Dear Bob;
Thank you for taking the time to meet me on -site yesterday to review the project. As you know,
the Warranty and Maintenance Bond for the above mentioned subdivision expires October 10,
2006.
Due to the recent improvements to the stormwater retention area, please submit an additional
Warranty and Maintenance bond to cover 125% of the cost of those specific improvements. The
bond should be valid for one-year from the date of the engineering certification of that work.
This bond will need to be submitted by close of business Monday to ensure that the City is
adequately protected.

Subject: Stormwater Retention Pond
Leisure Heiahts Subdivision — S 317
Dear Mr. Stauffer,
The Department has reviewed your latest design proposal (copy attached) that was sent to
the Hydraulics Unit in Helena. MDT has serious concerns over this retention pond and
the proposed resolution. In light of our concerns we will consider the following as
possible alternatives that may be permitted —
Alternate # 1:
The proposed design that was sent to Helena with the standpipe, bentonite, a
connecting pipe; draining into 6" to 8" sized riprap, placed at the toe of the ditch
adjacent to Secondary Highway 317 (Willow Glen Drive) may be permitted if
some additional conditions are met. This ditch will need to be graded to drain
and the grade maintained on a permanent basis. This is neither a responsibility
nor an liability exposure MDT is interested in taking on. Therefore, in order to
consider this alternative an agreement will need to be prepared, between the City
of Kalispell and the Montana Department of Transportation. This agreement shall
not only authorize the City to handle maintenance responsibilities but shall also
pass on the associated liability and responsibility to perform the necessary work
associated with this retention pond outfall, ditch and water permanently to the
City. In addition, the City and Swartz Engineering shall accept all liability
associated with this retention pond, associated design, ditch and resultant water.
MDT must be totally released from any maintenance responsibilities and any
associated liability involving this system.
Alternate # 2:
A closed buried underground system that transports the retention pond water
southerly, the total distance to Muskrat slough on the west side of S 317 (Willow
Glen. Drive). This system would be the responsibility of City or another legal
entity agreeable, to MDT. You will be responsible for obtaining all necessary
permits and approvals associated with the system. The.Departrz�ent will not accept
any liability for the, retention pond, the water transportation system or the
resultant water.

There are still issues dealing with adjacent landowners relating to this retention pond
regarding seepage, the design and initial construction. The fact remains that if all that
was happening was historic predevelopment flow, there would be no need to do anything
with the ditch. In the event MDT permits one of the alternatives or some other proposal,
MDT is neither approving the design nor the engineering of the permitted alternative and
the associated the retention pond system.
You may have other alternatives you may wish to propose. MDT will work with you and
the City of Kalispell to get a design and storm water system that is appropriate and meets
the needs of MDT, the traveling public and adjacent landowners.
