I am in receipt of your letter of March 5, 1996, in regard to the above
referenced matter.
The property owners are in general agreement with your letter and have
decided to share in the Developers Diversified cost of these improvements.
It is the property owners concern, however, in addition to the elimination of the
cost of a traffic signal from this project to control the costs of the remaining
improvements and would therefore only consider direct payment for these
improvements with the City's agreement to administer and direct the
construction of the improvements.
If the City is in agreement, the property owners would secure the necessary
bids on the improvements and if the bid amount is acceptable to all property
owners, they would then proceed to award the bids on the condition that the
City staff would coordinate the construction and payment therefore on behalf
of the property owners.
Please advise whether the City can agree to this process at which time I feel
it would be appropriate to enter an agreement between the City and the
property owners setting forth the respective obligations of the City and the
