Recommended Bonding for Mountain View Plaza PUD

As you know, the Kalispell City -County Planning Board held a public hearing at their
regular meeting of January 9, 2001 to consider the Mountain View Plaza PUD. They
are forwarding a recommendation for approval for the project subject to 31 conditions.
The transmittal from the planning board is being forwarded to you along with this
memo. The recommendation from the planning board in Condition 29 states "That
the phasing and timing of the development shall occur as proposed. Bonding for the
proposed i ueture and public water and sewer or other
acceptable means of insuring that the improvements will be completed as proposed
shall be provided by the developer on each phase as the project develops."
You have asked me to try to identify what items would be expected to be included in
the bonding. As we had briefly discussed, those items would include the following: (1)
necessary water and sewer services to the development pads, (2) grading for the entire
site, (3) revegetation and a plan for maintenance of the site to keep it in an weed -free,
dust -free, attractive state until development, (4) the cost of removing the MDOT
maintenance facility and equipment, (5) the cost of removing the NuPack batch plant,
equipment and offices. It would be prudent to talk with Jim Hansz regarding other
items that should be included such as engineering for the drainage, utilities, etc.
What would not be included in the bonding would be (1) service lines to the
individual buildings, (2) final landscaping in the parking lots and around the
buildings, (3) parking lot paving, (4) access roads and sidewalks within the
development site, (5) lighting, (6) signs, or (6) buildings.
There are one or two remaining issues that apparently need to be fully addressed
prior to the scheduling of a work session with the city council (1) the transfer of title
of the MDOT property to Pack and Company, (2) expunging Christiansen's interest in
the Domesite project and the Nupac property.
In recent discussions with Mike Fraser, he tells me that Pack and Company have a
clear title to the property and that there is a hearing scheduled in Kalispell for today
to address the interest Christiansen may have in the Domesite project.
