Memo Hansz/Irrigation Water Service�IA MEMORANDUM August 12,1998 To: Glen Neier, City Attorney / Interim City From: Jim Hansz, Director of Public Subject: Irrigation Water Service, Buffalo Commons At Council direction, irrigation water service has beekIVovided to Buffalo Commons to irrigate their public area landscaping. However, to date there has been no payment of connection fees because the actual fee has not been set by the Council. As I outlined in my May 26`h memo to you on this matter, the present ordinance does not specifically identify our ability to provide this service, and it does not list any connection fee. In view of the overall desirability of public and quasi -public landscaping to beautify the City in general and enhance neighborhoods, I believe the message sent by the Council was that the usual rationale of equitable cost recovery for capital facilities that provide water should be modified to reflect a public desire to encourage landscape beautification. In making such a change it is understood that the public would view the resulting landscape enhancement to be an investment that should, in some way, be publicly supported. In this case, the lowered connection fee would be the public investment to promote these enhancements. To date, I have received no further comments from the developers of Buffalo Commons on this but I believe they share this point of view. Therefore, I recommend the present water ordinance be modified to clearly identify and authorize landscape irrigation water service in conjunction with required public or quasi -public landscaping installations. I have modified the attached schedule B-1 to reflect the changes outlined above. Please review this and let me know whether it is satisfactory. If satisfactory, please redraft these changes into the proper modification of ordinance #4288 and schedule it for consideration by the City Council. No minimum monthly fee will be assessed against these separate sprinkling services except during the Sprinkling Season. No Sewer Fees will be assessed against these separate sprinkling services unless water is used for other purposes (which is prohibited in the Rules and Regulations.)
