SUBJECT: Meadow Park Annexation
MEETING DATE: April 7, 2003
BACKGROUND: Recently, the City Council discussed the annexation of the Meadow Park
area and directed staff to continue with the process. Staff has refined the extension of services
plan for this area to reflect comments made at that meeting. Also, a neighborhood meeting has
been scheduled for the evening of April 3 at the Outlaw Inn to answer any questions the residents
may have.
The present plan limits the annexation to those lots which are either (a) presently
connected to both city water and sewer, or (b) have access to those lines in the right-of-way
immediately adjacent to them. The boundaries were drawn to avoid creating a "checkerboard"
effect. The result is a connection between the present city limits and The Willows/Leisure
Heights that is already substantially served by the City.
The first formal step for the Council is the consideration of a resolution of intent to annex
the designated area. Approval by the Council of this resolution essentially schedules the matter
for consideration for a specified date. It is important to understand that this resolution does not
actually annex the area. Instead, it begins the process of public notice and sets May 5 as the date
to consider the actual resolution of annexation.
Initial zoning for the area would follow a separate, but related, track through the Planning
Office. They will prepare a staff report to be presented to the Planning Board on May 13, and a
recommendation will then be forwarded to the Council.

A RESOLUTION OF INTENTION TO ANNEX TERRITORY INTO THE CITY OF
KALISPELL, UNDER THE PROVISIONS OF TITLE 7, CHAPTER 2, PART 43, M.C.A.
(ANNEXATION OF CONTIGUOUS LAND), COMPRISING PLATTED TRACTS OF LAND
AND UNPLATTED LAND THAT HAS BEEN SURVEYED FOR WHICH A
CERTIFICATES OF SURVEY HAVE BEEN FILED, MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A", TO BE DESIGNATED AS MEADOW PARK ADDITION
NO. 323, AND DIRECTING THE CITY CLERK TO PROVIDE NOTICE OF THIS
RESOLUTION AS PROVIDED BY LAW.
WHEREAS, in the judgment of the City Council of the City of Kalispell, Montana, it is in the best
interest of the City of Kalispell and the inhabitants thereof, that the contiguous
platted tracts and unplatted land that have been surveyed and for which certificates of
survey have been filed, as required by law, encompassed in Exhibit "A" attached
hereto and for purposes of this Resolution made a part hereof, be annexed to the City
of Kalispell, so that the boundaries of the City of Kalispell would be extended so as
to include the same within the corporate limits of the City, to zone said property in
accordance with the Kalispell Interim Zoning Ordinance, Ordinance No. 1439, as
amended; and
WHEREAS, the City of Kalispell desires to annex the property to the City limits under the
provisions of Title 7, Chapter 2, Part 43 Montana Code Annotated (Annexation of
Contiguous Land); and
WHEREAS, on the 6th day of November, 1995, the City Council adopted, pursuant to Title 7,
Chapter 2, Part 47 Montana Code Annotated, an Extension of Services Plan which
anticipated development of City services approximately five years in the future, said
Plan being amended on the 1 st day of March, 1999, and
WHEREAS, the City Council shall, prior to annexing said property, cause to be developed an
Extension of Services plan for the territory described in Exhibit "A", and proposed by
this Resolution to be annexed, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission shall on the 13th day of
May, 2003, hold a Public Hearing, pursuant to 27.03.010, Kalispell Interim Zoning
Ordinance, to recommend zoning for the territory described in Exhibit "A" in
accordance with the Kalispell Interim Zoning Ordinance, in the event the territory is
annexed to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That it is the intention of the City of Kalispell that certain territory
described in Exhibit "A", be embraced within the corporate limits of

the City and the boundaries of the City be so extended so as to
include the same.
SECTION II. That it is further the intention of the City of Kalispell that said
property described in Exhibit "A" be zoned in accordance with the
Kalispell Interim Zoning Ordinance, Ordinance No. 1439, as
amended.
SECTION III. The City Clerk shall forthwith prepare and publish in the Daily Inter
Lake, a daily newspaper published at Kalispell, Montana, proper
notice of this Resolution of Intention at least once a week for two
successive weeks next preceding the regularly scheduled Council
meeting at which said Annexation will be considered; and give said
notice in writing, addressed to all registered voters and property
owners in the territory proposed to be embraced.
For a period of twenty days after the first publication of said notice by
the City Clerk, said City Clerk will receive expressions in writing of
the approval or disapproval of the proposed extension of the
boundaries of said City of Kalispell from the registered voters and
property owners residing in the area proposed to be annexed.
SECTION V. At the regularly scheduled meeting of the City Council of the City of
Kalispell, next succeeding the expiration of said twenty days, the City
Clerk shall forward all written communication received by said Clerk
for Council's consideration.
SECTION VI. The City Council, after considering all written communication, may
adopt a resolution approving the annexation and the boundaries of the
City shall thereby be extended to include the property described in
Exhibit "A".

2003
The area considered for annexation lies in the southeast area of Kalispell. In general terms,
the area includes Meadow Park Units 1 and 2, those properties adjacent to the south side of Kelly
Road, and those properties adjacent to the north side of Kelly Road between Highway 93 and
South Woodland Drive.
A map which shows the proposed annexation boundaries is attached. On April 7, 2003
the Kalispell City Council passed Resolution 4779, a Resolution of Intent to Annex the Meadow
Park Area. This plan is intended to address services which would be provided to thes annexation
area as required under Section 7-2-4305, M.C.A. and Section 7-2-4506, M.C.A. This plan is
prepared as an addendum to the City of Kalispell Extension of Services Plan.
MIX"
The area being considered for annexation contains a mix of residential and commercial
uses. This area is on the urban fringe of Kalispell and can be viewed as a transition area to the
more rural, large tract residential and agricultural uses to the east. The majority of the properties
have been developed residentially, primarily single-family residences with some multi -family,
duplex and townhouses in the area.
Extension of municipal sewer and water facilities without annexation has previously taken
place in the area in response to residential and commercial growth in the area. Over the last
several years, both residential and commercial developments which have required extension of
services have been annexed into the City.
The annexation will be pursued under the provisions of Section 7-2-4301, M.C.A., et sue,
(Annexation of Contiguous Land). Those sections outline the specific procedures for annexation
including, but not limited to, an extension of services plan outlining the extension of services to
the area.
EXISTING SERVICES
Roads: The principal road within the area is Kelly Road. The City has recently been granted
ownership of Kelly Road by the County. Other roads within the area proposed for annexation are
a mix of those owned by the County and those which are privately owned and maintained.
Water Service: The proposed annexation area is served primarily by the City of Kalispell's water
system. Some properties are presently supplied by a private water system, although they are
adjacent to city water lines.
Sewer Service: Sewer service in the plan area is provided by a combination of on -site septic
systems and the City of Kalispell's sewer system. City sewer mains run along Kelly Road and
South Woodland Drive. City sewer also serves subdivisions to the north and south of Kelly Road.
The City has provided sewer services to Meadow Park Subdivision and Meadow Park Unit No. 2
with a waiver to protest annexation. City sewer is also provided to The Willows subdivision just
east of the Willow Glen /Kelly Road intersection which has been annexed to the City. The sewer
lift station serving the Greenacres area has been upgraded and relocated in conjunction with
development of The Willows subdivision. All properties within the annexation area are either
served by the City or are adjacent to city sewer lines.
Storm Drainage: There are no storm drains in the proposed annexation area. Drainage plans for
the area were developed as part of the initial approval for the Greenacres West subdivisions and
subsequent Southgate subdivisions. Drainage is provided by a series of drainage ditches and
culverts which ultimately discharge into the slough after being filtered with grasses and sand.
Over the years, some culverts have been filled or crushed and ditches have been filled leaving the
drainage system in poor shape.
Fire: The South Kalispell Fire District provides service. EMS ambulance transportation and
advanced life support service is already provided by the City of Kalispell.
Police: The area is served by the Flathead County Sheriff's Office. There is a mutual aid
agreement with the City of Kalispell for emergency back-up, but the City typically provides the
first response. Animal control services are also provided by the County, although this service is
on a limited basis.
Parks and Recreation: There are no publicly owned parks in the area.
Solid Waste: Solid waste pick-up and disposal services are provided by a private service
contract hauler or by homeowners hauling to the county landfill or county green boxes.
Roads: The ownership of Kelly Road has recently been transferred to the City. Other roads must
first be dedicated to and accepted by the City in order to be maintained by the City.
Kelly Road was not constructed to current City or County standards. The greatest
deficiency is the lack of adequate sub -base material that can result in excessive frost heaving.
Numerous utility cuts in the area exacerbated these problems and resulted in marginal driving

surfaces in several areas. Recent pavement overlay maintenance by the County has significantly
improved the condition of Kelly Road and overall it now generally meets the City's alternate
standard for residential streets that employs roadside ditches for drainage in lieu of curb and
gutter. Subsurface deficiencies appear to have been offset by increased pavement thickness that
strengthens the driving lanes. Streets in Meadow Park Subdivision and Meadow Park Unit No. 2,
which were constructed after 1990, were built to City standards and are expected to have a much
longer service life than others. Some of these streets have curb and gutter, and some meet the
alternate design standard with roadside ditches.
Kelly Road, which functions as an area collector street, is relatively narrow. It should
eventually be considered for full reconstruction and widening when traffic volumes in the area
warrant. Kelly Road may be a candidate for reconstruction within the next five years, but the
actual schedule will depend upon traffic growth in the South Woodland / Greenacres area and
other city-wide demands. It is presently in reasonable condition following an overlay.
Reconstruction of the roadway may be financed through general fiend and/or gas tax revenues. In
general, reconstruction of substandard roadways is highly desirable. The need and timing of any
specific reconstruction would be entirely dependent on the rate of deterioration to an
unacceptable level of service, funding availability, and ranking of the roadway within the overall
priority scheme for the City as a whole.
In all cases, streets that do not have curbs and gutters should continue as such. Curbs and
gutters concentrate storm water and increase the rate and the total volume of runoff to the slough
south of Kelly Road. The system of open ditches tends to reduce the peak flow into the slough
and provides beneficial filtration via grassy swales and ditches.
General maintenance of the streets within the annexation area would be immediately taken
over by the City (Streets that are presently held in private ownership or are owned by the County
must be formally dedicated to and accepted by the City prior to commencement of any
maintenance by the City). This would involve routine pothole repair, snow removal and street
cleaning. City streets within the annexation area will be included in the City's pavement
maintenance program.
It should be noted that the Public Works Department equipment fleet, while benefiting
from some recent replacements and additions, continues to age. Additional demands on
equipment are created when properties are annexed into the city. These demands further increase
the strain on old equipment with an already shortened useful life span. It is reasonable to
anticipate that some older equipment must be replaced in the future. It is also reasonable to
anticipate that, while not necessary for this specific annexation, a full-time employee will
eventually need to be added as additional properties are annexed.
In addition to the general maintenance and future upgrades to be provided by the City of
Kalispell, the Montana Department of Transportation plans to reconstruct Highway 93. The City
will continue its work with the State to facilitate the most practical and safe intersection with
Kelly Road and Highway 93, and pursue the possibility of placing a signalized intersection at this

corner. This decision is under the control of MDT and consideration of this installation would not
be possible until the required signal warrants are satisfied.
A four way stop may be created at the intersection of South Woodland Drive and Kelly
Road provided this intersection meets the warrants for a four-way stop sign as specified within the
Manual of Uniform Traffic Control Devices (MUTCD). Routine police patrolling of this area will
encourage consistent compliance with speed limits and other traffic laws.
With respect to costs, most roadways are presently in reasonable condition due to fairly
new construction or recent pavement maintenance by the County. Annual costs for routine
sweeping, leaf pickup, patching, plowing and flushing are estimated to be proportional to those
costs for the existing street system and total approximately $9,800 per year. Revenues from
special street assessments and potential increased gas tax allocations will offset portions of these
costs.
Water Service: The annexation area is served primarily by the City of Kalispell. All properties
are adjacent to city lines, although not all are connected and instead are served by a private
system. No water lines will need to be installed or extended to serve the annexation area. New
connections to the city system may be made according to the City's general policy and by paying
the appropriate fee. Any additional cost to the City would be nominal.
Fire hydrants would also be installed at key locations determined by the Kalispell Fire
Chief. It is estimated that approximately three (3) hydrants would be required to provide adequate
fire protection for the area. The Kalispell Public Works Department would make these
improvements as part of its continuing program of system improvements. The installation of the
hydrants would cost about $4,950.
Sewer: Most properties presently receive municipal sewer service, although some dispose of
sewage through on -site septic systems. Those properties with septic systems are adjacent to city
sewer lines, and no sewer lines will need to be installed or extended to serve the annexation area.
New connections to the city system may be made according to the City's general policy and by
paying the appropriate fee.
The cost impact of this annexation is negligible; the impact of maintaining the current
service base is already accounted for in the current budget. Future impacts will be nominal and
wholly dependant on customer decisions to request service.
Storm Sewer: There are no storm drains in the annexation area. Drainage plans for the area
were developed as part of the initial approval for the Greenacres West subdivisions and
subsequent Southgate subdivisions primarily through ditching and swales that ultimately discharge
into the slough after being filtered with grasses and sand. Over the years, culverts have been
partially filled or crushed and ditches have been partially filled leaving the drainage system in poor
shape.

Recommended drainage improvements would include re-establishing swales and ditches as
well as other surface drainage and improvements outlined in the South Woodland / Greenacres
Facilities Plan. These facilities would continue to discharge the water into the slough.
Improvements could be made within five years but must be carefully coordinated because of the
many areas where property owners have used swale areas for landscape or other improvements.
These actions should be part of a storm water management approach for the entire area that
integrates older concepts with more recent improvements provided with development of other
nearby subdivisions.
Dedicated funds gathered over a five year period from storm sewer assessments in the area
will be used for storm sewer improvements, in additional to other potential funding sources.
The homeowners have undertaken water quality testing in the slough for the purposes of
monitoring the water quality in different areas. The City could provide technical assistance and
coordination for this monitoring program. Abandonment of septic systems in favor of public
sewer would significantly contribute to improving groundwater and surface water quality in this
area.
Cost impact of this annexation is minor and estimated to be, at maximum, in direct
proportion to the additional area served. In this case, the service area of the city storm system is
to be increased by approximately 1-2%. Therefore, maintenance costs are expected to increase by
approximately $2,000 per year. This cost will be offset by a corresponding increase in revenue.
Fire: South Kalispell Fire Department (a volunteer fire district) provides fire protection to the
proposed Greenacres Annexation area. When this area is annexed, fire protection then becomes
the responsibility of the Kalispell Fire Department. For purposes of this analysis, we are
estimating that there are approximately 325 people living in this area. The Kalispell Fire
Department as the EMS provider for the south half of Flathead County already provides EMS
ambulance transportation and advanced life support service to the area. There is no impact to
EMS ambulance transportation services, since we already provide this service to the area. There
is however, a direct impact on the Kalispell Fire Department in regards to fire protection. Using
current local figures, we anticipate fire calls to increase by 6 calls per year due to the annexation
of this area.
One of these calls may be a structure fire, so receive a general alarm response, committing
two fire engines and a ladder truck. Two hours is the average time that 2 engines, a ladder truck,
and 17 personnel would be committed on a general alarm structure fire.
The other 5 calls would most likely be single engine responses. One hour is the average
time that an engine company of four fire personnel is committed on a single company response in
Kalispell. Using this information, we can anticipate the following:

annually, with approximately 10 inspections added to our current schedule. Each inspection
requires 1 personnel and averages 1.5 hour, including filing and return compliance visits.

The plan should include:
♦ Budgeting for additional costs associated with the annexation as shown above.
♦ Continue plans for automatic aid agreements with surrounding fire districts.
♦ Work with the South Kalispell Fire Department to combine services in a way that provides
seamless quality fire protection.
♦ Provide annual fire inspections for all businesses and 5-plex or larger residential structures
in the annexation areas annually.
♦ Public Works to plan for the installation of hydrants at a minimum every 500 feet or every
intersection, immediately following annexation, with completion within 12 months. Three (3)
hydrants should create complete coverage. The anticipated cost of installation is $4950. Fire
hydrants should be addressed as follows:
1) Inadequate hydrant coverage was noted on Kelly Road. Proposed address locations of
these hydrants are 150 and 195 (2 hydrants).

2) Inadequate hydrant coverage was also noted on Mallard Drive. Proposed address
location of the hydrant is 104 (1 hydrant).
Police: This area is primarily residential in an urban setting immediately adjacent to the city limits.
It also lies between the city limits and a block of property (the Willows Subdivision) that has
already been annexed into the city.
Kelly Road is the principal roadway, and it creates considerable secondary traffic. That
traffic is not the result of destination travel in this zone but rather results from the use of these
roads as connecting roads from Highway 93 and Woodland to Willow Glen Drive. The Flathead
County Sheriffs Office has been contacted regarding the call load in the area. Although they
cannot produce statistics specific to the area, they indicated the call load was moderately high for
an urban residential setting.
The annexation of this area will generate some additional workload, although the impact is
mitigated by the fact that the police already respond in the area to some degree and also serve
properties to the east which have previously been annexed. Due to the unique manner in which
this area is presently served by law enforcement, a formulistic approach is not accurate. It
appears that the likely additional cost for police service would be approximately $4,000.
It should be noted that, even without this annexation, the Police Department is in need of
an additional police officer position. That staffing could absorb these annexations without the
need for staffing above the currently anticipated need.
Parks and Recreation: There are no parks within the annexation area.
Solid Waste: With annexation, solid waste removal services in the area will continue to be
provided by a contract hauler. The City cannot provide solid waste removal services to an
annexed area for at least five years following annexation if licensed contractor services are
presently available, as required by Section 7-2-4736, M.C.A.
Other City Services: Zoning and planning jurisdictions would be extended to encompass the
annexed area. The building code extraterritorial jurisdiction already covers the entirety of the
annexed area, so there would not be a change in the level of services provided by the Building
Department. However, it should be noted that there is pending legislation which could impact the
extraterritorial jurisdiction and, in the future, building code jurisdiction may be limited to the city
limits. The annexations, in essence, solidify the applicability of building codes in the area. The
Community Development and Finance Departments will not be directly impacted, although they
may provide assistance in regard to grants and other financing strategies.

The Kalispell Extension of Services Plan sets forth various policies for financing extension
of services. Construction of new streets, sewer, water, and drainage facilities are typically the
responsibility of the developer or property owner. Other than minor improvements to the existing
storm drainage system, no such extensions are anticipated
Generally, the entire municipality tends to share the tax burden for the services described
in this plan and the area may be annexed without a bond issue. Operating and maintenance costs
for streets, sewer, water, police, fire protection, parks, building and zoning, and other municipal
functions would be primarily financed by a combination of user fees and taxation. Any additional
impact on the waste water treatment facility and the water system would be paid for through
connection fees. Street overlays and repairs would be financed from the City's general fund and
gas taxes collected.
As a final note, should the annexation of this area result in litigation, no improvements or
additional services would be provided until the matter is resolved.
