Kukulski, City Manager From: James C. Hansz, PE, Director of Public Works/City Subject: Mountain View Plaza Site Environmental Clearan Dick Amerman and I have reviewed the attached letter from Land & Water Consulting on the MV site. Items 1 & 2 deal with closure of environmental concerns with the Target site and indicate these matters are closed with receipt of the MDEQ letters. The industrial well near the Target site was properly abandoned is also closed and the report is being prepared now. Note: this is not a site environmental issue but is of concern to DNRC. The third and fourth items deal with abandonment of the MDT and Nupac domestic wells and buried barrels. These issues are indicated to be satisfactory. Strictly speaking, the known environmental issues on the MV site appear to have been dealt with, but there is still work to be done in order to be in compliance with the PUD requirement for a general environmental closure of the entire site. Since this will not be done by MDEQ the task, by mutual agreement, falls to LWC to provide a statement of satisfaction that the whole site is clear of environmental hazards. They cannot do this at this time because the Nupac buildings are still in place. I have spoken with Mr. Noble who has indicated he does not believe there will be any problems uncovered upon demolition, but he cannot declare this in writing until the work is done. He does not know when the work will be done. Dick Amerman has checked the site and is skeptical that it is free of problems. With respect to the Target site, there seems to be no reason to be concerned about that portion of the MV site. However, I believe it is in the City's interest to insist that all the PUD requirements be met before considering Any other work proposals for MV Plaza. For example, there is a subdivision application pending that on its surface appears to not comply with the PUD. Before proceeding with this or any other developer proposals, the developer should be required to comply with the PUD agreement. Failure to require this could result on the developer successfully moving ahead in a piecemeal fashion developing and selling most of the site while leaving a small area, possibly with a concealed environmental problem, that could be abandoned at the end of the project. memo04O2002 Mr. James Hansz, P.E. Box 1997 Kalispell, MT 59903-1997 Re: Mountain View Mall LWC Project No. 220256 Dear Mr. Hansz: The purpose of this letter is to provide documentation regarding environmental condition's at the subject -referenced site pursuant to Section 2.02 of the Final Agreement between the City of Kalispell (City) and Crosswell Development LLC and PACK. Based on our familiarity of the site and available information, the following environmental concerns are either acceptable for closure or have been approved" for no further action by either the Montana Department of Environmental Quality (DEQ) or the Department of Natural Resources and Conservation: 1. NuPac underground storage tank (UST) located beneath the asphalt aboveground storage tank (AST) battery; Facility ID #15-01349, Release #4083. This site has been designated as "No Further Correction Action Required" by DEQ. Attached is a copy of the closure letter from DEQ dated May 17, 2002. 2. NuPac underground storage tank facility adjacent to east side of the NuPac office building; Facility ID #15-12664, Release #3794. This site has been designated as "No Further Correction Action Required" by DEQ. Attached is a copy of the closure letter from DEQ dated July 17, 2002. 3. Plugging and abandonment of two onsite wells (large industrial supply well and Montana 6wc- Department of Transportation (MDT) domestic well). Billmayer Drilling, Inc., completed this work on July 17, 2002. Attached is a copy of the Well Driller's Report for the MDT well. According to Mr. John Bower of Schellinger Construction, the driller is currently preparing the report for the NuPac industrial well. The procedure used is consistent with Section 36.21.670 — Permanent Abandonment of the Administrative Rules of Montana. 4. Buried drums were purported to occur on the MDT property according to the Phase I Environmental Site Assessment prepared by Land and Water Consulting (January 2000). Based on a telephone enquiry with James S. Weeks of ERM Consulting, a number of crushed paint drums were excavated in this area during the summer of 2001. Planning • Environmental Engineering Hansz July 24, 2002 Page 2 to Mr. Terry Stonehocker, onsite inspector with Thomas, Dean, and Hoskins, removal and disposition of the buried drums and the paint towers was conducted by Olympus Technical Services under contract to MDT. Based on a telephone enquiry to Alan Stein, Manager for Olympus Technical Services, this material was disposed at a landfill. The decision that no.further corrective action is required is based on laboratory analytical results which clearly indicate that soil samples obtained within the tank basin indicate all constituents of concern are either ND or well below DEQ action standards. It does not appear there is a threat to human health or to the environment. The DEQ-PRS will maintain your "release" file so that if you need any information in the future or new problems with your site arise, it can be accessed easily. If you still have outstanding permit requirements or fees due, you will be contacted separately by the Technical Services Bureau's Environmental Services Section..
