SUBJECT Final Plat for North Meadows Subdivision

BACKGROUND: This is a request for final plat approval of North Meadows
Subdivision that plats four single family lots on approximately 1.003 acres. This
subdivision is located on the east side of Denver Avenue between Bluestone and
Sunnyside Drive. All of the water and sewer facilities were in place at the time the
subdivision was approved and the only public improvements required were sidewalks
and landscaping. These improvements have been coordinated with the Kalispell
Public Works Department and completed. This property was annexed to the city in
November of 2003 and given a zoning designation of R-4, Two Family Residential.
The property was annexed into the city and the subdivision given preliminary plat
approval by the Kalispell City Council on November 3, 2003 subject to 12 conditions.
The following is a list of the conditions of preliminary plat approval for this subdivision
and a discussion of how they have been met or otherwise addressed.
RECOMMENDATION: A motion to approve the final plat for North Meadows
Subdivision would be in order.
FISCAL EFFECTS: Potential minor positive impacts once developed.
ALTERNATIVES: As suggested by the City Council.

Dear Chris:
Our office has received an application from Jackola Engineering for final plat approval
of North Meadows Subdivision that plats four single family lots on approximately
1.003 acres. This subdivision is located on the east side of Denver Avenue between
Bluestone and Sunnyside Drive. All of the water and sewer facilities were in place at
the time the subdivision was approved and the only public improvements required
were sidewalks and landscaping. These improvements have been coordinated with the
Kalispell Public Works Department and completed. This property was annexed to the
city in November of 2003 and given a zoning designation of R-4, Two Family
Residential.
The property was annexed into the city and the subdivision given preliminary plat
approval by the Kalispell City Council on November 3, 2003 subject to 12 conditions.
The following is a list of the conditions of preliminary plat approval for this subdivision
and a discussion of how they have been met or otherwise addressed.
Condition No. 1. Development of the subdivision shall be platted in substantial
compliance with the approved preliminary plat which governs the location of lots and
roadways within the subdivision except as modified by the conditions listed herein.

® This condition has been met. The final plat complies with the preliminary plat that
was approved.
Condition No. 2. Because Ashley Meadows subdivision lying on the south and east
side of this subdivision has only been granted preliminary plat approval and this
subdivision depends on the access road to serve Lot 4 of this subdivision, if the Ashley
Meadows access road is not complete at the time of final plat of North Meadows
subdivision, the applicant will wither eliminate Lot 4 from his project, develop Lot 4 in
a separate phase or bond to have the road completed. (Fire Marshall - Site Review).

® This condition has been met. Ashley Meadows internal road known as Rim Rock
Court has been completed and certification from Carver Engineering dated
2/ 19/04 has been submitted with the final plat application.
Condition No. 3. The applicant shall install curb gutter, a minimum 5-foot wide
landscape boulevard with street trees and a minimum 5-foot wide sidewalk along
Denver and along the new access road serving Ashley Meadows the entire length of his
property. (Kalispell Sub. Regs. Section 3.01 & 3.09A).
® This condition has been adequately addressed. Curb, gutter, sidewalk and street
trees have been installed in accordance with a plan approved by the Kalispell
Public Works Department.
Condition No. 4. That a letter be obtained from the Kalispell Public Works
Department approving the plans and specifications for water, sewer, drainage facilities
and street improvements for the subdivision. (Kalispell Sub. Regs. Section 3.09, 3.12 -
3.15).
® This condition has been met. A letter from the Kalispell Public Works Department
dated 4/28/04 has been submitted confirming the adequacy of the existing public
infrastructure for the subdivision.
Condition No. 5. A letter from an engineer licensed in the State of Montana
certifying that the public improvements have been installed according to the required
specifications shall be submitted at the time of final plat approval along with a letter
from the Kalispell Public Works Department stating that the required improvements
have been inspected and comply with the City standards. (Kalispell Sub Regs. Sections
3.09, 3.11 - 3.15).
® This condition has been met. A letter dated 2/ 19/04 from Carver Engineering
confirming the installation of the public infrastructure has been submitted with the
final plat. A letter dated 4/28/04 from the Kalispell Public Works Department has
been received stating that the City improvements have been approved.
Condition No. 6. That a letter be obtained from the Kalispell Public Works
Department approving the installation of the water, sewer, drainage facilities and
street improvements for the subdivision. (Kalispell Sub. Regs. Section 3.09, 3.12 -
3.15).
® This condition has been met. A letter dated 4/28/04 from the Kalispell Public
Works Department approving the existing City infrastructure has been received.
Condition No. 7. Development of the landscape boulevard with location of street
trees shall be done in accordance with a plan approved by the Kalispell Parks and
Recreation director with verification of plan compliance from the parks director
submitted at time of final plat. (Site Review).

• This condition has been met. A letter dated 4/ 16 / 04 from the Kalispell Parks 8v
Recreation Department approving the street trees has been submitted with the
final plat.
Condition No. 8. The fire access and suppression system shall comply with the
Uniform Fire Code and a letter from the Kalispell Fire Department approving the
access and placement of fire hydrants and fire flows within the subdivision shall be
submitted with the final plat. The fire access and suppression system shall be
installed and approved by the Fire Department prior to final plat approval. (Uniform
Fire Code).
• This condition has been met. A letter from the Kalispell Fire Department dated
11/ 10/03 approving the poject has been submitted with the final plat.
Condition No. 9. The developer shall provide a letter from the U.S. Postal Service
approving the plan and verifying installation from the mail service. (Kalispell Sub.
Regs. Section 3.22).
• This condition has been adequately addressed. A letter dated 2/24/04 from the
USPS stating that a common mail delivery station will be coordinated with the post
office and adjacent developer has been submitted with the final plat.
Condition No. 10. Street lighting shall be located within the subdivision and shall be
shielded so that it does not intrude unnecessarily onto adjoining properties. (Kalispell
Sub. Regs. Section 3.09 L)).
• This condition has been adequately addressed. Street lighting exists in the
immediate area.
Condition No. 11. All areas disturbed during development of the subdivision shall be
re -vegetated with a weed -free mix immediately after development. (Kalispell Sub. Regs.
Section 3.13).
• This condition has been adequately addressed. Some areas are still under
construction and revegetation will occur once construction is completed.
Condition No. 12. That preliminary approval shall be valid for a period of three years
from the date of approval. (Kalispell Sub. Regs. Section 2.04 (E(7)).
• This condition has been met. The final plat has been submitted prior to the
expiration of the preliminary plat.
The final plat is in substantial compliance with the preliminary plat which was
reviewed and approved by the City Council on November 3, 2003.

This subdivision plat has been found to be in compliance with the State and City
Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance
and the R-4, Two Family Residential, zoning designation for the property which
governs the dimensional requirements of the lots within the subdivision as well as the
uses.

adequately addressed. The staff would recommend that the Kalispell City Council

A complete final plat application must be submitted no less than 60 days prior to expiration date of

When all application materials are submitted to the Tri-City Planning Office, and the staff finds the
application is complete, the staff will submit a report to the governing body. The governing body
must act within 30 days of receipt of the revised preliminary plat application and staff report.
Incomplete submittals will not be accepted and will not be forwarded to the governing body for
approval. Changes to the approved preliminary plat may necessitate reconsideration by the
Planning Board.

This is to certify that the information and fees received by the Department of Environmental Quality relating to
this subdivision are in compliance with 76-4-127, MCA. Under 76-4-125(2)(d) MCA, this subdivision is not
subject to review, and the plat can be filed with the county clerk and recorder.
Plans and specifications must be submitted when extensions of municipal facilities for the supply of water or
disposal of sewage are proposed {76-4-111 (3), MCA}. Construction of water or sewer extensions prior to
DEQ, Public Water Supply Section's approval is prohibited, and is subject to penalty as prescribed in Title 75,
Chapter 6 and Title 76, Chapter 4.

This letter is written at the request of Bob Foppiano, developer of the North
Meadows Subdivision, which is situated directly north of the westerly 200 feet of
Rim Rock Court, the new roadway into the Ashley Meadows Subdivision.
Please accept this letter as evidence that both the 8-inch diameter sewer main and
8-inch diameter water main required for the Ashley Meadows Subdivision have been
completely installed, tested and disinfected.
Based upon my visits to the site during construction, I believe that the sewer and
water mains were constructed in reasonable conformance with the approved plans
and specifications.
Sewer and water service lines were extended to the south property lines of Lots 3 &
4 of the North Meadows Subdivision from the new mains.
