SUBJECT Final Plat for Meadow Creek Subdivision

BACKGROUND: This is a request for final plat approval of Meadow Creek, a residential
subdivision with 9 duplex townhouse lots for a total of 18 dwelling units on approximately
1.639 acres located on the southwest corner of Eighth Street West and Twelfth Avenue West in
Kalispell. Preliminary plat approval for this subdivision was granted by the city council on
March 6, 2000. A one year extension was granted earlier this year. There were 13 conditions
of preliminary plat approval.
A cash -in -lieu of parkland check in the amount of $5,400 has been submitted as part of this
application. It should be noted that a subdivision improvements agreement has been
submitted with the final plat to address the completion of several minor improvements
including a light standard that was back ordered, a short section of sidewalk that is being
replaced and some backfill behind the curb line. A personal check in the amount of $ 3,975
which constitutes 125 percent of the remaining work has been submitted as collateral for the
improvements to be completed
RECOMMENDATION: A motion to accept the subdivision improvements agreement and
approve the final plat for Meadow Creek would be in order.
FISCAL EFFECTS: Potential minor positive impacts once developed.
ALTERNATIVES: As suggested by the City Council.

Re: Final Plat for Meadow Creek Subdivision
Dear Chris:
This is a request for final plat approval of Meadow Creek, a residential subdivision with 9
duplex townhouse lots for a total of 18 dwelling units on approximately 1.639 acres located
on the southwest corner of Eighth Street West and Twelfth Avenue West in Kalispell.
Preliminary plat approval for this subdivision was granted by the city council on March 6,
2000. A one year extension was granted earlier this year. There were 13 conditions of
preliminary plat approval.
A cash -in -lieu of parkland check in the amount of $5,400 has been submitted as part of
this application. Below is a list of the findings of compliance with each of the conditions of
preliminary plat approval.
COMPLIANCE WITH CONDITIONS OF APPROVAL:
Condition No. 1 Development of the subdivision shall be platted in substantial
compliance with the approved preliminary plat which governs the location of lots and
roadways within the subdivision.
• This condition has been met per face of final plat and per site inspection.
Condition No. 2 That the roadways serving the subdivision shall be constructed in
accordance with the adopted Design and Construction Standards for the City of Kalispell
for local roads and include the pavement, curbs, gutters, storm drainage, sidewalks and a
minimum five foot landscape boulevard with street trees placed in accordance with a plan
approved by the parks and recreation director. The sidewalks installed within the cul-de-
sac can be attached to the curb and shall be on both sides of the street. Sidewalks shall be
installed on the south side of Eighth Street West and the west side of Twelfth Avenue West.
A letter from an engineer licensed in the State of Montana certifying that the improvements
have been installed according to the required specifications shall be submitted at the time
of final plat approval along with a letter from the Kalispell Public Works Department stating
that the required improvements have been inspected and comply with the City standards.

® This condition has been met per letter dated October 13, 2003 from project engineer Thor
Jackola and per letter dated October 15, 2003 from Frank Castles, Kalispell Public Works.
Note that several items identified by Frank Castles have not been completed to date.
These minor improvements are addressed in a subdivision improvements agreement.
Condition No. 3 That the southern portion of Twelfth Avenue West is annexed into the
city of Kalispell prior to the filing of the final plat and that documentation be provided that
this is a public right-of-way or that access has been granted through a private easement.
This condition has been sufficiently addressed. The Kalispell Public works Department is
in the process of requesting Flathead County to deed over to the City the R/W. At that
point the city, as the owner will annex 12th Ave. West into the city.
Condition No. 4 A storm water drainage plan, which has been designed by an engineer
licensed in the State of Montana, shall be prepared which complies with the City's Design
and Construction Standards and shall be reviewed and approved by the Kalispell Public
Works Department.
This condition has been met per letter dated October 13, 2003 from project engineer Thor
Jackola and per letter dated October 15, 2003 from Frank Castles, Kalispell Public Works
Condition No. 5 That a Certificate of Subdivision Approval be obtained from the
Department of Environmental Quality and written approval by the Kalispell Public Works
Department approving the water and sewage facilities for the subdivision.
® This condition has been met per attached letter from DEQ dated 10-15-03 and per letter
from Frank Castles, Public Works dated October 15, 2003.
Condition No. 6 That an approach permit for the proposed access onto Twelfth Avenue
West shall be obtained from the Kalispell Public Works Department and any conditions or
improvements associated with the permits be completed prior to final plat submittal.
This condition has been addressed through the design approval process of the Kalispell
`Public Works Department approving the initial design of Meadow Court and 12th Ave.
West and with final review and approval of these streets per letter from Frank Castles,
Kalispell Public Works dated October 15, 2003.
Condition No. 7 The cul-de-sac road within the subdivision shall be named and signed
in accordance with the policies of the Kalispell Public Works Department and the Uniform
Traffic Control Devices Manual.
This condition has been per site inspection and Public Works approval per letter from
Frank Castles, Kalispell Public Works dated October 15, 2003.
Condition No. 8 The developer shall provide a plan for mail service approved by the U.S.
Postal Service.

Condition No. 9 Street lighting shall be located within the subdivision and shall be
shielded so that it does not intrude unnecessarily onto adjoining properties.
• This condition has been met per site inspection and per letter of approval from Frank
Castles, Kalispell Public Works dated October 15, 2003. Note, one street standard is still
missing and on back order. Placement of this light standard is included in the attached
subdivision improvements agreement.
Condition No. 10 That cash -in -lieu of parkland dedication be required in the amount of
one -ninth of the area devoted to lots or 0.15 acres in the amount of $5,400. The developer
may provide information to alter the amount of required cash -in -lieu of parkland based
upon either the amount paid for the property within the last six months or an independent
appraisal.
• This condition has been met. A check for $5,400 is attached with this request.
Condition No. 11 All utilities shall be installed underground.
• This condition has been met per site inspection on October 9, 2003. Note that there
continues to be overhead utilities along the west side of 12th Ave. West. These poles carry
power to residents adjacent to but outside of the ownership of this subdivision.
Condition No. 12 That a letter from the Kalispell Fire Department approving the access
and number and placement of fire hydrants within the subdivision shall be submitted with
the final plat.
• This condition has been addressed per site inspection and per letter from Fire Marshall
dated September 26, 2003
Condition No. 13 All areas disturbed during development of the subdivision shall be re -
vegetated with a weed -free mix immediately after development.
• This condition has been met per site inspection and per certification from the applicant
dated October 15, 2003. The applicants propose to sod the boulevards.
The final plat is in substantial compliance with the preliminary plat which was submitted
and approved.
This subdivision plat has been found to be in substantial compliance with the State and
City Subdivision Regulations. The preliminary approval was valid for three years.
Preliminary plat approval was granted on March 6, 2000 for a period of three years from
the date of approval. A one year extension was granted by City Council expiring on March

6, 2004. The final plat has been submitted within this time frame. The applicants have
submitted a subdivision improvements agreement to address the few minor features to the
project that have not been completed to date such as the remaining light standard,
additional backfill along 12t', Ave. West and replacement of a short section of sidewalk. The
agreement contains a personal check in the amount of $3,975 which will address 125% of
the cost of improvements.
This subdivision complies with the Kalispell Zoning Ordinance and the R-4 zoning
designation.

staff recommends that the Kalispell City Council approve the final plat for this subdivision.

SUBDIVISION IMPROVEMENT AGREEMENT --�
THIS AGREEMENT, made and entered into this _LkE day of
2003, by and between the CITY COUNCIL, CITY OF KALISPELL, MONTANA,
Flathead County, Montana, Party of the First Part and hereinafter referred to as the
CITY, and KMTS, L.L.C., of P.O. Box 1134, Kalispell, Montana, 5993, Party of the
Second Part and hereinafter referred to as DEVELOPER.
WITNESSETH:
THAT WHEREAS, the Developer is the owner of a new subdivision known as
"SUBDIVISION PLAT OF MEADOW CREEK", located in Section 18, T28N, R21W,
PM,M, Flathead County and,
WHEREAS, the city has conditioned it's approval of the final plat of "SUBDIVISION
PLAT OF MEADOW CREEK", upon the conditions as set forth in the Preliminary Plat
of the Subdivision being completed and all improvements, as cited in "Exhibit A" have
not been completed at this time, and the Developer wishes to bond for the completion of
those improvements set forth in "Exhibit A"; and
WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide
a financial security of 125% of the estimated total cost of construction of said
improvements as evidenced by an estimate prepared by a licensed public engineer or the
contractor included herewith as "Exhibit B", and
WHEREAS, the estimated total cost of construction of said improvements is the sum
of $3,180.00.
NOW THEREFORE, in consideration of the approval of the final plat of said
Subdivision by the City, the Developer hereby agrees as follows:
1. The Developer shall deposit as collateral with the City a Letter of Credit, or other
acceptable collateral as determined by the City Council, City of Kalispell, Montana, in the
amount of $3,975.00. Said Letter of Credit or other collateral shall have an expiration
date of at least sixty (60) days following the date set for completion of the
improvements, certifying the following:
a. That the creditor guarantees funds in the sum of $3,975.00, the estimated cost of
completing the required improvements in "SUBDIVISION PLAT OF MEADOW
CREEK".
b. That if the Developer fails to complete the specified improvements within the
required period, the creditor will pay the City immediately, and without further action,
such funds as are necessary to finance the completion of those improvements up to the
limited of credit stated in the letter;
2. That said required improvements shall be fully completed by AUGUST 31, 2004.
3. That upon completion of the required improvements, the Developer shall cause to
be filed with the City a statement certifying that:
a. All required improvements are complete;
b. That the improvements are in compliance with the minimum standards specified by
the City for their construction and that the Developer warrants said improvements
against any and all defects for a period of one (1) year from the date of acceptance of the
completion of those improvements by the City:
c. That the Developer knows of no defects in those improvements;
d. That these improvements are free and clear of any encumbrances or liens;
e. That a schedule of actual construction costs have been filed with the City; and
f. All applicable fees and surcharges have been paid.
4. The Developer shall cause to be filed with the City copies of final plans, profiles,
grades and specifications of said improvements, with the certification of the registered
professional engineer responsible for their preparation that all required improvements
have been installed in conformance with said specifications.
IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS
FOLLOWS, TO -WIT:
That the Developer shall provide for inspection of all required improvements by a
registered professional engineer before the Developer shall be released from the
Subdivision Improvement Agreement.
That if the City determines that any improvements are not constructed in compliance
with the specifications, it shall furnish the Developer with a list of specific deficiencies
and may withhold collateral sufficient to insure such compliance. If the City determines
that the Developer will not construct any or all of the improvements in accordance with
the specifications, or within the required time limits, it may withdraw the collateral and
employ such funds as may be necessary to construct the improvement or improvements in
accordance with the specifications. The unused portions of the collateral shall be
returned to the Developer or the crediting institution, as is appropriate.

The plat must be signed by all owners of record, the surveyor and the examining land surveyor.
Attach a letter, which lists each condition of preliminary plat approval, and individually state how
each condition has specifically been met. In cases where documentation is required, such as an
engineer's certification, State Department of Health certification, etc., original letters shall be
submitted. Blanket statements stating, for example, "all improvements are in place" are not
acceptable.
A complete final plat application must be submitted no less than 60 days prior to expiration date of
the preliminary plat.
When all application materials are submitted to the Tri-City Planning Office, and the staff finds the
application is complete, the staff will submit a report to the governing body. The governing body
must act within 30 days of receipt of the revised preliminary plat application and staff report.
Incomplete submittals will not be accepted and will not be forwarded to the governing body for
approval. Changes to the approved preliminary plat may necessitate reconsideration by the
Planning Board.
I certify that all information submitted is true, accurate and complete. I understand that
incomplete information will not be accepted and that false information will delay the application
and may invalidate any approval. The signing of this application signifies approval for Tri-City
Planning staff to be present on the property for routine monitoring and inspection during the
approval and development process.

Dear Tom:
1. The subdivision plat is platted in substantial compliance with the approved preliminary plat.
2. The roads serving the subdivision are constructed per plans and specifications and in
accordance with City of Kalispell design and construction standards. Due to the existing 8tn
Street West and 12t Avenue West street locations being on the far side of the south and west
side of the respective right-of-way and many existing utilities located at these property lines,
conflicts resulted as to the sidewalk placement and boulevard allowable width. Because of all
the utility conflicts and curb stop locations, it became necessary to provide a lesser than 5 foot
boulevard with a 4 foot sidewalk on 8tn street and the placing of a 5 foot sidewalk adjacent to the
curb on most of 12th street and in the cul-de-sac. Under the conditions, it was a compromise of
dealing with difficult existing conditions. This was discussed with the City Public Works and
received their concurrence. Trees are planted and topsoil and seeding done. The above work
has been completed as agreed upon. The sidewalk from the cul-de-sac Lot number 9B end to
12th was never shown on approved plans because of the need to accommodate right-of-way
storm drainage provisions.
3. Twelfth Avenue West, south of 8th Street West is a public right-of-way.
4. The storm water drainage plan has been designed by a licensed engineer in accordance to city
standards and approved by the city. The system has been installed per approved plans and
specifications.
5. Approval letters for the sewer, water and subdivision have been received for filing.
6. Improvements to 12th Avenue West and access to Meadow Court have been approved by the
City of Kalispell.

7. The street signs are provided and installed.
8. The mail service boxes have been installed by the postal service at a location selected by them.
A letter was requested from them and should be forthcoming.
Street lighting is being provided as shown on the approved plans and specifications. All three
pole bases and wiring are installed. Two of the poles and lights are in place and we are awaiting
the third pole yet to be delivered. It will be installed as soon as it arrives.
10. The cash -in -lieu of parkland check in the amount of $5,400.00 has been provided.
11. All subdivision utilities are underground. Existing utility company poles are to remain as they
service other properties in the area. Any temporary services will be removed.
12. 1 understand that a Kalispell Fire Department letter of approval has been sent directly to the
planning office. I have had phone conversations with the fire chief.
13. The disturbed areas have been graded and seeded with a weed free mix. As you are aware
residential construction will be continuing on the lots.

Dear Thor:
We have made a cursory examination of the referenced project today. The Public Works
Department concurs with the changes in the boulevards and sidewalks as outlined in your letter.
The existing pavement locations and locations of existing utilities necessitated the placement and
size of the constructed boulevards and sidewalks.
Public Works has examined the public improvements and have found them to meet the intent of the
current city standards with the following exceptions:
1. A section of sidewalk is missing at the transformer vault location on 12'b Avenue West.
2. The backfill on the East side of 12'b Avenue West should be placed at a 2 Horizontal to 1

3. The sidewalks should be backfilled with material to the top of the sidewalk on the
property line side.
4. The topsoil in the boulevards should be graded to the top of the sidewalk to the top of the
curb with no low spots in between.
5. All the topsoil and sidewalk backfill should be neatly raked.
6. One street light pole is not installed.

The plans with specification notes, certified checklists and required documents for the above
referenced project have been reviewed by this office and are satisfactory. Approval to proceed
with the project is hereby given. One set of the approved plans is enclosed.
This project includes installation of a water and sewer main extensions as shown on plans
prepared by Jackola Engineering and received by this office on 04/23/02. The plans were
submitted under the seal and stamp of Thor Jackola, P.E. # 3335E.
Approval is given with the understanding that any deviation from the approved plans and
specifications will be submitted to the department for review and approval. Prior to commencing
use of any portion of a new public system, the owner or his engineer, shall certify by letter to the
Department that the portion of the system to be put into use was built in accordance with
approved plans and specifications. As -built drawings for the portion of the system put into use
must be provided to the Department within 90 days after the date of initial use. Within 90 days
after the entire project has been completed, the project engineer shall certify to the Department
that the project was inspected and found to be installed in accordance with the plans and
specifications approved by the Department. This certification shall be accompanied by a set of
record as built drawings of the entire project, signed by the project engineer.

healthy through collaboration, promoting stewardship of our resources, and providing preventive health services to

It is further understood that construction will be completed within three years following the date
of approval. If more than three years elapse before completing construction, plans and
specifications must be resubmitted and approved before construction begins or resumes. This
three year expiration period does not extend any compliance schedule requirements associated
with a Department enforcement action against a public water or sewage system.
