SUBJECT Cottage Gardens Subdivision — Request for one-year preliminary plat extension
MEETING DATE: February 1, 2010
BACKGROUND: This is a request by Long Engineering on behalf of the developer of Cottage Gardens
for a one year extension of the preliminary plat of the subdivision. The subdivision would create 30
residential lots and was approved on April 2, 2007 by the Kalispell City Council subject to 24 conditions.
The Cottage Gardens Subdivision is 10.7 acres in size and is located on the north side of Three Mile
Drive %2 mile west of Stillwater Road and approximately 1/ mile east of the BPA power lines. The 10.7
acre subdivision site is zoned R-31, Urban Single Family Residential.
The Kalispell Subdivision Regulations, section 2.06.E.7, allows the subdivider to request a one year
extension of the preliminary plat approval deadline from the city council. A one year extension would
give the developer until April 2, 2011 to file the final plat.
RECOMMENDATION: A motion to adopt the resolution and grant a one-year extension to the
preliminary plat approval for the Cottage Gardens Subdivision would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

A RESOLUTION APPROVING A ONE YEAR EXTENSION TO THE PRELIMINARY
PLAT OF COTTAGE GARDENS SUBDIVISION, LOCATED ON THE NORTH SIDE OF
THREE MILE DRIVE ONE-HALF MILE WEST OF STILLWATER ROAD.
WHEREAS, the city council of the City of Kalispell granted preli m* nary plat approval for Cottage
Gardens Subdivision on April 2, 2007, and
WHEREAS, Long Engineering, PC, on behalf of the owner, now desires a one-year extension to
the preliminary plat for Cottage Gardens Subdivision in order to finish the
infrastructure necessary for final plat, and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and
Platting Act allows the city council to grant a one-year extension to the preliminary
plat in addition to the original three year approval; and
WHEREAS, good cause exists for the request for extension by Long Engineering, PC and it is in
the best interests of the city that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the application of Long Engineering, PC for a one-year extension of the
preliminary plat of Cottage Gardens Subdivision, Kalispell, Flathead County,
Montana is hereby approved.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR. OF THE

Dear Mr. Jentz:
Please allow this letter to serve as a formal request for a Preliminary Plat extension of
one year for the Cottage Gardens Subdivision. The City Council conditionally
approved this subdivision on April 2, 2007 with an expiration date of April 2, 2010.
We are requesting a one-year extension, with a new expiration date of April 2, 2011,
as it is not possible, at this time, to have the necessary improvements completed prior
to the current expiration date. This extension is necessary due to unforeseen
dramatic changes in the marketability over the past two years.
If for any reason questions or concerns arise regarding this document, please feel free
