Referencing the above matter, please find enclosed the following copies of
Declaration of Covenants, Conditions and Restrictions of Buffalo Commons (Single
Family); (Multi -Family); (Common Area); (Retail/Commercial/Office); and (Medical
Facilities).
As you can see, I have added a provision for a banking finance use to the
Declaration of Covenants, Conditions and Restrictions of Buffalo Commons
(Retail/Commercial/Office).
Also, I have revised the Declaration of Covenants, Conditions and
Restrictions of Buffalo Commons (Medical Facilities), which is Exhibit F to the
Ordinance. The noted change here is on page 6 where I have added:
"Offices: Professional/Governmental
Attorneys
Accountants
Appraisers
Real Estate Brokers
Surveyors
Other professional offices
All State/Federal/County Municipal Offices"
In summary, you should now have a complete set of revised covenants to
adopt via the new Ordinance.

Insofar as the provision for H-1 parking standards applicable to
medical/professional/governmental offices, please find a proposed Addendum No.
1 to the Development Agreement.
Please review and call me as to when you will need the original signed
Covenants as I will then secure the signature of Northwest Health Care Corporation
and return to you for recordation of the originals.
