would further their goal to "meet human needs
without discrimination." Michael Ober spoke against the petition stating that the proposal would
reduce his property's value and increase traffic, noise and congestion.
The board discussed the request and public testimony. A motion was made to adopt staff report
KCU-99-8 as findings of fact and recommend approval of the conditional use permit subject to the
conditions listed in Attachment A. The motion passed unanimously.
This matter is being forwarded to the Kalispell City Council for consideration at their November 1,

The Kalispell City -County Planning Board is recommending the following
conditions to the Kalispell City Council for the above referenced conditional use
permit. A public hearing was held on this matter at the October 12, 1999
planning board meeting.
1. That the proposal will be developed in substantial conformance with the
approved site plan and the Kalispell Zoning Ordinance with regard to
occupancy, landscaping, fencing, signage, parking and other applicable
elements.
2. That building construction shall be of brick materials which are similar
and architecturally compatible with the surrounding buildings.
3. That the Kalispell Fire Department shall review and approve the
proposal for compliance with the Uniform Fire Code.
4. That a deed restriction be recorded on the property that limits the use of
the residences for senior and disabled persons unless adequate parking
can be provided as required under the Kalispell Zoning Ordinance for
multi -family dwellings.
S. That construction of the approved activity must begin within 18 months
from the date of authorization or that a continuous good faith effort is
being made to do so.

the Kalispell City Council that the requested zone change from
RA-1 to R-4 be granted. On a roll call vote all members voted
Aye. The motion to recommend that the zone change be granted
passed unanimously.
SALVATION ARMY A request by the Salvation Army for a conditional use permit to
CONDITIONAL USE allow a multi -family development in an H-1 to construct a 12-
PERMIT unit apartment complex for senior and disabled persons in the
north part of the Salvation Army parking lot.
STAFF REPORT Narda Wilson gave a presentation on staff report KCU-99-8 in
which staff recommends that the conditional use permit be
granted subject to five conditions. She stated that the Salvation
Army wishes to convert the north lot to modest apartments for
seniors and the disabled. She added that this parking
displacement does not impact the required parking under
zoning. The parking requirement for multi -family for seniors
and the disabled is one space per five dwellings, and this
proposal includes one space per dwelling, which is far more
adequate. This would have a relatively minimal impact on the
area and services. This fits in well with the mix in the area.
Johnson asked about fire department requirements and Wilson
stated that the condition, as written, leaves this to the Fire
Department and would be worked out at site review.
Stevens asked about condition four, deed restrictions, and
Wilson stated that this would be flexible enough to allow for
future use by other than seniors if allowable parking were met.
PUBLIC HEARING The public hearing was opened to those in favor of the petition.
PROPONENTS Lt. Monte Jones, 216 Glenwood Drive, spoke in favor of the
petition stating that the Salvation Army's goal is to meet human
needs without discrimination. They want to meet that need with
this low-income apartment complex. During this process they
have met with the neighbors and have addressed a lot of the
concerns, the Salvation Army's idea is to meet their demands
where possible. This unused parking lot is not good
stewardship and an apartment complex to meet human needs is
good stewardship.
OPPOSITION Michael Ober, 54 Buffalo Hill Drive, spoke against the proposal
based on the fact that this will reduce his property values, and
increase traffic, noise and congestion.
Bob Windauer, 75 Claremont Street, questioned the petition
asking about landscaping and plans for Bountiful Drive, and the
problems with vagrants etc. He asked how that end of the
property will be managed.

No one else wished to speak and the public hearing was closed.
BOARD DISCUSSION Johnson asked Jones to answer Windauer's questions.
Jones stated that the property will be managed by the Salvation
Army, there is always someone there and it makes sense for
them to manage the complex, the landscaping at the corner and
within the complex in order to make it look like it has been there
for 20 years will insure it's compatibility with the surrounding
neighborhood. Jones explained that the proposal is being
funded with the agreement that this will be kept by the
Salvation Army for 50 years and therefore it would not change
from what is proposed.
Wilson stated that the city would require an extension of
Bountiful Drive at such time as the further undeveloped area
becomes developed. The Salvation Army side of the street has
been upgraded to city standard, so as far as upgrading
Bountiful Drive the Salvation Army is the closest to compliance
with city standards.
Rice asked about the deed restrictions and Wilson explained
that it would have to be approved by the city council.
Heinecke stated that he grew up in the neighborhood and he
has mixed feelings about this, as there is no public
transportation there. Jones answered that Eagle transit comes
to the Salvation Army twice a day. He added that he doesn't
know if it is a part of their regular route, and part of the
Salvation Army development would be to offer rides in their 15-
passenger van twice per week.
Stevens commented that the board has spent a lot of time
dealing with the issue of affordable housing and this is just such
an issue. He is opposed to any government regulation that
would restrict affordable housing and for that reason he is in
favor of this proposal. This proposal does not have near the
opposition as most affordable housing issues. He does not see
this impacting anyone significantly. His understanding is that
the permitted uses in this zoning district could have far more
potential impacts than this project.
MOTION Brenneman moved and Rice seconded to adopt staff report KCU-
99-8 as findings of fact and, based on these findings,
recommend to the Kalispell City Council that the conditional use
permit be granted subject to the five conditions as specified in
the report. On a roll call vote all members voted Aye. The
motion to recommend that the conditional use permit be granted
passed unanimously.

A report to the Kalispell City -County Planning Board and Kalispell City Council regarding
a request for a conditional use permit to allow the construction of a 12 unit apartment
complex in a H-1 zoning district. A public hearing on this matter has been scheduled
before the planning board for October 12, 1999, beginning at 7:00 PM, in the Kalispell City
Council Chambers. The planning board will forward a recommendation to the City
Council for final action.
BACKGROUND D INFORMATION

B. Size and Location: The property proposed for the apartment complex is located on
the side of the existing Salvation Army parking lot. The Salvation Army is located in
the north part of Kalispell near the hospital, on the east side of Bountiful Drive.
The development site will is a portion of this property located at 110 Bountiful Drive
which can be described as Lots 1 and 2, Highland Park First Addition located in
Section 6, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
C. Nature of Request: The applicants are requesting a conditional use permit to allow
the construction of a 12 unit apartment complex for senior and disabled people.
The complex would consist of 12, approximately 500 square foot units, that would
be located in the northern portion of the property owned by the Salvation Army.
Currently, this portion of the site is devoted to a parking lot which would be
removed. As indicated in the application and on the site plan, there will be a five
unit complex, a tri Alex and two duplexes. The complex would be rented on a
monthly basis and would not provide interim, transient or shelter housing which is
provided through the Samaritan House.
D. Existing Land Use and Zoning: Currently there is a church building where the
Salvation Army operates their church and other community services that they
provide to those in need. This facility does not provide overnight accommodations,
nor would overnight accommodations be provided under this proposal. This
property is in an H-1, Health Care, zoning district which lists multi -family housing
as a conditionally permitted use.
E. Surrounding Boning and Land Uses Zoning: There is a mix of uses in the
immediate area that have been developed in conjunction with the hospital. They he
a short distance to the north and include office uses, long term residential care for
the elderly and single family housing. Highway 93 is to the west approximately one
quarter mile or less.
North: Undeveloped property and the Brenden House,
H-1, a Health Care zoning district
South: Immanuel Lutheran Home and single family residential;
H-1 zoning
East: Single family residences; H-1 zoning
West: Medical offices; H-1 zoning
F. Master Plan Designation: The Kalispell City County Master Plan Map designates
this area as Medical / Professional which anticipates a variety of medical, dental,
office and residential type uses in the area. The proposed project is in compliance
with the land use designation of the master plan map and furthers the goals of the
master plan by providing for a diversity of housing needs in the community.

H. Evaluation of the Request:
Site Suitability:
a. Adequate Useable Space: An approximately one half acre area of the
approximately two acre site is proposed to be used for the apartments. The
remaining area of the property is where the Salvation Army currently has its
main building which serves as the Salvation Army Church and
administrative offices. This building, parking and landscape area occupies
the majority of the site. Displacement of the existing parking area that will
house the new apartments will not effect the needed parking for the church
or administration offices. The parking requirements for the church are based
upon a ratio of one parking place per five seats. With a seating capacity of
150, 30 parking spaces would be required. Approximately 51 parking spaces
will remain after the ones on the north side of the property have been
developed with housing, more than adequate parking for the church use.
b. Adequate Access: Access to the property is off of Bountiful Drive, a paved
City Street, although there is no curb and gutter along the north or west
sides of the street. An existing 26 foot wide driveway will be used as the
main entrance to the apartment complex which comes directly off of
Bountiful Drive. The main entrance to the Church is also off of Bountiful
Drive, but further to the south and is generally from the parking lot located
to the west and the sidewalk along Bountiful Drive to the south of this
project. Access to the site is generally good, however, the fire access and
turnaround area toward the east portion of the site will have to be more
clearly delineated and maintained. One of the existing outbuildings on the
east portion of the site appears to be set in a temporary manner and may
have to be removed or relocated.
C. Environmental Constraints: There are no obvious environmental constraints
apparent on the property which is generally level. Some excess paving may
have to be removed to provide for on -site retention of stormwater along the
perimeter of the property.
2. Appropriate Design:
a. Parking Scheme: One space per five dwelling is required under the Kalispell
Zoning Ordinance for housing complexes that are for seniors and / or
disabled people. As proposed, there is one parking space for each dwelling.
The parking arrangement as proposed may not be the most conducive to
immediate access to the individual dwelling units, but appears to be
adequate to meet the parking requirements of the zoning regulations.
b. Traffic Circulation: Traffic will enter and exit the site from a single
established driveway along the northwest section of Bountiful Drive. Two
way traffic can be accommodated within the parking lot. A defacto
turnaround area can be used in the parking lot to the rear of the church. A
more defined turnaround area may need to be established for the fire
department's needs and to provide adequate circulation within the parking
lot itself.
C. Open Space: No specific open space requirements are required under the
zoning other than the required setbacks which have been adequately met as
indicated on the site plan. Additionally, there is a lawn area around the
church.
d. Fencing/Screening/ Landscaping: Nice landscaping is in place around the
church building and along the northern boundary of the property. Large
trees provide good buffering and landscaping for the site along the northern
boundary and will be retained. Additional lawn areas will be established
around the perimeter of the site which may require the removal of some
asphalt and / or concrete. Fencing and some landscaping will be established
along the eastern boundary of the property where it abuts a residential
neighborhood to provide some buffering between the two uses.
e. Signage: No signage has been indicated on the site plan or proposed in the
application, however any signage will need a permit from the zoning
administrator and will comply with Kalispell zoning regulations.

3. Availability of Public Services/Facilities:
a. Schools: This site is within the boundaries of School District #5, however,
generally speaking, this proposal should have minimal impact on the school
district.
b. Parks and Recreation: There is no formal park in close proximity to the site
and very few sidewalks or other adequate pedestrian system. Some limited
walking areas are provided around the property itself.
C. Police: No substantial impacts to the police can be anticipated as a result of
the proposed residential facility.
d. Fire Protection: Fire protection will be provided by the Kalispell Fire
Department. A fire hydrant may be required to be extended to the site in
order to meet fire code requirements. Additionally, adequate access and a
fire truck turnaround area will need to be identified prior to the issuance of a
building permit.
C. Water: City water will be extended to service the new buildings which may
require a main be extended to service the site and to supply water to a
hydrant. The plans and specifications for the water systems will need to be
reviewed and approved by the Kalispell Public Works Department.
f. Sewer: Sewer service will be provided by the City of Kalispell. No significant
impacts on City sewer services can be anticipated as a result of the proposed
use, however, additional sewer services may need to be extended to the site
to service the new development. Plans and specifications will need to be
reviewed and approved by the Kalispell Public Works Department if new
facilities are required.
g. Solid Waste: Solid waste pick-up will be provided by the City, and no
significant increased impacts can be anticipated as a result of the proposed
use.
h. Roads: Minimal to moderate traffic generation can be anticipated as a result
of this use. Access will generally be onto Bountiful Drive and then onto
Highway 93. Although congested at times, streets in the area are generally
well maintained and in good condition. Roads in the area are adequate to
accommodate the proposed use.
i. Immediate Neighborhood Impact: The general character of this area is a mix
of medical, office and residential uses. Impacts to the neighborhood will be
insignificant. The projects appears to be in an area well suited for this type
of use because of its close proximity to medical services and the services
offered by the Salvation Army. Additionally, there are other alternative type
residential uses in the area with Immanuel Lutheran Home and Buffalo
Terrace. This complex provides a good element to create a mixed residential
use area

A notice of public hearing was mailed to property owners within 150 feet of the subject
property approximately 15 days prior to the hearing. At the writing of the staff report, no
comments were received by the Flathead Regional Development Office from the public.
SUMMARY OF FINDINGS
1. The size and location of the site is adequate for the proposed use which has a mix of
single-family and multi -family uses in the area.
2. The site design is in compliance with the zoning and design standards of the City.
3. Existing public services and facilities are available and adequate to serve the
proposed use.
4. There will be minimal impact to the neighborhood with regard to the use of the site
for the proposed use and will not adversely effect the quality of the neighborhood.
RECOMMENDATION
It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU-
99-8 as findings of fact and recommend to the Kalispell City Council that the conditional
use permit be granted subject to the following conditions:
1. That the proposal will be developed in substantial conformance with the approved
site plan and the Kalispell Zoning Ordinance with regard to occupancy,
landscaping, fencing, signage, parking and other applicable elements.
2. That building construction shall be of brick materials which are similar and
architecturally compatible with the surroundings buildings.

Preliminary Plat Approval for Buffalo Commons Phases 3, 4 and 5 - 27 Lot Subdivision
The regular meeting of the Kalispell City -County Planning Board and Zoning Commission is
scheduled for Tuesday, October 12, 1999, beginning at 7:00 PM in the Kalispell City Council
Chambers, Kalispell City Hall, 312 First Avenue East, Kalispell. During the regularly scheduled
meeting of the planning board, the board will hold public hearings and take public comments on
the following agenda items. The board will make recommendations to the Kalispell City Council
who will take final action:
1. A request by William and Rebecca Sneed for a zone change from RA-1, Low Density
Residential Apartment, to R-4, Two Family Residential, on approximately 1.64 acres located
on the southwest corner of Eight Street West and 12th Avenue West in Kalispell. The property
can also be described as Assessor's Tract 3, Government Lot 3 located in Section 18,
Township 28 North, Range 21 West, P.M.M., Flathead County, Montana and as further
described in attached Exhibit A.
2. A request by the Salvation Army for a conditional use permit to allow a multi -family
development in an H-1, Health Care, zoning district. The applicants propose to construct a 12
unit apartment complex for senior and disabled persons which would consist of four units;
two duplex units, one tri-plex unit and one five plex unit. These would be constructed in the
north part of the Salvation Army property, which is now part of their parking lot. This
property is located at 110 Bountiful Drive and can be further described as Lots 1 and 2,
Highland Park, 1st Addition located in Section 6, Township 28 North, Range 21 West, P.M.M.,
Flathead County, Montana.
3. A request by Northwest Health Care for preliminary plat approval of a 27 lot subdivision on
approximately 36 acres which is known as Buffalo Commons, Phases 3, 4 and 5. This is a
commercial subdivision that is zoned as part of the Buffalo C:-)mmons Planned Unit
Development located east of Highway 93 and north of Sunnyview Lane in Kalispell. Lots
range in size from approximately one half acre to approximately four acres. This property can
be described as Assessor's Tract SABM and portions of Assessor's Tracts 7ET+ and 7ETH+
located in Section 6, and Assessor's Tract 2DCE located in Section 13, Township 28 North,
Range 21 West, P.M.M., Flathead County, Montana.

The Salvation Army has been active in Kalispell since 1896 doing two things: Preaching
the good news about Jesus Christ, and meeting human needs in His name without
discrimination. In the past that has meant clothing vouchers to our thrift stores, a
congregate meal program feeding over 50 people a day, a summer lunch program where
hungry children receive nutritious meals, a free health clinic where there are literally people
walking around Kalispell today who would have died a year ago had we not been there,
and many other services offered on a case by case basis. When God provided our new
building up on the hill, we committed to using every square foot of this property to meeting
the needs of the less fortunate of Kalispell or proclaiming the Gospel.
After a year of praying and doing our homework, we, in cooperation with some of the
good citizens of Kalispell have come up with the proposal you see before you. Our hope is
to provide an affordable place to live for low income seniors and the disabled that is
pleasant, quiet, safe, gives access to the services we already provide, as well as easy access
to medical facilities.
Please imagine for example a senior whose spouse has to be placed in Brendon House or
the Lutheran Home. He can live at our complex, get meals for free, and be close to the one
he loves. Another example would be the little lady who is on dialysis and is paying a taxi to
bring her up for treatment twice a week. She can live in our apartment, get her meals for
free, and have a volunteer wheel her over to dialysis. We can't imagine a better use for the
parking lot that is, for now, sitting fallow and collecting debris.
It is our prayer that this housing will meet the basic needs of food, shelter, and medical
attention for low income seniors, as well as being a lovely addition to this beautiful
neighborhood. May God bless you as you consider this worthwhile project.
