The applicant has applied to the City of Kalispell for a conditional use permit to operate a
dance school within an existing building located at 42 Bruyer Way in a Residential/Professional
Office, R-5, zoning district. Dance schools fall under the definition of commercial schools, which are
listed as conditional uses within the R-5 zoning district.
The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on
October 12, 2010, held a public hearing on the application, took public comment and recommended
that the application be approved subject to two conditions.
After reviewing the application, the record, the KPD report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Kalispell Planning Department Conditional Use Report #KCU-10-6 as the Council's findings
of fact, and issues and grants to the above -described real property a conditional use permit to operate
a dance school within an existing building located at 42 Bruyer Way in the Residential/Professional
Office, R-5, zoning district, subject to the following conditions:
Commencement of the approved activity must begin within 18 months from the date of
authorization or a continuous good faith effort is made to bring the project to completion.

2. Prior to operating the dance studio the applicant shall apply for and receive a building permit
fur tenant improvements necessary to allow the dance studio to operate. All improvements
shall comply with current building and fire code standards and be completed prior to
operating the dance studio.
