Re: Final Plat for Lantis Subdivision
Dear Glen:
Our office has received the application for final plat approval of Lantis Subdivision, a
two lot residential subdivision located between Three Mile Drive and Liberty Street,
west of Meridian Road in Kalispell. Preliminary plat approval for this subdivision was
granted by the Kalispell City Council on June 16, 1997 subject to nine conditions.
This property is zoned RA-1, Low Density Residential Apartment. This property
received a conditional use permit to allow two 32 unit assisted living facilities. One
has been constructed on proposed Lot 2. The other will be built as the market will
allow.
The following is a list of the conditions of approval and a discussion of how they have
been met.
COMPLIANCE WITH CONDITIONS OF APPROVAL:
Condition No. 1. That the development of the site will be in substantial conformance
with the approved preliminary plat which shall govern the general location of the lots
and roadways.
® This condition has been met. The final plat conforms to the approved preliminary
plat design.
Condition No. 2. That the Certificate of Subdivision Approval be obtained from the
Department of Environmental Quality for water and sewer service to the lots.
This condition has been met. A letter dated June 23, 1998, E.Q. #98-2717, from the
Montana Department of Environmental Quality stating that the information
submitted has ful filled the requirements of the State's master plan exemption has
been submitted with the final plat.
Condition No. 3. That the roadway from Liberty Street be constructed in accordance
with the City of Kalispell's design and construction standards for paved roads and that
a letter from a professional engineer licensed in the State of Montana certify that the
road has been constructed accordingly.

• This condition has been met. A letter from NTL Engineering and Geoscience, Inc
dated June 26, 1998 has been submitted with the final plat stating that the road has
been constructed in accordance with the project plans.
Condition No. 4. That the road providing access from Liberty Street be privately owned
and maintained for year-round use.
• This condition has been met. This condition was addressed by placing a note on the
face of the final plat.
Condition No. 5. That the property owner shall provide a cul-de-sac which meets the
City of Kalispell's subdivision standards at the terminus of the road providing access
from Liberty Street or that the internal roadway system between Liberty Street and
Three Mile Drive be completed prior to final plat approval.
• This condition has been met. The roadway has been completed.
Condition No. 6. That an approach permit be obtained from the Kalispell Public Works
Department for access onto Liberty Street.
• This condition has been met. A letter from the Kalispell Public Works Department
dated June 22, 1998 approving the driveway has been submitted with the final plat.
Condition No. 7. That an approach permit be obtained from the Flathead County Road
Department for access onto Three Mile Drive and that the terms and conditions of the
permit be met prior to final plat approval.
• This condition has been met. An approach permit from the County Road Department
has been submitted with the final plat.
Condition No. 8. That an easement be placed on the southwest corner of the property
for on -site stormwater detention.
• This condition has been met. A easement has been noted on the plat.
Condition No. 9. That the following notes shall be placed on the final plat:
a. All house numbers shall be placed to be visible from the road, either at the driveway
entrance or on the building.
b. That the road from Liberty Street to Lot I is a privately owned and maintained road
open to public use.
c. That an engineered drainage plan be approved by the Kalispell Public Works
Department prior to granting a building permit.

COMPLIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was
submitted and approved.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in substantial compliance with the State
and City Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision complies with the Kalispell Zoning Ordinance.
RECOMMENDATION:
All of the conditions of preliminary plat approval have been adequately met The
Flathead Regional Development Office recommends that the Kalispell City Council
approve the final plat for this subdivision. Please schedule this matter for the regular
City Council meeting of July 20, 1998.

Plat must be signed by all owners of record, the surveyor and examining land
surveyor.
Attach a letter which lists each condition of preliminary plat approval and individually
state how each condition has specifically been met. In cases where documentation is
required, such as an engineer's certification, State Department of Health certification,
etc., original shall be submitted. Blanket statements stating, for example, "all
improvements are in place" are not acceptable.
A complete final application must be submitted no less than 30 days prior to
expiration date of preliminary plat.
When all final plat materials are submitted to the F.R.D.O. and the staff finds the
application is complete, the staff will submit a report to the governing body. The
governing body must act within 30 days of receipt of the final plat application and
staff report. Incomplete submittals will not be accepted and will not be forwarded to
the governing body for approval. Changes to the approved preliminary plat may
necessitate reconsideration by the Planning Board.
I certify that all information submitted is true, accurate and complete. I understand
that incomplete information will be not accepted and that false information will delay
the application and may invalidate any approval. The signing of this application,
signifies approval for F.R.D.O. staff to be present on the property for routine
monitoring and inspection during the approval and development process.

This is to certify that the information and fees received by the Department of Environmental Quality relating
to this subdivision are in compliance with the Sanitation in Subdivisions Act, Title 76, Chapter 4, MCA 1995,
and the administrative rules, ARM Title 17, Chapter 36, Sub -Chapters 1, 3, & 6. Under 76-4-111 (3), MCA,
this subdivision is not subject to The Sanitation in Subdivisions Act, and can be filed with the county clerk
and recorder.
Since this subdivision is in a master planned area, and has fulfilled the requirements of the master plan
exclusion, the plat can be filed. Please note, however, the requirements of the Public Water Supply Act, Title
75, Chapter 6, MCA. No construction of water supply or sewage disposal facilities can commence until the
Department has approved plans for those facilities submitted under Title 75, Chapter 6, and ARM Title 17,
Chapter 38, Sub -Chapter 4.
Plans and specifications must be submitted when extensions of any system of water supply, water distribution,
sewer, wastewater or sewage treatment or disposal is proposed. Construction prior to approval is prohibited,
and is subject to the penalty prescribed in the Public Water Supply Act, Title 75, Chapter 6, Section 113,
MCA.
Where these plans have received approval from DEQ no further review is necessary. Where they have not
received approval it is necessary to obtain approval prior to any construction.

Dear Mr. Ames:
In accordance with your authorization, we performed engineering observations during the
parking lot and entry road construction at the Wel-Life project in Kalispell, Montana. The entry road and
parking lot were constructed in general accordance with the local street detail of page C-7 of the project
plans. Nuclear field density tests were performed during the placement of structural fill, base course. and
asphaltic concrete. Marshall Field Control tests «ere also performed during the placement of asphaltic
concrete pavement. Construction materials test results were presented previously in separate reports
which indicated general compliance with specifications.
