BACKGROUND: This is a request for final plat approval of Ranchview Subdivision,
a ten lot residential subdivision located on the west side of Grandview Drive just
south of Commons Way in the north part of Kalispell. The current city limits front
along the eastern boundary of this property. The subdivision contains approximately
2.86 acres. Zoning for the subdivision is RA-1, Low Density Residential Apartment,
which has a minimum lot size requirement of 6,000 square feet plus 3,000 square feet
for each lot beyond a duplex. All of the lots within the subdivision are in excess of
8,000 square feet, some which would accommodate multi -family dwellings through
the conditional use permit process. All of the lots would be accessed by way of a new
internal roadway that ends in a cul-de-sac. The new roadway will have access onto
Grandview Drive and will be dedicated to the City of Kalispell as part of the final plat
approval process. All of the subdivision improvements have been installed and
constructed to City standards. Cash -in -lieu of parkland dedication has been approved
and a check in the amount of $6,279. has been submitted with the final plat. An
approximately two plus acre remainder tract will be created as a result of this
subdivision where the Peters currently have their home.
The preliminary plat for this subdivision was approved by the city council on June 21,
1999 subject to 14 conditions of approval. All of the conditions of approval have been
met and certified by a licensed engineer and the Kalispell Public Works Department.
RECOMMENDATION: A motion to approve the final plat for Ranchview Subdivision
would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

Re: Final Plat for Ranchview Subdivision
Dear Chris:
Our office has received an application from Thomas, Dean and Hoskins on behalf of
Douglas C. Peters for final plat approval of Ranchview Subdivision, a ten lot residential
subdivision on approximately 2.826 acres. All of the lots are over 8,000 square feet.
The property is in an RA-1, Low Density Residential Apartment District, which has a
minimum lot size requirement of 6,000 square feet for duplexes plus an additional
3,000 square feet for each unit beyond a duplex. There are several lots within the
proposed subdivision which would accommodate duplex and multi -family dwellings.
The property is located on the west side of Grandview Drive and just south of Commons
Way in the north part of Kalispell. The current city limit boundaries front along the
eastern boundary of this property.
Preliminary plat approval was granted by the Kalispell City Council for this
subdivision on June 21, 1999 subject to 14 conditions. The following is a list of the
conditions of approval and a discussion of how they have been met.
Condition No 1. Development of the subdivision shall be platted in substantial
compliance with the approved preliminary plat which govern the location of lots and
roadways within the subdivision.
This condition has been met. The final plat is in substantial compliance with the
approved preliminary plat.
Condition No 2. That the roadways within the subdivision shall be constructed in
accordance with the adopted Design and Construction Standards for the City of
Kalispell for local roads and include the pavement, curbs, gutters, storm drainage,
sidewalks on both sides of the street, a minimum five foot landscape boulevard with
street trees placed at 40 foot intervals which are a minimum one and a half inch
circumference at planting. A letter from an engineer licensed in the state of Montana
certifying that the improvements have been installed according to the required
specifications shall be submitted at the time of final plat approval and a letter from the

Kalispell Public Works Department shall be provided stating that the improved have
been inspected and comply with the City standards.
® This condition has been met. Thomas, Dean and Hoskins has certified the
improvements and a letter from the Kalispell Public Works Department has verified
their compliance with City standards.
Condition No 3. A storm water drainage plan which has been designed by an
engineer licensed in the state of Montana shall be prepared which compiles with the
City's Design and Construction Standards and shall be reviewed and approved by the
Kalispell Public Works Department.
® This condition has been met. A letter from Thomas, Dean and Hoskins has
certified the improvements, including the stormwater management, and a letter
from Kalispell Public Works Department has verified those improvements.
Condition No 4. That a Certificate of Subdivision Approval be obtained from the
Department of Environmental Quality and written approval by the Kalispell Public
Works Department approving the water and sewage facilities for the subdivision.
o This condition has been met. A Certificate of Subdivision Plat Approval dated
12/ 1'7/99 from MDEQ has been submitted with the final plat.
Condition No 5. That a driveway permit for the proposed access onto Grandview
Drive shall be obtained from the Kalispell Public Works Department and any conditions
or improvements associated with the permits be completed prior to final plat submittal.
® This condition has been adequately addressed. The Kalispell Public Works
Department has approved all of the utilities and infrastructure for the subdivision,
including the road approach.
Condition No 6. The roads within the subdivision shall be named and signed in
accordance with the policies of the Kalispell Public Works Department and the Uniform
Traffic Control Devices Manual.
® This condition has been met. The street sign has been installed and approved by
the Kalispell Public Works Department.
Condition No 7. The developer shall install a central mailbox location approved by
the U.S. Postal Service and shall be indicated on the final plat.
® This condition has been met. A letter from the USPS has been submitted with the
final plat and the central mailbox location has been indicated on the final plat.
Condition No 8. That a 20 foot wide buffer area comprised of coniferous trees not
less than four feet in height shall be provided along the eastern property boundary

between the subdivision and Grandview Drive to provide screening, buffering and dust
abatement.
® This condition has been met. The trees have been installed and have been
inspected and approved by the Kalispell Parks and Recreation Department and the
Kalispell Public Works Department.
Condition No 9. Street lighting shall be located within the subdivision and shall be
shielded so that it does not intrude unnecessarily onto adjoining properties.
® This condition has been met. Necessary street lighting has been installed.
Condition No 10. That cash -in -lieu of parkland dedication be required in the amount
of one ninth of the area devoted to lots or 0.25 acres in the amount of $6,279. The
developer may provide information to alter the amount of required cash -in -lieu of
parkland based upon either the amount paid for the property within the last six months
or an independent appraisal.
® This condition has been met. A cash in lieu of parkland check in the amount of
$6,279. has been submitted with the final plat.
Condition No 11. All utilities shall be installed underground.
® This condition has been met. All of the utilities have been installed underground,
certified by the engineer and inspected by Kalispell Public Works.
Condition No 12. That a letter from the Kalispell Fire Department approving the
access and number and placement of fire hydrants within the subdivision shall be
submitted with the final plat.
® This condition has been met. A letter from the Kalispell Fire Marshal has been
submitted with the final plat approving the location and placement of they
hydrants.
Condition No 13. All areas disturbed during development of the subdivision shall be
re -vegetated with a weed -free mix immediately after development.
® This condition has been met. The engineer has certified that the disturbed areas
have been revegetated with a weed -free seed mix.
Condition No 14. That preliminary approval shall be valid for a period of three years
from the date of approval.
® This condition has been met. The final plat has been submitted prior to the
expiration of the preliminary plat approval.

The final plat is in substantial compliance with the preliminary plat which was
submitted and approved.
This subdivision plat has been found to be in compliance with the State and City
Subdivision Regulations.
This subdivision has been found to be in compliance with the Kalispell Zoning
Ordinance and the RA-1 zoning designation which governs the dimensional
requirements of the lots within the subdivision.

All of the conditions of preliminary plat approval have been adequately met. The
Flathead Regional Development Office recommends that the Kalispell City Council
approve the final plat for Ranchview Subdivision. Please schedule this matter for the
regular city council meeting of January 22, 2001.

The plat must be signed by all owners of record, the surveyor and examining land surveyor.
Attach a letter, which lists each condition of preliminary plat approval, and individually state how each
condition has specifically been met. In cases where documentation is required, such as an engineer's
certification, State Department of Health certification, etc., original letters shall be submitted. Blanket
statements stating, for example, "all improvements are in place" are not acceptable.
A complete final plat application must be submitted no less than 30 days prior to expiration date of the
preliminary plat.
When all application materials are submitted to the F.R.D.O. and the staff finds the application is
complete, the staff will submit a report to the governing body. The governing body must act within 30
days of receipt of the revised preliminary plat application and staff report. Incomplete submittals will
not be accepted and will not be forwarded to the governing body for approval. Changes to the
approved preliminary plat may necessitate reconsideration by the Planning Board.

THIS IS TO CERTIFY THAT the plans and supplemental information relating to the
subdivision known as Ranchview Subdivision
A tract of land located in NW 1/4 Section 6 Township 28 North Range 21 West,
Principal Meridian Montana, Flathead County, Montana
consisting of 10 lots have been reviewed by personnel of the Permitting and Compliance
Division, and,
THAT the documents and data required by ARM Title 17 Chapter 36 have been submitted and
found to be in compliance therewith, and,
THAT the approval of the Plat is made with the understanding that the following conditions shall
be met:
THAT the lot sizes as indicated on the Plat to be fled with the county clerk and recorder will not
be further altered without approval, and,
THAT each lot shall be used for one duplex (two-family residence), and,
THAT the public water supply and public sewage disposal shall be provided by the City of
Kalispell, and,
THAT the public water supply and public sewage systems shall be constructed in accordance
with the approved plans and specifications, consisting of approximately 240 LF of 12 inch C900
PVC CL 150 water main, 400 LF of 8 inch C900 PVC CL 150 water main, one hydrant, three
valves, and appurtenances. The project also consists of approximately 400 LF of 8 inch SDR 35
PVC sewer main, three manholes and appurtenances. Approval is based on the plan sheets 1 and
3 of 3 dated received October 18, 1999 and plan sheet 2 of 3 dated received December 14, 1999.
The plans were received under the seal of Jeff H. Larsen PE #9250ES, and,
THAT the storm drainage system shall be constructed in accordance with the approved plans and
specifications, and shall consist of four catch basins, located as shown on the approved plans,
received under the seal of Jeff H. Larsen PE #9250ES, and,
THAT construction will be completed within three years of the approval date. If more than three
years elapse before completing construction, plans and specifications must be resubmitted and
approved before construction begins. This three-year expiration period does not extend any
compliance schedule requirements associated with a Department enforcement action against a
public water or sewage system, and,

THAT within 90 days after construction is completed upon a public water system, wastewater
system, or storm drainage system, or upon an extension of or addition to such a system, the
professional engineer shall certify to the Department that the construction, alteration or extension
was completed in accordance with the plans and specifications approved by the Department, and,
THAT project certification shall be accompanied by a complete set of "as -built" drawings
bearing the signature and seal of the professional engineer, and,
THAT plans and specifications for any proposed sewage treatment systems will be reviewed and
approved by the county health department and will comply with local regulations and ARM Title
17 Chapter 36 subchapters 3 and 9 before construction is started, and,
THAT instruments of transfer for this property shall contain reference to these conditions, and,
THAT the developer and/or owner of record shall provide each purchaser of property with a copy
of the Plat, and a copy of this document, and,
THAT departure from any criteria set forth in the approved plans and specifications and Title 17,
Chapter 36, Sub -Chapters 1, 3, and 6 ARM when erecting a structure and appurtenant facilities in
said subdivision without Department approval, is grounds for injunction by the Department of
Environmental Quality.
Pursuant to Section 76-4-122 (2)(a), MCA, a person must obtain the approval of both the State
under Title 76, Chapter 4, MCA, and local board of health under section 50-2-116(1)(i), before
filing a subdivision plat with the county clerk and recorder.
YOU ARE REQUESTED to record this certificate by attaching it to the Plat filed in your office
as required by law.
