RE: (Buffalo Commons PUD - Use Accessory to a Hotel/Motel
I want to point out a potentially significant aspect of the
Development Agreement as it pertains to Hotel\Motels and uses
accessory thereto. As written, the agreement will allow as a
permitted use a Hotel/Motel. Additionally, the agreement will
rely on Section 27.22.020 of the Kalispell Zoning Ordinance for
the governing of accessory uses within the PUD. I think it is
important for the council to realize that this means in addition
to the permitted hotel/motel, it is possible that a bar,
restaurant and/or gift shop could also occupy space within the
hotel/motel.
While restaurants or gift shops are otherwise permitted within
the retail/commercial/office pod of the PUD, and are not of
concern, the possibility of a bar in the PUD has not been
previously discussed. Would it be appropriate to specifically
name bar/tavern/night club as a prohibited use within the PUD, or
do you think it will be an issue with the council?
I don't think it has ever been the applicant's intent to allow
this kind of use, but at the same time I don't think it is wise
to leave the door open for future debate with other owners or
developers, either.
