BACKGROUND-. This is a request for final plat approval of Glacier Village Greens
Phase 17 that plats eight lots for single family lots on approximately two acres. The
property is located at the northern terminus of Palmer Drive, north of the clubhouse
between. East and West Nie lau.s Avenues. This phase will further extend Palmer
Drive and the road will end in a temporary cul-de-sac that will provide an extension
for future phases.
The Kalispell City Council. approved. Glacier village Greens phases 14 through 22 in
December of 2002 subject to 16 conditions. Nearly all of the required infrastructure
has been completed with the exception of some landscaping and some work on a lilt
station. A subdivision improvements agreement has been submitted to cover the
remaining improvements. A letter of credit in the amount of 125 percent of the cost of
the remaining improvements,- or the amount of $8,500 has been submitted with the
final plat. The remaining improvements are anticipated to be fully completed by July
1, 2005.
RECOMMENDATION: A motion to accept the subdivision improvements agreement
and approve the final plat for Glacier village Greens phase 17 would be in. order.
FISCALEFFECTS: potential minor positive impacts once developed.

THAT WHEREAS, the Developer is the owner and developer of a new subdivision

WHEREAS, the City has conditioned it's approval of the final Plat of
Glacier Village Greens, Phase 1.7 upon the conditions as set forth in the Preliminary flat

of the Subdivision being completed and all improvements, as cited in "Exhibit A" have not
been completed at this time, and the Developer wishes to bond for the completion of those
improvements set forth in "Exhibit "; and
AREAS,, the City{s Subdivision Regulations require that a subdivider shall provide
a financial security of 1 of the estimated total cost of construction of said improvements as
evidenced b an estimate prepared by a heensed public engineer included herewith as "Exhibit
B,f } ; and
VvIMR-EA, the estimated total cost of construction of said improvements is the sum
of 6,800
NOW THEREFORE, in consideration of the approval of the final plat of said
Subdivision by the City, the Developer hereby agrees as follows:
{ The Developer shall deposit as collateral with the City a Letter of Credit, or other
acceptable collateral as detem-lined by the City Council, in the amount of $ 8,500 4
Said Letter of Credit or other collateral shall have an expiration date of at least sixty 60 days
following the date set for completion of the improvements, certifying the following:
a. That the creditor guarantees funds in the sum of $ 8,500the estimated cost
of completing the required improvements in Glacier villa e Greens phase 17

b. That if the Developer fails to complete the specified improvements within the
required period, the creditor will pay to the City immediately, and without further action, such
funds as are necessary to finance the completion of those improvements up to the limited of
credit stated in the letter;
. That said required improvements shall be fully completed by .lulu 11, 2005.
3. That upon completion of the required improvements, the Developer shall cause to be
filed with the City a statement certifying that:
a. All required imp rovernen is are complete;
b. That the improvements are in compliance with the minimum standards specified b
the City for their c nstruc ti on and that the Developer warrants said improvements
against any and all defects for a period of one 1) year from the date of acceptance
of the completion of those improvements by the City;
e. That the Developer knows of no defects in those improvements;
d . That these improvements are free and clear of any encumbrances or liens;

f, All applicable fees and surcharges have been paid.
4. The Developer shall cause to be Bled with the City copies of final plans, profiles,
grades and specifications of said improvements, with the certification of the registered
professional engineer responsible for their preparation that all required improvements have
been installed in conformance with said specifications.
IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS
FOLLOWS, TO -WIT:
That the Developer shall provide for inspection of all required improvements by a
registered professional engineer before the Developer shall he released from the Subdivision
Improvement Agreement.
That if the City determines that any improvements are not constmeted in compliance
with the specifications, it shall furnish the Developer with a list of specific deficiencies and
may withhold collateral sufficient to insure such compliance. If the City determines that the
Developer will not construct any or all of the improvements in accordance with the
specifications, or within the required time limits} it may withdraw the collateral and employ
such funds as may he necessary to construct the improvement or improvements in accordance
with the specifications. The unused portions of the collateral shall he returned to the
Developer or the crediting institution., as is appropriate.

Our office has received an application from. Sands Surveying for final plat approval of
Glacier Village Greens Phase 17 that plats eight smgle fanny lots on approm' ma.tely
two acres. The property is located at the northern terminus of Palmer Drive, north of
the clubhouse between East and West NicIdaus Avenues, This phase will further
extend Palmer Drive and the road will end in a temporary cul-de-sac that will provide
an extension for future phases.
The Kalispell City Council, approved Glacier Village Greens Phases 14 through 22 in
December of 2002 subject to 16 conditions. Nearly all of the required infrastructure
has been completed with the exception of some landscaping and some work on a lift
station. A subdivision improvements agreement has been submitted to cover the
remaining improvements. A letter of credit in the amount of 125 percent of the cost of

final. plat. The remaining improvements are anticipated to be fully completed by July
3 1 r 2005.
The following is a list of the conditions of preliminary plat approval for this subdivision
and a. discussion of how they have been reset or otherwise addressed.
M LkN.E -I iCONDITIONS OF APPROVAL
Condition No. 1: Development of the subdivision shall be platted in substantial
compliance with the approved preliminary plat which governs the location of lots and
roadways within the subdivision.
This condition has been met. Some minor modifications have been made to the
lot layout for this area by ehrm'nating one lot and making another lot larger.
Condition No. ; That the roadways ser ng the subdivision shall be constructed in
accordance with the adopted Design and Construction Standards for the City of
Kalispell for local roads and include the pavement, curbs, gutters, storm drainage,
sidewalks and a minimum five foot landscape boulevard with street trees placed in
accordance with a plan approved by the parks and recreation director. A letter from

an engineer licensed in. the State of Montana certifying that the improvements have
been installed according to the required specifications shall be submitted at the time
of final plat approval along with a. letter from the Kalispell Public works Department
sta.t.ing that the required improvements have been inspected and comply with. the City
standards.
This condition has been met, A letter from the Kalispell Public works
Department dated / s / o4 has been submitted approving the infrastructure.
Certification of work to date is attached from the applicant's engineer, wMw.
subdivision improvements agreement is attached to cover uncompleted work
including landscaping and trees. Approximately $6,800 worth of work remain s
to be completed. Accordingly, a bond for $8,500 is attached with work to be
completed by July of Zoo .
Condition No. t That a letter he obtained from the Kalispell Public works
Department approving the sewer and drainage facilities for the subdivision.
This coildition has been nict. Attached is a letter dated 19/2/03 from City of
Kalispell Public Works Department approving the plans and specifications for
the project.
Condition No. 4. That a geotechnical analysis of the slope areas to the north and to
the west of the proposed subdivision be performed that pertains to the stability of the
slope and identifies any potential for failure due to development of the subdivision or
other construction that might occur. The report shall be submitted to the Kalispell
Public works Department for their review and approval.

Condition No. 5; A storm water drainage plan which has been designed by an
en.gi.neer licensed in the state of Montana shall. be prepared which complies with the
ity's Design and Construction. Standards and shall be reviewed and approved by the
Kalispell public works Department.
• This condition has been met. A letter from Kalispell Pubic Works dated 9/2 J03
approving the plans and specifications for this project has been submitted with
the final plat application.
Condition No. * That the developer obtain a letter from the Evergreen water
District or their engineer approving the water main extension and certifying that any
necessary improvements have been completed.
* This condition has been. met. A letter from the Evergreen water & Sewer
District 9/17/03 approving the plans and specifications for the main extension
has been submitted with. the .final plat application.

accordance with the policies of the Kalispell Public Works Department and the,

recognizing the existffig park and parking improvements as well as open space within
the development.

Condition No. 12: That the fire access and suppression system comply with the
Uniform Fire Code and a letter- from the Kalispell Fire Department approving the
access and number and placement of fire hydrants within the subdivision as well as
fire :lows and access shall be submitted with the final plat. The fire access and
suppression system shall be installed and approved by the fire department prior to
final plat approval
This condition has been met. A letter from. the Kalispell Fire Department dated
/ 1.,5/ 00 has been submitted approving the fire access and suppression
system and the .fire flow tests have been completed.
Condition No. : That a minimum of two-thirds of the necessary infrastructure for
this subdivision shall be completed prior to final plat submittal.
This condition has been met. A. subdivision improvements agreement has been
submitted for the completion of remaining improvements that consist pn arily
of some landscaping and street trees.

MENDATION:
It can be found that the conditions of prehminary plat approval have been met or
otherwise adequately addressed.. The staff would recommend that the Kalispell City
Council approve the final plat for the Glacier Village Greens Phase 17 and accept the
subdivision improvements agreement as submitted. Please schedule this matter for
the regular city councill meeting of March 21, Zoo .

Attached please find the materials necessary to file the final plat for Flathead Village Greens,
Phase di l l . l have listed the Conditions of Approval, and then subsequently addressed how
each Condition was met.
Flathead Village Greens Phase XV11 was granted Preliminary Plat approval on December 10,
2002.
1. Development of the subdivision shall be platted in substantial compliance with the
approved preliminary plat which governs the location of lots and roadways within the
subdivision.

have been some minor changes, however, such as the elimination of one lot, and
increasing the lot size of another by 20 feet, Please refer to the attached dravAng of the
original preliminary plat to compare it to the vinai piat.
. That the roadways serving the subdivision shall be constructed in accordance with the
adopted Design and Construction Standards for the City of Kalispell for local roads and
include the pavement, curbs, gutters, storm drainage, sidewalks and a minimum five foot
landscape boulevard with street trees placed in accordance with a plan approved by the
parks and recreation director. A lefter from an engineer licensed in the state of Montana
certifying that the improvements have been installed according to the required
specifications shall be submitted at the time of the final plat approval along with a letter
from the KaljspelJ Public Works Department stating that the req u i red improvements have
been inspected and comply with the City Standards.
Attached are the letters frorn WMVV Engineering, the city of Kalispell Public Works
Department and the Parks and Recreation Corrector, approving all of the above.
That a letter be obtained from the Kalispell Public Works Department approving the
sewer and drainage facilities for the subdivision.
Attached is a letter from the city of Kalispell ell Public Forks Department approving all of
the above.
4. That a geotechnical analysis of the slope areas to the north and to the west of the
proposed subdivision be performed that pertain to the stability of the slope and identify
any potential for failure due to development of the subdivision or other construction that
tight occur. The report shall be submitted to the Kalispell Public Works Department for
their review and approval.
This Is not applicable for this portion of Phases XVII.
5. A storm water drainage plan which has been designed by an engineer licensed in the
State of Montana shall be prepared which complies with the it 's Design and
Construction Standards and shall be reviewed and approved by the Kalispell Public
Works Department.
Please refer to the attached letter from Kalispell public Works Department.
. That the developer obtain a lefter from the Evergreen Water District or their engineer
approving the grater main extension and certifying that any necessary improvements
have been completed.
Please refer to the letter from Evergreen Water District approving the water main
extension and verifying water flows for that phase.
7. The road within the subdivision shall be named and signed in accordance with the
policies of the Kalispell Public Works Department and the Uniform Traffic Control
Devices Manual and be subject to review and approval of the Kalispell Fire Department.
The roads were named as part of previous phases.
8. The developer shall provide a letter from the U.S. Postal Service approving the plan for
mail service.
This has been done as part of previous phases as well,
9. Street liahtin-q shall be located within the subdivision and shall be shielded so that it does
not intrude unnecessarily onto adjoining properties.
Street lighting has been installed.
10. That the parkland dedication requirements shall be met by recognizing the existing park
and parking improvements as well as open space within the development.

12. That the fire access and suppression system comply with the Uniform Fire code and a
fetter from the Kalispell fire Department approving the access and number and
placement of fire hydrants within the subdivision as well as fire flows and access shall be

and approved by the fire department prior to final plat approval.

13. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be
completed prior to final plat submittal.

1 . All areas disturbed during development of the subdivision for this shall be re -vegetated
with a weed -free mix immediately after development.
This has been Incorporatedinto the Subdivision Improvement Agreement.

'The plat must be signed by all owners of record, the surveyor and the examining land surveyor.
Attach a. letter, which lists each condition of preliminary plat approval, and individually state how
each. condition .has specifically been met. In cases where documentation is required, such as an
engineerys certification, State Department of Health certification, etc,, original letters shall be
submitted. Blanket statements stating, for example, "all improvements are in place" are not
acceptable.

the preliminary plat.

a minimum of 2 '' In addition boulevards need to be seeded or sodded boulevard and
trees need to be of a species on the enclosed list.
Final approval will be given upon completion, inspection and approval of the
