The proposed land exchange is a critical component to allow the further development of the property as detailed in the PUD agreement. In this regard: 1. Section 2.01 (A) of the PUD agreement (attached to the EA as appendix D) specifies that development will conform to the provisions of the PUD agreement and the documents and drawings annexed to the agreement. In this connection, Figure 4 of the EA is not in conformance with the PUD agreement. It is not the approved layout for development. The approved layout, drawing C 1.2 attached to the PUD agreement, details a significantly higher density development. 2. Following on 1, above, if the parcel(s) are developed as outlined in the PUD then the anticipated air and water pollution impacts, and drainage impacts will actually be greater than implied by the incorrect information presented on Figure 4. The amount of this difference may be significant. 3. The document incorrectly states that there is no timetable for development. Section 2.01 (F) 1) specifies that all the infrastructure improvements specified in the PUD agreement shall be compete by July 1, 2006. Further, Section 2.01 (C) specifies that the concrete batch plant shall be operated during the site development construction period but in no case for a term greater than five years after which it shall be removed.
