Dear Stan:
This letter is intended to clarify the issues in my letter of June 14 given your comments in
your letter of June 19.
(1) The development agreement calls for the NUPAC offices to be removed prior to any
building permit being issued. The "foundation only" permit was issued in part to allow an extra
several weeks to take care of that requirement. Nevertheless, it sounds like it will be taken care
of before a remainder permit is necessary.
(2) The fire station pad is being addressed by the Fire Chief and City Manager. I do not
have the authority to remove the condition or otherwise alter the terms related to the pad.
(3) The Fire Department will need to approve the condition of the access and the hydrant
during the construction phase. They also need to approve the sprinkler plans.
(4) Section 2.02, regarding environmental issues, has been handled primarily by Public
Works. The specific language in the section states that Crosswell and Pack "will submit evidence
from the Montana Department of Environmental Quality demonstrating that the Subject Property
is free of contamination." The final closure letter may very well suffice, but we need to reserve
judgment until we have a chance to review the letter.
